This approval is subject to the following conditions:
1. That ten (10 feet of right-of-way be dedicated along
S.W. 72nd Avenue and that the property owner sign an
agreement not to remonstrate against a future local
improvement district for street improvements to S.W.
72nd Avenue.
2. That a detailed site plan in substantial compliance
with parking and landscaping requirements be sub-

8. Applicant's Presentation: Ralph Terran, 3525 Lake Grove Ave., Lake Oswego,
represented both developments; he stated they had maintained the 2 units
per acre density as designated by NPO 6; he referred to #5 stating that
the required sight of way dedication was acceptable; #7 the storm water
runoff had not yet been detailed and he would wait until the lotting arrange-
ment was approved; #8 the site plan had been made; #9 pertaining to the road
pattern, the loop drive followed the topography, tie lot layout was the
best possible, an increase in width would be exces3ive; cul-de"sacs were
to serve driveways only; #10 the trees on the WaymLre site are too numerou
and need thinning anyway for optimum growth; #11 the NPO 6 plan called
for visual access and the lots were wide enough to allow this along the
Tualatin; #12 was agreed with; Staff Recommendation #1 was okay; #4 street
tree and landscape plan was being prepared at this time; #5 the common area
to be dedicated to the public was acceptable; #7 and #8 were okay; #9
was questioned; #10 the 12 7o slope would not provide a slope problem.
Wood asked how the loop road would tie in with a future development adjacent.

, Paul Grimstad, son of the owner of the parcel of land, stated he' had
contacted Mr. Fennel who responded due to the future construction of
elementary schools in the area it would be no problem.

Based on the findings of fact and conclusionary findings, staff
' recommends approval with the following conditions:

1. Twenty-five feet be dedicated along S.W. Durham Road to provide
the necessary right-of-way for future street improvements, and
that the intersection improvements be provided for the access to
Durham Rd.
• 2. That a storm water plan be submitted for public works department
approval. Prior to submission for general plan and program review.
,6 3. That easements be provided adcording to public works department
specifications for drainage and utility purposes.
4. That a street tree and landscape plan for all cul-de-sacs and
the northern common area be submitted for design review approval.
5. That the common area along the Tualatin River be dedicated to the
public.

portion of the site be revised to meet the intent of the Np0 #6

way with 32 feet of pavement.
7. That 5 foot sidewalks be provided on both sides of all local streets

8. That maintenance of the cul-de-sac islands and the common area along
S.W. Durham Road be assigned to the Homeowners Association.
9. That a survey showing the location of the major trees on the site
be submitted with the general plan and program. '
10. That soil stability tests be provided for all lots proposed on
slopes in excess of 12 percent grade.

Speaker questioned the 25 foot right of way dedicated on SW Durham.
' Brian stated it was a Fine development and. the wider streets were
warranted as requested by staff; requested the inclusion of a centrally
accessibly recreation spate; and was concerned over the flood plain
encroaching on private lots.
Rossman z•'is in favor of the proposal.
Corliss was in favor of the concept; didn't want to be held to this
specific lot pattern; also was concerned that a play area for children
be provided; stated Design Review must look at this proposal very

Wood asked if there was not to be a bike path along the Tualatin?
Altman stated it could be provided.
Wood asked about clustering lots
Altman stated the density along the river was actually 7 units per acre.
Wood asked the bike path be considered; the lots along the river should
be rearranged and were too small; a street improvement was needed at
Durham,
McMonagle stated it was a county road and no improvement was required,
+ . Tepedino stated the ideas on the bike and pedestrian paths were good;
the flood plain issue concerned him and made a motion for approval of
the request with the addition of Staff Recommendation #11 that the
developers along with staff review the advisability of a bike path and
pedestrian path and also a centrally accessible recreation space, and
#12 no platted lots will encroach in the flood plain.
Wood ammended Staff Rec. #9 to read "of the trees at least 12" in diameter".
Brian seconded the motion. The vote was unanimous.

retail take-out food service which would occupy approximately
400 square feet in the front of the existing warehouse. The
proposed hours of operation are to be from 9 a.m. to 6 p.m.

5. Southwest 72nd is designated en arterial street south of S.W.
Hampton Street, requiring 60 feet of right-of-way. There is
currently 40 feet of right-of-way therefore, necessitating an
) additional 10 foot dedication.

be required for customers waiting to pick up ordered food
itefus. However, because of the nature of the proposed
• business (take-out only) customer parking would be expected
to be short term in nature. There appears to be sufficient
' area to provide for adequate parking. A circulation pattern
can be established through the design review process.
• 8. The location of the existing building does not allow for strict
adherence to the setback requirements of the M-3 zone, which
are as follows (18. 48.040) :

(1) Front yard thirty feet
(2) Side yard twenty feet •
(3) Rear yard twenty feet' •

reduce the front yard setback to only 20 feet and, the exist-
