Mr. Frank Cresmer, 9980 SW Garrett, spoke in opposition saying there was already too much traffic on Garrett Street, and that multiple units were not rppropriate in this location. Mr. Chester Curry, 9975 SW Garrett Stree4 also spoke in opposition to additional traffic. Mr. Adkins, applicant, explained his proposal and stated that, by leaving the existing house on the front of the lot, the street would appear essentially the same as it has in the past. Mr. Taylor said, no, that this office is concerned with life, and the insurance people are concerned with dollars - - than an insufficient amount of hydrants raises the fire insurance rates. d. Mr. Aitken suggested that the hearing be continued next month so that the water and fire problems could be investigated and solved. He said that he was faced with the same problems with his subdivision to the south. e. Mr. Perry asked if the fire and water conditions weren't a problem of the building department when issuing a permit. Ar. Paterson asked if the Planning and Zoning Commission should be an enforcement agency for the Fire and Water Diotricts. f. Mr. Severson said he felt it was fairer to table this application until the Water District can be counsulted as to its schedule for improvement of Garrett Street. (1 Mr. Paterson asked Mr. Adkins if this was agreeable to him. Mr. Adkins said it appeared there really was no other alternative. 4. S. Conditional Use Application: Dolores Stover, applicant owner. A request for a Conditional Use in the R-7 zone for a day nursery without limitations on her property located at 8845 SW Hunziker Road, Tigard, Oregon (Map #251 1BC, Tar Lot 1000) 1. Staff recommendation for denial. 2. Public Hearing: a, Mr. Mayes, 12450 SW Knoll Drive, stated he felt that the parking situation was still inadequate, that Mrs. Stover should still be limited in the number of children she may care for, and that traffic in the area has only gotten heavier during the year. Mr. Joe Zawaske, 12360 SW Highway 217, said additional children would be outrageous and he already objects to the noise. Mrs. Stover said that she didn't realize that she hadn't complied with the request of the Council as to her parking; she thought she had provided all she was supposed to provide. She said she now had more than ten rhildren, but that she had complied with the Council's limit until this September. She also stated that she hoped to have 25-30 children to care for under this application. Mrs. Mayes, 12450 SW Knoll Drive, said she felt the number of children also should be limited. The Public Hearing was closed. 3. Commission discussion and action a. Mr. Paterson asked Mrs. Stover if she would be willing to bus the children. Mrs. Stover said it would be difficult at this time. b. Mrs. Wied explained the staff feeling that the location was poor and asked if Mrs. Stover would plan to relocate if a limit was put on the number of children. She said, no, that the house would now be hard to sell because of the changes she had made in the house for a nursery school. c. It was moved (Nicoll), seconded (Aitken) and passed by unanimous vote of the Commission to approve a Conditional Use for a day nursery for two years, with four parking spaces and limiting the number of children to ten. Box 23583 Tigard, Oregon PROPERTY INVOLVIO: 10010 SW Garrett Street (Map 2S1 2CB Tax Lot :1600) SIZE OF PROPERTY: 1.35 acres STAFF RECOMMENDATION: The staff recommends denial of thit. application. The plot plan presented shows 18 units: 10 one-story duplex units and eight two-story toWnhouse units in addition to the existing single family home which will become part of the total development. The staff feels that this is too many units for the lot in is present environment; there is undeveloped C-3 zoning along the rear of the lot; there is a small seven unit multi-family development in the adjoining c-3 on the north side of the lot and undeveloped C-3 adjoining this and 99W; a new R-7 subdivision adjoins the property on the south; across the street and closer to 99W on the north an A-2 zone was recently granted basically because topography made the land unsuitable for R-7 development; the rest of the land across the street is undeveloped R-7 in use. The staff also feels the proposed circulation is very minimum and provision should be made for freer movement within the property. A reduction in the number of units would facilitate the circulation' provide more landscaped recreational open space, and give the development a lower density character which would blenlbetter into the residential neighborhood. Previously the desire of the staff and the commission was for this property to be developed in cooperation with the adjoining property to the south. The staff still considers this to be the best development of the two properties and one which would benefit both owners. This could provide good circulation and access for both properties and result in a harmonious planned residential development consisting both of single family and small multi-family units. W. Garrett St., Tigard, Oregon, I would like to express my comments and objections to this request. First, I would like to call your attention to the platt map recently received in which tax lots 3500, B501 and lot 3502 are shown as being zoned C 3-Commercial. In 1064 the Washington County Planning Commission issued to me a zone change on this property from R7 to A2. The map should be corrected as it may have some bearing on your consideration. Item 1 At the hearing on my request for the zone change mentioned above the interested property owners of -bids area were infor med by the nashington t,ounty Planning (Jommission that they felt the area would benefit by the zone change from i ' to A 2 as it would act as a buffer between the it 7 property and the C 3 property along iacific Highway. At the same meeting several members of the Commission Stated that no further zone changes should be made or considered for the R 7 zoned property locat ed between my property and McDonald Ave. It is my thinking that the Tigard Planning Commission should respect the plan as Bet forth .by the County Planning Commission. I think the pre- sent zoning is good and will make a good residential community. Item 2 It is my contention that the 1,35 acres owned by Mr. Adkins 1,s not sufficient size and shape to warrent 10 units. Crowded and congested conditions do not improve or invite the best in- viorments to a come1unity4 I also Abject very strongly to the planned entrance and driveway being placed along our peeperty line. We now have a house and a three-plex unit located oa lot 3501. The heavy traf fic wil create a noise problem for people living in the house and three-plexo Item 3 Since the incorporation of Tigaed as a city I have noticed that many zone changes have been made for A 2 apartments, however to date only a small portion o tit have been develop ed. Today Tigard has ample apartmeolcienilAin4s and with the large' her of new :unite that will soou beco,oe available the vacancy rate will certianly be a problem. With this in mind I see no urgency for more units to be built or even zoned for the same. I have great confidence in our Planning Commission and feel that you have done a good job. I do feel however that the Commission should pursue some type of re- venue to make it possible for a long range planning program covering all areas of our city. If this could be accomplished I ant sure we would have a better coardinated community development, I also beleive it would el- ivate the promotion type of development and irritated property owners. Garrett Ste We understand Mr. Adkios was .previoasly denyed a zone change petition for the purpose of apartment construction on the same property. We do not believe the Oircumstances for his latest zone change request should be conmidered any more now than at that time. Rio intention of a 19 unit complex on such a small and limited piece of ground could only result in a highly congested situtation which we believe the city ha o been trying to control., The driveway, according to the plan shown to us, runs parallel to our property line between us and a house already on his property, which will remain as a rental, leaving approximately 10 to 12 feet from our house to the edge of the propeeed driveway. This would most ceeletainly present anannoyanee both during the daytime as well as at night. Nineteen families coming and ving could keep such a thoro- fare busy at all hour. It would seem the much discussed "buffer zone" protecting resident- ial from apartment, multiple dwellings and commercial ,zoning should certaine. ly be considered as a reason to deny such a zone, change for the property in question.
