Location: 9035 SW Burnham St. (Wash. Co. tax map 2S1 2AD,

BASIC FACTS:
1. Section 18.52.020 of the TMC provides for automotive service
stations and any other similar use as a °conditional use° in
the industrial Park zone.
2. The objectives of the °Commercial-Industrial° area is to con-
centrate in a single location businesses bhat provide specialized .
goods and services or require outdoor storage or display area. "
FINDINGS:
1. The applicant has requested a conditional use permit to locate
an automotive repair business in an existing building designated
°Commercial-Industrial° in the Tigard Community Plan and zoned
M-4, Industrial Park.
2. The subject site is presently occupied by a building which is
jointly occupied by °Sign Craft° and is part of a larger
commercial development (Burnham Circle) which has plumbing,
radiator repair and automotive repair bucinosses. The parcel
to the south is occupied by a residence and a vacant pasture
is east of the site.
3, SW Burnham St. , the primary access to the site, is a substandard
street. A non-remonstrance agreement was acquired by the City
- for an L.I.D. during the original partitioning.

4. Access from Burnham St. to the building proposed for the repair
..) business is over a 30' non-exclusive casement which satisfies
Chapter 18.64 (Access and Egress) of the TMC.
5. The site plan shows a 1350 sq. ft. building. No parking spaces
are shown on the plan and no spaces are marked at the site.
Section 18.60.120 (4) (A) requires I space for each 500 sq. ft.
) of gross floor area, but not less than 3 spaces. Delineation
of the required spaces should be made.

6. The proposed use is for a repair shop exclusively for the
Capri automobile and appears to be compatible with the other
adjacent automotive-oriented businesses and does not appear to
have an adverse impact on the remaining adjacent uses.

1. CALL TO ORDER: The meeting was called to order by Chairman Popp at 7;35 p.m.
2. ROLL CALL; Present; Moore, Nicoll, Phillips, Porter, Sakata, Topedino,
Popp, Krause; staff: Bolen, Daniels

3. APPROVAL OF MINUTES: Phillips noted an error in the minutes of 5/4/76 re
4 . agenda item 1,, The applicant is shown to be O'Donoghue.
The City should also be added as applicant.
The minutes were then approved as amended.
4. COMMUNICATIONS: Members of the Commission expressed the concern about not
receiving a copy of the ethics commission forms and asked

D. PUBLIC HEARINGS;
5.1 ZONE CHANGE ZQ 4-75 (Bunn)
A request by ;ten Dunn for preliminary plan and program review of a pro-

posed multi-family residential planned development in the vicinity of 109th
and Canterbury Lane (Wash. Co. tax map 2S1 IOAD, tax lot 500).
A. Staff Report: read by Bolen
o Porter inquired as to present zoning.
• Bolen responded that present zoning is R-7, single family residential.
° Krause inquired as to whether there was a commitment on the part
of the applicant to adhere to the original plan for the entire
• hill.
o Bolen responded that, due to changes in land use character of the

hill; changes in being annexed to the City; changes in procedures
since the original plan, the planned development as presented should
stand on its own merits.
° Krause asked for a definition of "Urban Low Density Residential,"
° Bolen responded that the Community Plan calls for a density up
to 4 dwelling units per acre,
B. Applicant's Presentation:
° Joe Van Immo architect for the applicant, summarized the project
and showed 3 alternatives for the proposal, but stated their

preference for alternative "B" which includes 3/4 of an acre to
be dedicated for a public park.
Sakata inquired as to how the proposal affects SW 109th Ave.
° Van Lora responded that the right-of-way for 109th is being shifted
. . to the edge of the property and will jointly be provided by this
proposal and when the adjacent property owners come in for their
development approval, The alignment shown will tie in with the
' existing right-of-way to the south.
• Harley Adams, property owner to the east, inquired about building
' height and setback.•
° Van Lom responded that there would be 1, 2 and 3 story buildings,
fiat roofs and stepped back away from the property line with the
closest being approximately 50 ft. to the east property line.
° Adams inquired as to the location of the recreation building and
what screening will be provided.
o Van Lom responded that screening between the swimming pool,
recreation building and adjacent property will be provided and
added that if that is not sufficient) the pool can be relocated
t. more interior to the development.
6 Adams urged the Commission that the swimming pool be relocated
along with the recreation building to help minimize the adverse
impacts on his development to the east.

, ° Sakata asked 13olen whether the Caiway Hills Homeowners Assoc.
had been notified.
° Bolen responded, "No, but this will be done for the general plan."
o Dale Conn) Caiway Homeowners it. ',Aoc. stated that the 3 story
buildings were too high and should be limited to 2 stories.
C. Staff Recommendation: Approval with the following conditions:
1. The amenities specified on the site plan be located on the site
development plan submitted for general plan and program approval.
2. The method of providing for the right-of-way and improvement
of SW 109th be spezified in the general plan.
The following condition was added:
3. The existing screening between the Caiway development and this
development be left and new plantings should be added if it

• Maurice Marzinelli, 1027 SW Fanner, inquired as to whether the
NPO had been notified of the proposal.
' Bolen responded they had not, but would be notified when the
general plan came in.

D. Commission Discussion and Action
a Popp stated this is the 3rd plan submitted by the applicant and
that each one was an improvement over the previous one.
• Krause stated that he felt the density was too high and encouraged
limiting it, otherwise he would be opposed to the proposal at this
time.
• ° Bolen stated that, under the Washington County zoning, the appti-
cant would have been able to build at 20 units to the acre.
Sakata stated she felt there were access problems with the entire
Canterbury Hill and that more streets were needed.
° Bolen stated that he felt that he was not aware of a traffic
problem in this area and that the traffic being generated off the
hill was not exceeding the 3,000 average daily trips for which
the local streets are designed. I .
o Topedino stated there appeared to be right-of-way problems internal
to the development, especially in regard to emergency vehicles.
o Phillips stated he felt 109th should be required to have a half
street improvement to provide access to the park area.
'1111 ° Porter stated that the density appeared too high.
' Nicoll said that there has been a continual controversy as this
area has been proposed for development as whether to save the trees
and increase the density or whether to spread the density out and
clear cut the area. He would support saving the trees and cluster-
ing the density,
o Bolen showed the original, plan which showed the whole area as
duplexes.
° Moore stated the density appeared to be acceptable and with this
plan showing the units integrated better into the trees. He
stated that there needed to be adequate screening along the
swimming pool area.

5,2 ZONE CHANGE ZC 3-76 (Belanich)
A request by Roger Belanich for general plan and program review of a
proposed commercial planned development in the vicinity of 121st, 122nd
and Scholls Ferry Rd, (Wash. Co. tax map 1S1 34B, tax lot 500).
A. Staff Report; read by Bolen.
Bo Applicant's Presentation:
o Roger )3elanich applicant, summarized his proposal.
o Porter inquired whether the right-of-way along Scholls Ferry
Rd. was adequate,
Mr. Ernie Platt, Commonwealth Properties, stated that he had been
. in contact with the highway dept. and they have approved the right-
of-way dedication as shown on the general site plan.
° Tepedino invited whether there was adequate turning radius for
a truck, backing into the service area.
O Belanich said Chat it was and it was unlikely that traffic along
SW 121st would be delayed while a truck is maneuvering into the
• service area,
° Henry Voderberg, 543 3rd St. , Lake Oswego, architect for the appli-
, cant, explained how this shopping center would be able to be ex-
panded on to the rest of the area designated on the Tigard Com-
prehensive Plan as neighborhood shopping.
° Krause inquired as to how access would be provided for expansion.
o Belanich responded that cross easements would be provided for all
driveways within the development,

o Bolen noted that the location of the driveways from SW 121st and
SW 122nd and the setback from SW 122nd are not to code and should
be listed in the general program plan as code deviations.
C. Public Testimony:
° Mr, Cy Penn, Mercury Development, representing Mr. Meats, property
owner to the west j stated their intention of not expanding the
shopping area and that the Planning Commission should review this
development on its own merits.

Xavier Zuada stated that the development of a shopping center is
being proposed to the northeast of this at Sorrento Rd. and is
under consideration by the City of Beaverton.
Bolen stated that the staff was aware of that proposal and that
this plan does not conflict with the official plans of any other
agencies,
Penn stated that the CPO for the Tigard area had recommended that
the Sorrento site is bettor for neighborhood commercial and that
recommendation should be adhered to.
° Bolen responded that the Planning Commission should consider
official, adopted plans and that plans in the making should not
\ be considered as importantly as the officially adopted plans.

• D. Staff Recommendation; Staff recommends approval with the following
conditions;
1. Sanitary sewer hook up be shown for the 4100 sq. ft. building.
2. Conditions attached at the time of the original zone change be
satisfied prior to issuance of building permits.
3. Curb cuts on SW 121st and SW 122nd be listed as code deviations •
as vela as the setback on SW 122nd.

E. Commission Discussion and Action
° Krause recommended that the building be moved closer to SW
Scholls retry.
4 . a Voderberg explained the parking situation and that the parking
stalls immediately in front of the building are necessary for
convenience shopping and moving the building closer to Scholls
Ferry would eliminate those parking places.
6 Sakata moved and Nicoli second to approve the general plan and
program with staff conditions.

private drive interior to the lot be worked out with the engineering
dept. , bringing the intersection as close to 90° as possible.
2. All buses dispense and receive passengers from the off-road side
onto the subject site,
3, All buses be directed to enter the site from the southwestern ,

entrance onto the frontage road and exit from the northeastern
intersection of the realigned frontage road on Pacific Hwy, 11
4. The frontage road, as realigned, should privide adL „idte space

plantings be provided for the front yard landscaping.

o Lennie Tierney, living at lot 12 in Pathfinder I, asked that the
