Mr. Lewis said he still feels the application should be tabled that engineering studies requested by the staff have not been submitted. He also said he would like to hear whether the Fire District would recommend it, that he was not yet sure that the proposed tank wouldn° t be duplication, and that it was the duty of the Commission tu prevent such duplication when possible. b. Mr. Phillips said he felt the Commission should be de- ciding whether or not the tank should be in this parti- cular location, not whether or not there was need for the tank. C. M. Paterson concurred with Mr. Phillips and asked what the Fire District's comment t the staff had been. Mrs. Wied and Mr. Telfer explained that Mr. Taylor had said ho felt this tank would not have sufficient capacity to serve the area if it were built, and that the Tigard District's 2 million gallon tanks on 66th Avenue could serve this area with Bull Run water if it were requested by the area, and could serve it adequately for both fire and domestic purposes from the already existing 12" line which runs down 72nd Avenue. Mr. Telfer further ex- plained that he could not with clear conscience recom- mend this at this time, and could not until a long-range plan showing that this tank would not be a duplicate facility and that it is necessary tu serve the area. d. It was moved (Lewis), seconded (Severson) and passed by unanimous vote of the Commission present that the re- quest be tabled until the next meeting on June 17, in order to get more information. . Stover for an amended Conditional Use for a Day Nursery for increase in tne number of children allotted her since the last hearing our objections are as follows: We still believe it creates an extreme traffic hazard and congestion, as it is located on the corner of Hunziker and old Hwy 217. The property in question is adjoining our property, and in our estimation it is very poorly kept up. It can become a blight to the neighborhood, but if that is whal(the zoning commission wants, so be it. It seems that that this hearing was not to come up again until two years had past. Ruling bodies making these decisions are worthless unless they abide by them. We are getting tired of coming to meatings at the whims of every Tom, Dick and Harry. Either rezone the whole area or keep it intact as is, Breaking it up piece meal zact will just create a Tigard ",rAumil The property does not lend its3lf to a further increase in capacity, and it is not fair to surrounding property owners to be subjected to 30 children on such a small piece of property. The property is located on a vt,..cy busy and hazardous intersection. The police department vigorously objects to any additonal problems being created there. It is felt that the location is a poor one, and in a more appropriate area, or if additional property could be made available for better parking and accesr,, there wuuld probably be no objections to Mrs. Stover's request. Last year, on appeal by the neighborhood, after conditional • approval by the Planning Commission, the City Council approved the Conditional Use for a probation period of one year, limited the number of children to ten, and imposed parking provisions as set forth by the Planning and Zoning Commission. Complaints have been received during the year particularly regarding backing cars from the driveway onto Hunziker Road. Accord- ing to plans previously submitted to the Planning and Zoning Commission, such backing movements were to be eliminated by using the driveway for backing from four paved parking spaces on the property. This might work if people were inclined to do this, however, they don't seem to be so inclined. At this time, only three of the four spaces approved' by the Commission have been paved. This approval originally of only four spaces was a variance from the zoning Ordinance which requires a minimum of eight spaces per nursery school (Sec. 190-4). The staff does realize that this traffic problem occurs usually only in the evening, occasionally in morning, and is not an all day situation. Unfortunately, however, it does occur when other traffic at the intersection is also at its heaviest. Staff recommendation for approval of any additional children cannot be made until the present number can be adequately handled traffic-wise. As used in sections 23-004 to 23 -026, unless otherwise required by contexts (1)'1Day Nursery" means any institution, establishment or place in which are commonly received at one time three or more children not of common parentage, under the age of 6 years, for a period or periods not exceeding 12 hours, for the purpose of being given board, care or training apart from their parents or guardians for compensation or reward. (2) "Board" means the Oregon State Board of Health. 23.004 APPLICATION FOR LICENSURE. All persons contemplating the establishment Of a day nursery shall apply to the Board for a license on a form provided by the Board, and remit the vequired license fee at least 30 days before the open. ing of the nursery. 28406 LICENSE. (1) On receipt of the application for a license the Board's representative shall make an evaluation inspection for consideration of licen- sure. (2) All licenses shall expire at the end of the fiscal year in whioh they were issued. Renewal shall be on an application form as provided for their in- itial issue, (3) Each license certificate shall specify the number maximum and minimum ages, and other limitations (if any) concerning the children who may be admit- ted, and clearly identify the premises where the day nursery is located. (4) Licensee are not transferable, and shall be valid for the premises there- in described only. b) The license shall be conspicuously posted within the institution. (6) Day nurseries are prohibited: (a) In combination with maternity or other nursing care. (b) In combination with boarding care of aged persons; or (o) In households with one or more mentally defective, epileptic, senile or psychopathic personal and licenses will not be issued under any of these air.. cumetanoea. (7) Day nurseries will not be licensed, if children more than 6 years of age are admitted for care, or where children are admitted for periods exceeding 12 hours, unless special permission of the Board has been obtained. 23.008 PHYSICAL PLANT. (1) The following will be considered essential to every day nursery, indoor and outdoor play space, adequate sleeping space, isolation facilities, lavatory and kitchen. (2) The outdoor play space shall be sufficient for recreational purposes. It shall be suitably surfaced and have good drainage. (Space that is covered and unable in rainy weather is desirable). Protection from the street traffic and other hn2ards to life or health is essential to approval of the play apace. n -2- (3) Buildings must have the approval of the State Fire Marshal and comply with Local Building Codes. (4) An adequate supply of water of satisfactory quality shall be available for drinking and household uee. (5) Convenient and sanitary toilet faoili,ties shall be provided, with at least one toilet and one wash basin for every 10 ohildren. (a) The plumbing system shall meet the Standards set by the Boards (7) The heating plant shall be capable of maintaining a temperature of approximately 70 degrees Fahrenheit at a point 24 inohes above the floor in all roans 000llpied by the ohildren. (8) All rooms used for the oare of ohildren shall be above the street level or grade. (9) All rooms shall be well ventilated. They shall have at least 36 square feet of floor npaoe, and 280 oubio feet of air apace for eaoh child. No hazards to safely within the play space shall be permitted. 23014 DIETARY. (1) Proper and adequate food shall be provided and served. (2) Food served shall be sufficient in quantity, of a quality supplying proper nourishment, and suited to the needs of the ohildren for whom it is pre.. pared. 23.i016 RECREATION. (1) Suitable play materials chosen with a view to the age groups of the children shall be provided. (2) Play materials shall not be hazardous to the children using them. (It is recommended that children also be protected by immunization against poliomyelitis.) (3) A daily inspection of each child must be made by an attendant before the parent or guardian leaves the child in the nursery for the day. No child with any illness or suspicion of illn ©es shall be permitted to remain, or allowed to come in oontaot with any of the other children. (4) If a child becomes ill while in the day nursery, he must be segregated from the other children and placed in isolation until removal from the nursery. (6) ren. (9) The person in oharge of the day nursery must at all times have current information as to how and where the parents or guardian of each ohild may be quickly reached in case of illness or other emergenoy (The name and address of the family doctor or clinic should also be secured.) 23»022 STAFF AND CHILD CARING PERSONNEL, (1) The staff to care for the child» ren shall at all times be adequate and competent. It shall include a director who shall have full responsibility for the manner in which the nursery is oper- ated, and at least one competent awsietant who shall be available and take charge whenever the director le absent. At least one attendant shall be prevent for each group of 10 children in the nursery. (2) Each member of the staff must be a person of good oharaoter, be in good physical and mental health and adapted by temperament to work with children. (3) All personnel shall Submit to an annual examination to exclude communi- cable tuberculosis. Such examination shall include either a satisfactory nega- tive reaction to an intradermal tuberculin test containing at leant 0.0001* milli* gram of purified protein derivative or 0.1 milligram of old tuberculin or tech- nioally Satisfactory chest X -ray film certified by a physician lioensed by the Oregon State Board of Medical Examiners as showing no evidence susses -live of ao* tive pulmonary tuberculosis. Reports of such examination shall be retained in the filee of the institution and made available an request of any authorized re- presentative of the Board. *Intermediate Test Strength P.P.D. (4) Persona knowing or suspecting that they have a communicable disease must not work in a day nursery. (5) Arrangements Shell be made to always have a physician sional standing available when the physician designated by the (See subseotion (2) of section 23-024) cannot be reached. 23 -024 REPORTS AND RECORDS. (1) The following information received for dare sha11 be recorded at the time of admission (a) Name (b) Address (o) Sex (d) Date of Birth (e) Date of entering (f) Name, work addresses and telephone numbers of parents or guardians. (g) Naine, address:1 and telephone number of the person to be notified in ogee of emergencyo in good profoe' parent or guardian regarding each child and kept on file: (2) A signed authorization by the parent or guardian for the calling of a physician, specified by the parent or guardian, in case of sudden i11rIe,as or accident shall be obtained at the time of admission, and filed with the data re- quired by the last preceding regulation. (3) ''ihe date .end hour when the child left the day nursery shall be record- ed and filed with the admittance records. (4) There shall be a day. -by -day record of all children attending. (5) The medical certificate of physical examination required by subsection (1) of section 23.020, records of the immunization required by subsection (2) of section 23-020 and a record of past communicable diseases, shall be filed where they will be available for inspection by authorized representatives of the State, County or Local Health Departments at a11. reasonable times. (6) In the event of a communicable disease occurring in the day nursery, the Local or County Health Department, or the Local or County Health Officer, must be notified immediately by telephzn'a or telegraph. (7) Death, or severe accidental injury, of a child in the day nursery must be reported immediately to the County Health Offioern 23026 RELIGIOUS TOLERANCE. Except as to the sanitary and safe conditions of the premises and physical equipment, oleanlinesa of operation, and compliance with Laws and Rules governing the control of communicable disease, nothing in these Rules shel be construed as 'authorizing the supervision, regulation or control of the remedial care or treatment of children in any home or institution conducted exclusively for those who rely upon treatment by prayer or spiritual moans in accordance with the creeds or tenets of any well- recognized church or religious denomination. .23.028 CHILD CARE IN COMMERCIAL FACILITIES. Special provision for child care in commercial facilities, i. en, department stores, bowling alleys, etc. (1) No child shall remain in the nursery longer than three (3) hours. (2) All previously stated regulations shall apply except for sections 23.006 (1) (2) (10), 23 -012 (2), 23014 (1) (2) and 23020 (s) (3) Indoor play space, isolation facilities, separate rest rooms for adults and children shall be provided. If nourishments are provided, provision shall be made for sanitary handling, storage and serving. (4) Hand-waahing facilities with soap dispenser and paper towels shall be available in the play area, toilet rooms, and f�." ation area. (5) Only washable toys can be brought into the nursery. (a) The person plaoing the child shall coign a statement upon each ad. mission certifying that the ohild has not had or has not been exposed to a communicable disease within the past week. No child shall be admitted to the nursery who has been exposed to a oomnunioable disease within the prior 7 days. (10) Disposable diapers shall be made available. No soiled diapers shall be Kept in the nurnory except in covered containers. Soiled diapers, other than disposable, shall be wrapped in newspaper and placed in a moisture resistant bag ,for return to the owner. It is abutted on either side by residential lots, and is directly across the street from an M-3 zone. A. BACKGROUND * 1. The request applicant, Delores Stover, made a previous application, which was granted by the Planning and Zoning Commission. The same application was denied by the City Council three weeks later. *Attached sheet No. 1 gives more detail on the previous application. B. ACCESS AND TRAM?IC LOAD INCREASE 1. Access would be provided of of Hunziker onto the property through a driveway cut in the above mentioned road. 2. The load on Hunziker would not increase significantly, because the applicant intends to transport the children in her own vehicle, both to and from the parcel under discussion. C. DISTURBING INFLUENCE TO ABUTTING PARCELS 1. The staff feels that because of a high wooden fence, normal weather conditions, and the age of preschool children, that the disturbance would not be signifigant. D. STAFF RECOMMENDATION The Staff recommends approval of the Conditional Use on the following grounds. 1. That there are no traffic load increases. 2. That there are no access or egress problems. 3. Hunziker, Map lBc Tax Lot 110047 The Commission granted the Conditional Use request by a unanimous vote with the following conditions: 1. That the applicant submit at the next regular meeting plans for parking and plans for a turn -a -round on the property. 2. That this Conditional Use be restricted to a five year limit. ,At the next regular meeting on July 18, 1967, Dolores Stover, did r ubmit said parking plans.
