REQUEST: To locate a landscaping contractors business in an
"M-4, Industrial Park" zone as a conditional use.
LOCATION: On Hall Blvd. , south of SW Burnham S . (Wash. Co.
tax map 2S1 2DA, tax lot 400) .
APPLICANT: Stewart E. Jr. and. SuAnn Schriver (S & S Garden
Service, Inc. )
BASIC FACTS:
1. The Tipard Co. Plan designates this area as "commercial-
0 . , industrial" and is zoned "M-4, Indus-trial Park" .
2. Hall Blvd, (State Highway #217) is designated as an arterial in
the TCP. Arterials are intended to carry large volumes of traffic,
.
provide limited access to abutting properties and have limited
street parking.
• • . 3. Section 18.52.020 of the TMC allows contractors office, storage
and silpplemental retail sales as a conditional use in the M-4
zone.
• FINDINGS:
1. The applicant has requested a conditional use permit to operate
• S & S Garden Service, Inc. (a commercial landscaping contractor
with storage) on Hall Blvd. , south of SW Burnham St.
2. The surrounding land use consists of Oregon Food Service across
SW Hall, flood plain on the south, General Telephone to the west
and a vacant, dilapidated dwelling on the north.
3. The site consists of an existing, vacant dwelling unit and three
garage/storRg sheds. There exists an abundance of natural
vegetation on the site including medium height birch trees and
overgrown hedges.
4,3 All but one storage shed is shown to remain for use as equipment
• and material storage and the back portion of the dwelling is
proposed for use as an office area.
5. Equipment presently stored on the site includes a dump truck,
rider-lawnmower, (2) equipment trailers, (2) trenchers, tractor
with rototiller attachement and harrow. Section 18,12.080 of the

TMC requires that all outside storage areas be screened from

adjacent parcels. In that the applicant proposes to store plant
materials on the site, plants could provide the appropriate
screening.
6. Section 18. 60.120 requires a minimum of six parking spaces.
Twelve spaces are shown on the site plan. These spaces are
required to remain open for use as parking spaces, not equipment.
7. The site development plan shows two 12' (me way driveways, 64 ft.
. , 1 apart. The Comprehensive Plan proposes that access onto arterial
streets be minimized and the TMC requires a 30' driveway. The
two one way drives should therefore be combind into 1 two way
drive.
8. No measurements are provided for the parking aisles and stalls.
Section 18.60.160 requires a 9'6" x 19 stall with a 24' aisle
width.
9. Section 18.60.170 requires all parking areas to be paved.
10. Section 18.60.180 requires bumper curbs on all parking stalls
on the boundaries of the parking lot, None are shown on the
plan.
11. Section 13.60.190 requires off 5treet parking areas to have a
drainage system.
12. Section 18.64.030 requires vehicular access drives for commercial
and industrial uses to be 30' minimum width with 80% being paved
and curb cuts closer than 30' apart.
•\..40 13. Hall Blvd. is presently a 50' and 60 ' right-of-way along the
site. The Tigard Commun)4x Plan calls for a minimum 801 right-
, 0 of-way for an arterial ana SFRIon 17.28.040 requires a minimum
100' right-of-way for primary arterials.
f 14. The material storage bins along the driveway are shown to be
, approximately 701 from the right-of-way. Section 18.52.040(1)
• requires a 40 ' front yard setback and Section 18.12.100(D) requires
an additional 40 ' setback along SW Hall,
15, The new access onto SW Hall Blvd. requires a state highway dept.
access permit.
15. The Fanno Creek 100 Year Flood Plain at this site is 146' MSL.
No fill is to be permitted without a flood plain fill permit.
