He said in his opinion the Plan was illprepared and illconceived. E. Mr. Bobbit of Ash Ave. stated that the area sown for commercial-industrial use is more appropriately an office area© F. Al Hill of King City stated that this is "a fantastic plant expecially the portion recommending redevelopment of the Downtown. He encouraged the Plenning Commission , to adopt it and put it into effect as soon as possible." 0 G. Mrs. Parker asked whether the areas the County would have to be annexed for the Plan to work. Mr. Whittaker replied that not the County could impleeent those portions under their jurisdication if they so chess. H, Mrs. Eggeard of Viewing stated that the N.P.O. was given a difficult task and aha felt they had done a commendable fob. 2, Staff Reco. mendation A. The staff recommended that the Neighborhood Plan be adopted bas.d upon the fact the testimony offered at the last two public heerings has pointed out no major flaws or brought to light new areas for con- sideration. The problems which have been discussed at these hearings have been considered in depth by they NeP.O0 and the City Planning Staff. It is believed that the best of alternative solutions have been chosen. 30 Commission Discussion and Action . . A. Again we state the fire district agrees with the present subdivIsion oriinance requiring 34' streets and would like to see the requinments in all new developments, whether it is a subdivision, planned development, etc., for the following reasons: 1. The streets provide access for che fire apparatus. Two 6' wide cart parked opposite each other doesn't leave much room for apparatus to pass thru or to manuver for proper placement. The 12' section of street with 6' cars parked doesn't leave enough room for 81/2' fire apparatus to pass. 2. The streets provide fire breaks to prevent the spread of fire from building to building, remembering some of these town houses are frame construction, 250' long, 50' wide with less than 10' of separation on the ends. After having several apartment house fires in our district, and learning of experiences of other fire departments involved in these type of fires, we feel strongly that any street less than your requirements could only contribute to a possible conflagration. p: If you have any further guLtstions, please call. The northerly portion of the site is adjacent an unnamed creek indicated on the Tigard Community Flan as a potential greenway area Utilities: Water is available from the Tigard. Water District and sever service from the Unified Sewerage Agency. . Revised Staff Findings 1. The applicant has requested by letter, application for conditional use for a planned residential development on 9.77 acres be revised to include only a request for duplex . conditional use on 2.5 acres of the same development. 2. The Planning Commission at its June 19, 1973 regular meeting tabled this agenda item to allow the applicant to confer with the staff and the City Attorney regarding the requirements . „ set down by the Oregon Supreme Court in the Fasano case. . . The applicant has conferred with the staff and the City Attorney has written an opinion stating that conditional use approvals must be based on findings related to the "guidelines and procedural requirements" of the Fasano Case. 3. The subject site is designated "Urban Low Density Residential" having a maximum density of 4 dwelling units per gross acre. The applicant proposes a density of 2.7 units per gross acre. The subject property is zone R-15 allowing the development of 28 dwelling units. The applicant proposes 26 dwelling units. The staff finds the applicant's proposal conforms with the density provisions of the Tigard Community Plan. and City of Tigard Zoning Ordinance, 4, The Tigard, Community Plan states the following Objectives: Objective: To provide areas of the City having a predominately single-family residential character. Page 2 . Staff Report - Arrow Heating - C 13-73 • July 17) ley73 •. (- 4, The staff finds that this project will not adversely affect the predominately single family character of this neighborhood as it ic Planning Commission policy to allow duplex development only on arterial or collector streets. This leaves the bulk • of residentially zoned land for single family development. The staff find the siting and landscaping for the proposed units to reflect a single-family residential caharacter rather than a multi-family character. Objective To permit densities that will economically support the cost of necesoary public services and facilities, such as paved streets, pedestrian ways, and utilitites. Staff finds the proposed density adequate to economically support the cost of necessary public (=vices, an the proposed density closely conforms to the allowable density. Sewer and water service Jo available adjacent the site. Objective: To permit a variety of howling types to meet the needs of different family size and income. The staff finds the applicantte propooal adds variety to the Citylo houaiug otock, providing hoeing neceooary to meet the need of family'o with above average incomeo« The applicant / has stated the proposed duplex unite will coot approximately $60,000 - $70,000. 5. TO: Planning Director and Planning Commission City of Tigard . .-., From: Fred. A. Anderson .. , - SUBJECT: PROPOSED "LAKE TERRACE SUBDIVISION" Date : July 17, 1973 . . I have today reviewed with the Planning Director Brooks and Associate Planner Bolen the preliminary plat of "Lake Terrace Sub- , division" as rerised July 10, 19730 . . . -. As a result oP P,ur review and discussion, it is my opinion that the proposed plat of Lake Terrace constitutes subdividing of land subject to the provisions of Ordinance 68-48 - Subdivision • Code, as embodied in Title 17 of the Tigard Municipal Code , and . . „ . that the preliminary plat as projected does not conform to the Code with particular regard to SectionVIII - Design Standards . The subdivision requirements contemplate dedicated streets . in such instance, having a minimum right-of-way width of 50 feet . . for local street. The ways shown on the plat are of lesser width .. and presumably are intended to be non-public, or private, easements , This, of course, is unauthorized in any of the subdivision or zoning requirements of the city. .., .. , .,. r , 1 Respectfully submitted, r ) Vr/e''' Ir „. .i : Anders:-n -(4----c--4— -):4": FAAtob ) .. . . , . ... . lir , « .. ,.' -----...„.---.......-- : ,,:,; ,..,,._,,..:.,,,,..,:..:_.,,,,, j , • . . .. Dear Sirs: • . . 1" We have just submitted a preliminary plat to Washington County for subdividing the Tippitt property which is approximately a four acre . .. parcel of land located at 12695 S. W. 121st Avenue. We have been requested by the City of Tigard to set aside an area along the . . Western boundary of the subject property for the City's Oreenway , . ., • System following the creek that is the natural drainageway through ' the area. • :, ' We support the °Oreenwaym concept and feel that it is one of the most vital parts of the Community Plan if the eame is to ultimately be • fulfilled. If we set aside a tract for greonway purposes, however, , , we would hope that this segment would connect with other open spacee. •• In the particular case the greenway should be extended North through the proposed Lake Terrace Planned Unit Development now being heard by the Planning Commission to connect with the Bellwood-Brockway areenway. We feel that there should be some provision made for some 0k,, continuity in respect to the Chamberlain property either in the way of greenway as has been handled in the past, or at least a public • easement through the property. This latter suggestion might be appropriate because of the unique character of a lake vs a natural , drainageway. If nothing is required to integrate the natural greenway system , . through a proposed development such as Lake Terraceccwhich incidentely is within the City limits of Tigard--how eat you justly ask for * greenway through other lands which in our case is even in Washington County? We are more than willing to do our part as requested, but reluctant if similar requirements are not made of others. L (V tritly.,y purs 9 . ,---- .10 ... ' .V, , , . ' I. The Planning Commission at its June 19, 1973 regular meeting . . .. tabled this agenda item to allow the applicant to confer , with the staff and the City Attorney regarding the requirements : . set down by the Oregon Supreme Court in the Fasano case. . . . .‘ , The applicant has conferred with the staff and the City Attorney . , . • has written an opinion stating that conditional use approvals • m ..,o be based on findings related to the "guidelines and . . . . . .. procedural requirements" of the Fasano Case. . . . . - 2. The subject site is designated "Urban Lnw Density Residential" , ' . , having a maximum density of 4 dwelling units per gross acre. 5 The applicant proposes a density of 2.7 units per gross acre. The subject property is zoned R-15 allowing the development .. , of 28 dwelling units, The applicant proposes 26 dwelling units. The staff finds the applicant's proposal conforms with the • density provisions of the Tigard Community Plan and. City of . ,.. . Tigard Zoning Ordinnince, . 3. The Tigard Community Plan states the following objectives: , . . . . Objective To provide areas of the City having a predominately . . single-family residential character. 4, . , '3,; The staff finds that this project will not adversely affect the . . predominately single family character of this neighborhood , , . . as it is Planning Commiesion policy to allow duplex development . . only on arterial or collector streets. This leaves the bulk . of residentally zoned land for single family development, The staff finds the siting and landscaping for the proposed units 0 . ' , to reflect a single-family residential character rather than a multi-family character. .. Objective: To permit densities that will economically support the cost of necessary public services and facilities, such as paved streets, pedestrian ways, and utilities. . Staff rinds the proposed density adequate to economically support the cost of necessary public services, as the proposed density closely eonforms to the allowable density, Sewer and watur service is available adjacent the site. Otreetu and access ways within the proposed development will be paved at the owners expense. The applicant has agreed to dedicate land sufficient . , . .,. Page 2 - staff Report - Arrow Heating -. Objective: To permit a variety or housing types to meet the needs of different family size and income. • • . • The staff finds the applicant' s proposal adds variety to the City's housing stock, providing housing necessary to meet the , needs of family's with above average incomes. The applicant • has stated the proposed duplex units will cost approximately $60,000 - •$70,000. . 4. The applieant's property is not suitable for the continuation • of the City' proposed greenway system as an existing dedicated right-of-way exists 800 feet to the west. A continuation of the greenway system through the applicants property would duplicate an existing facility and provide the possibility IL of potential use conflicts between the public and private landowners within the proposed development. The terminus of the proposed route through applicants property and the route • to the west is in approximately the same general location. The taft tInds a greenway route through the applicant's • . • property an unnecessary duplication of facilities. 5. The applicant proposes a )0 foot easement to provide access to lots 8, 9, and 10 on the easterly portion of the site. The staff finds this acceptable. 6. The pond and dam are to be maintaimd by a homeowners association. 7. The applicant wishes to maintain ownership of lots 5, b and 7 and Tract "B" . The applicant has stated that Tract 'B" was . 1 not intended to be apart of this application. 8, Tract A is to be dedicated to the City of Tigard for its greenway system. 9. The cul-de-sac on the easterly portion of the site is to be dedicated and built to City standards. 10. The applicant proposes to underground all utilities. • ,, • U. The applicant proposes to further subdivide lots 1 and 12 • of the proposed development so as to place each duplex on a single lot. Duplex building lots are practically non-existent. *Len they are • created as a conditional use in a reeidential zone the has been , re a ready market, We have soul 8,000 square feet minimum lot size . . duplex lots for from $6,000 to $7,500. Such lots when developed . and built on sustain duplexes valued from $35,000 to $40,000 with . rent structures from a low of about $180 per month per unit to . ., . $195 per month per unit of two bedrooms each as a standard. It is . , almost always easier to rent a duplex than an apartment unit in a . . predominately suburban residential area such as Tigard. Rentals , . ,. generally are at least 10% higher for comprable duplex units over . . apartments, Vacancies in duplex units are minimal. . The most luxurious duplexes that we have sold, have been some located , above King City off Beef Bend Road and they were constructed by '.. Robert Cooper. Cne sale in 1970 was for $469500 for two, two bedroom . . units with some basements for storage. This particular unit has rented .• since that time for $250 per month per unit. A comprable new unit is now for sale in the same area for $55,500 but such luxury units are exceptional examples in the Tigard area.
