Dear Sir:
Please be advised that the Tigard Planning Commission at their regular
meeting of November 25, 1980 approved your request for a Conditional Uso
4 Permit to construct seven duplexes at the above referenced project.
This approval is subject to the following conditions: ,►
1. A nonremonstrance agreement shall be signed for the future improvement of
Bonita Road to collector street standards. This agreement shall be made
a part of each deed for each lot. If this is not done, the developer
shall be responsible for half street improvements to Bonita Road.
2. A twenty (20') foot right-of-way dedication shall be made to the City
on the frontage of this entire property along SW Bonita Road.
3. Protect shall be subject to Site Design Review prior to the isstianco of
Building Permits.
in 4. No Occupancy Permits shall be issued until all conditions placed upon
this development by the City of Tigard have been satisfied and inspections

The APPLICANT'S PRESENTATION was made by Robert Cruz of David
Evans St Assoc., Inc., Portland, who briefly sZ,Ated agreement with the
staff report and requested approval by the commission.
There was no PUBLIC TESTIMONY.
Howard clarified the apparent'discrepancy between half street
improvements called for by Condition 1p and the assumption of a nonre-
monstrance agreement in Condition 2. He outlined developments occuring
• on Bonita atanti expreeced conviction there would be an LID for this

4 improvement in the foreseeable future.
COMMISSION DISCUSSION AND ACTION: Although Funk expressed surprise , 4
that the commission had previously approved seven duplexes for the site)
none had problems with the request. Speaker inquired about the poesi-
bility, in view of the tentative layouts of the buildings, of ever
making them common wall single family dwellings. Cruz stated there was
no intention they be other than duplexes, and agreed the building siting
would not lond them to this sort of partitioning or division.

I. Findings of Fact:
1. The site is designatad "Urban Low Density Residential'''. on
the NPO 5 Plan and zoned R-7, Single family Residential.
2. Section 18 .20 .020 (1) of the Tigard Municipal Code permits
"Duplex residential, with a minimum lot of 10,000 square
feet: one duplex per lot or two single family attached
units with a minimum lot area of 5,000 square feet per
unit. " In the event it appears that it is not practical
to divide a legal lot into two lots of 5,000 square feet
each, the planning director may approve the division not-
'
withstanding the fact that one lot is less than 5,000
square feet, provided o however, that no such lot shall be
kaataller than 4,250 square feet.
3: The applicable policy from the Tigard Housing text is the
folloWing:

Policy 15: Provide greater di.oersity of housing density
(e.g. , duplexes, four-plex, attached single family
units, etc. ) .
II. Staff Observations:
1. The site is a relatively flat, vacant parcel surrounded by
apartments or the north; residences to the east; pasture
to the south; and a home on the western portion of the tax .
lot. This western portion is designated on the NPO 5
Plan as Commercial and zoned C-50 "Limited Neighborhood
Commercial" .
2. The applicant is proposing to develop a seven lot duplex
subdivision on 10/000 square foot minimum lots bordered
on the north by Bonita Road and to the west approximately
310 feet by Hall Boulevard.

3. S.W. Bonita Road is designated a collector 'street on the
NPO 5 Plan, requiring 60 feet of right-of-way, where 40
feet presently exists. Normally, an additional ten feet
of dedication is needed along the parcel 's street frontage.
However, the road takes a bend at this point due to the
severity of the slope (in excess of 25 percent) on the
north side o/A: Bonita directly across from the site. This
slope therefore requires all widening to take place on the
south side of Bonita Road. This requirement is justified
by two facts:
(1) It is unlikely that the two properties to the north
4, will be able to gain access from Bonita due to the
slope problem. In fact, the western parcel, which is
presently developed multi-family, gains access from
Hall Boulevard.
(2) The subject property, when completely developed, will
, consist of a neighborhood convenience shopping center
and (if approved) a duplex subdivision. Therefore,
this property substantially benefits from the access
provided by Bonita and should therefore be expected
to provide for the upgrading necess"..ated by the con-
• tinued development of properties abutting its front-
age.
Therefore, the additional 20 feet of right-of-way should
be provided on the south side of the street to facilitate
lessening the additional engineering and costs entailed
•
in the improvement of Bonita Road at this location.
4. The location of duplexes adjacent a designa.Fed neighbor- .
hood shopping area along the west side of the proposed de-
, •
velopment would provide a transitional land use between
the single family residents to the east and the designated
single family properties to the south. The same buffering
effect would be provided along the northern portion of the
site that fronts on Bonita Road. S.W. Bonita is a collec-
tor street, and there are apartments directly across from
the proposed development.
5. Sanitary sewer is available to the site via a ten inch
lin lust north of Bonita Road. Water service is also
• available from the Tigard Water DiGtrictis eight inch
line and 16 inch high pressure line in Bonita.

III. Conclusionary Findings:
1. This request conforms to the density limitations of the R- 1
4 7 zone (Single Family Residential) and Urban Low Density
Residential designation of the NPO 5 Plan.
2. The duplexes will provide a buffer between single family
homes and the property to the west - t such time as it is
0 developed commercially and will also provide a buffer be-
tween the apartments to the north and the homes to the
east and single family development to the south.

3. There is an identified public need to provide a diversity 1 .
I . of housing types within the community, according to poll-
des set out in the Housing Plan.

4. The dedicPtion of 20 feet of right-of-Way along Bonita Road

1. Nature of o_posal
$
This site currently .consists of 2.2 acres of undeveloped
I land located o the south side of S.W. Bonita Road
approximately 300 feet east of. Hall Boulevard. Much of
• the property in the area is similar in nature, although
some of it has recently developed into residential
neighborhoods. Hambach* Park :exists directly south, and
Pinebrook Terrace and Greensward Park are located en the
West side of S.W. Hall. Waverly Meadows is located to
the northeast. A large apartment complex exists direct.i.y
across Bonita Road.
The developmen4-. plan calls for residential , and the
existing zone is R-7. The R-7 zone in the City of Tigard
is residential in nature, with a minimum lot area for
duplex use of 10 ,000 square feet. This conditional use '
application proposes subdivision of the 2.2 acres into
seven duplex lots with an average size in excess of 11 ,18L,
square feet. No variances are being required.
2. Conformance
The Plan of Development calls for residential, and the
proposed conditional use conforms to this designation.
Current zoning on the Parcel iS R-7, which specifies a
minimum lot size for duplex residential of ten thousand
square feet, ore duplex per lot. The proposed use exceeds
this minimum.

The Tigard Planning Commission on December 6, 1977 approved
a conditional use permit for seven duplexes on this site.
A copy of that approval is attached. As indicated by
that approval, the proposed land use is in conformance
with the residential land use designated by the R-7 zone.

21. Community Need
The development of this property into residential duplex
lots continues theCity''s goal of .providing a varied
housing mixture, addressing the, needs of the public in
general. Residential development of this .area is
characterized by houSing which ranges from apartment
• • units located directly north and single family units
directly south. A. small, duplex subdivision located
between the two meets the community' s need in terms of
y. providing the varied 'mixture of, housing and at the same •
time providing a transition from one type to another.
4. Potential Impact
No change in zoning or Comprehensive Plan is being
requested. The Tigard Planning Commission on December 6,
1977 approved a conditional use permit for seven duplexes,
on this site. Therefore, the impact is that anticipated
when the area was designated residential by the City.
Direct social and ?hysical environmental impact of
approving the proposed 'subdivision would be a potential
of 14 households added to the community and their needs
for public and quasi-public uervices.

6. Effect on Neighborhood
This property is relatively flat, varying from approximately
\.
2% to 12%. The center of it forms a crest, and it falls
both to the east and west. This site is particularly
suited to both the existing one and proposed use.
Since this land is already zoned R-7, the value of the
property will only be increased by the improv=ents
constructed, Raw Land value will only be slightly increased
• # by approval of the proposed preliminary plat.
•
This development would add 14 households to the area and
ould have minimal impact on service z available, to the
area now. It would have no effect upon natural resources.
7. Impact of Services Necessitated
Since the proposed use is in conformance with the existing
zone and will add only 14 families to th( area, the impact
upon public services will be minimal. Water is available
from the Tigard Water District by means of an eight-inch
main on the south side of Bonita Road. Sanitary sewer exists
just west of the site. 8.1,4, Bonita is designated a collector
street on the NPO 45 Plan. Therefore, the preliminary plat
reflects a 20-foot dedication for the improvement of Bonita
to centerline.
