However they did feel a need for some type of guidelines or criteria but felt this should be basically left between Staff and NPO # 1. REASON FOR CONDITIONAL USE ACTION: • The Greenway Town Center was zoned under a Planned Unit Development and the Zoning Ordinances of the City of Tigard . The use of donut and ice cream shops are a permitted "USE" but not in a free standing building. Our interpretation of the ordinance is a restriction of P fast food busineas requiring drivein lanes , parking and on-site traffic circulation. Technically the building which we have completed is a free standing building, but the "USE" , (Confectionary Shop) which we propose is supported by foot traffic and is located in the midst of many other shops and is a part of the shopping center company. The confectionary shop by regulations become a restaurant by virtue of selling a variety of Hot Dogs and Soft Ice Cream, and it now is necessary to ask for a Restaurant Conditional • Use Permit to comply with the Zoning Ordinances of the City of Tigard, 2. COMPREHENSIVE PLAN CONFORMANCE : The shopping is existing and has met all comprehensive plan requirements . 3 . PUBLIC AND COMMUNITY BENEFITS : Judy ' s Treat Shop (Tenant) is the only retail shop in the Greenway Town Center or in the immediate area (freeway interchange at Scholia Ferry Road and Highway #217 is the closest services to this site) selling the types of • confectionary items and prepared food being offered , such as , Soft Ice Cream, variety of popcorn , cold drinks , variety of Hot Dogs,, candies and etc, Other Tenants in the °hopping center do, through special promotions and single items , sell some of these commodities , but Judy ' s Treat Shop is a spe- . cialty business selling these commodities as a business . 4 . ENVIRONMENTAL, ECONOMIC OR SOC1AI CONDITION CHANGES : • The Tenant Mix on the Creenway Town Center is benefited by the Judy ' s Treat Shop type of tenancy which provides an unfilled type of service in the immediate area . The economic impact on other tenants in the Shopping Center is minimal and does not create a competitive advantage or dis- advantage to other tenants by adding Judy ' s Treat Shop , There is a social benefit by the fact that each time another • non-competing type tenant is added to the existing tenant mix more services are offered to the consumers , making the shopping center a one-stop service to the immediate popula- tion. 0 • • . (4 ‘4 , • 5. SUITABILITY OF THE PROPOSE LAND USE : The Greenway Town Center is an existing facility and this is • not applicable for a Conditional Use Permit . • 6 . THE IMPACT OR EFFECT OF THE PROPOSED "USE" ON THE IMMEDIATE AREA: There are no sevices on adjacent sites because the immediate area is basically residential, the Greenway Town Center is complimented by an additional tenant , and the immediate , neighborhood is benefited by the expanding tenant mix. 7 . IMPACT ON PUBLIC SERVICES : • When the shopping center was developed , environmental , roadways, parking, esthetic design, utilities and other • • public services were considered. On site traffic circu- lation is not impacted because Judy' s Treat Shop supported • by walk—in consumer traffic created by the many Tenants in the center. Seating capacity in the facility is not pro- • vided , Customers will walk in, make their purchase and walk • out . The shopping center Owners and Tenant have met all the inspection requirmenta by the City of Tigard and Washington County Health Department to operate under a Conditional Use . • Permit . CONCLUSION : • The question before the Planning Commission is , can Judy' s • ' Treat Shop sell Soft Ice Cream and a variety of Hot Dogs , . , and other related items . All other commodities for sale do not require a Conditional Use Permit , The Zoning Ordinance of the City of Tigard and the Washington County • health Department regulations define this business , because • of the two items mentioned herein a restaurant and there- fore a Conditional Use Hearing before the Planning Com- mission is required.
