Porter at 7:35 p.m.

of the site screening fence removed by the adjacent
developer and indicated it was his understanding that
the developer would replace the fence after the con-

further landscaping as well as the desirability
of limiting the operation to particular hours of

o Wakem said that he felt this conditional use was
not within the intent of the N.P.O. #1 Plan, as
adopted by the City Council as part of the Com-
_ prehensive Plan, and he felt the policy statement,
which spoke to the need to improve the Main St.
business area, was violated by this action.

o Motion failed 3-2 (Wakem, Smelser, Hansen voting
against) .
o Chairman Porter indicated that he felt unconvinced
of the adverse impact of the project.
// o Mr. McClure told the Commission that he felt that
Hansen should have disqualified himself in the
voting and asked if the Commission would reconsider
its vote.
o Porter indicated that disqualification, in fairness,
is a matter up to the individual Commission member
and that the question had been defeated.

8. OTHER BUSINESS
o Commissioner Ball brought up the topics of recent legal
cases in the area of land use law, citing specifically
Baker vs. Milwaukie. Ball asked the Commission to re-
quest a discussion by the new City Attorney of these
• cases before the Commission.
o Porter pointed out that there were a number of unresolved
issues previously attempted by the Planning Commission
over which they had asked some time ago to confer with
the City Council in order to discuss the particular
policies germaine to the issues involved,
o Wakem pointed out that it may be valuable to orient the
Council to the Planning Commission's thinking with
respect to planning and that such a meeting would be
necessary in order to establish rational priorities
for future legislative matters. An example cited was
that of outdoor advertising Signs and the amendment
of the Sign Code.
o Sakata asked that the staff address the issue of zoning
code enforcement. She stated that she personally had
noticed, and it had been frequently brought to her
attention, that conditions applied by the Planning
Commission to conditional uses were not being adhered
to and that other zoning code violations were becoming
commonplace,
o It was suggested that revocation of conditional uses is
a Planning Commission power and that a check list of
conditional uses and their conditions should be estab-
lished for a vigorous enforcement program.

Staff Findings
1. This matter is continued from June 17, 1975.
2. Colonial Texaco was annexed to the City of Tigard in 1973
and was zoned C-3. A service station is ordinarily a
conditional use in a C-3 zone; however, an existing con-
ditional use subject to an annexation is annexed as a
permitted use
3. Land use in the area is highway oriented commercial along
Pacific Hwy. , although h a more "urban arterial commercial"
character is beginning to be evident. The lots behind
the Pacific Hwy. frontage support mixed single family
homes and apartments which here seem to be compatibly

maintained, residential area. The site adjacent the ser-
vice station on the west is presently under construction
for two restaurants, "Shakeyts Pizza" and "Country Kitchen".
4. The undeve:,oped area in the rear of the site provides an
excellent ',suffer between the adjacent commercial and resi-
dential uses, but needs to be maintained. Provision of
some additional evergreen vegetation would help control
noise from the service station somewhat, but will not pro-
vide complete sound isolation.

distances for ingress and egress due to appropriate set-

8. Staff's evaluation of the noise added by this installation
is that it is within acceptable limits (similar unit at
Barbur Blvd. and Capitol Hwy. Shell Station has been visited
by staff) and will not likely increase existing operational
noise levels at the property lines. The service station is
subject to noise control guidelines established, by the
State of Oregon Department of Environmental Quality which
limit noise levels at the property lines to levels unlikely
to interfere with ordinary conversation.
9. Site proposed is behind existing station building, approxi-
mately 45 ft. from the rear lot line. (It would be approxi-
mately 60 ft. from the nearest single family dwelling) .
10. Several existing, although comparatively minor violations,
of Tigard Code were noted on staff inspection. These were
outside storage and display of tires, excessive signs,
illegal "A frame', signs and banners and an open trash
collection area.
11. The Tigard Community Plan designates the area as ugeneral
commercial" and no NPO organization has yet been formed in
this area to provide other input.
12. Waste water disposal will be accepted by the Unified Sewer-
age Agency, but a sand and grease trap will likely be re
# quired under the State Plumbing Code.

entire neighborhood and that he had been asked to
appear and specify the neighborhood's opposition.

1. That no portable or A-frame signs are to be located
on the site and all other signs are to be brought
into conformance with Tigard code.
2. There is to be no outside storage or display of
tires or other automobile accessories,
3. Trash and debris is to be confined to the collection
area to the rear of the building, as provided on the
general station plan.
4. Applicant is to provide and maintain landscaping and
screening per code requirements.
5. Sight obscuring screening along the west line is to
be replaced and the area to the rear of the service
station is to be neatly landscaped and covered with
appropriate groundcover materials.

CU 12-75 (Colonial Texaco Car Wash - Charles Dunn)
Conditional Use
for a portable car wash to be installed at Colonial Texaco
(11465 SW Pacific Hwy. )
Staff Findings
1. Colonial Texaco was annexed to the City of Tigard in 1973
and was zoned C-3. A service station is ordinarily a
•• conditional use in a C-3 zone; however, an existing
• . conditional use subject to an annexation is annexed as
a permitted use.
2. Land use in the area is highway oriented commercial along
Pacific Hwy. , although a more "urban arterial commercial"
character is beginning to be evident. The lots behind
the Pacific Hwy. frontage support mixed single family
homes and apartments which here seem to be compatibly
arranged. A general impression is of a pleasant, well-
maintained, residential area. The site adjacent the ser-
,
, • ' vice station on the west is presently under construction
for two restaurants, "Shakey's Pizza" and "Country Kitchen".
3. The undeveloped area in the rear of the site provides an
excellent buffer between the adjacent commercial and resi-
dential uses, but needs to be maintained and perhaps modest-
ly landscaped.
4. The sight obscuring fencing formerly located near the

property line adjacent "Shakey's , has been taken down.
No information has been yet received whether the fence or
a suitable sight obscuring hedge will be replaced.
5. Access to the site appears very good with adequate sight
distances for ingress and egress due to appropriate set-
backs being present. Traffic conflict with the driveway
as located would be expected only during periods of heavy
south bound traffic (evening rush hour) .
6, Proposed carwash (according to applicant) may slightly
increase patronage and consequently the traffic generation
of the station. Applicant states that that could be a
Side effect. Patronage is now 200-250 cars per day.

7. Staff's evaluation of the noise added by this installation
is that it is within acceptable limits (similar unit at
Barbur and Capitol Hwy. Shell Station) .
S. Site proposed is behind existing station building, approxi-
mately 45 ft. from the rear lot line. (It would be approxi
mately 60 ft. from the nearest single family dwelling) .
9. Several existing, although comparatively minor violations,
of Tigard code were noted on staff inspection. These were
outside storage and display of tires, excessive signs,
illegal "A frame" signs and banners.
10. The Tigard Community Plan designates the area as "general
commercial" and no NP0 organization has yet been formed
in this area to provide other input.
11. Waste water disposal will be accepted by U.S.A. , but a
sand and grease trap will likely be required.

wax we use that gives the car a protective coat of wax and a glistening

To round out the performance picture of the `Swab Bee" we can install a
complete water recycling unit for reclamation of water and chemicals when
and where desired or needed.
ElBee Manufacturing feels the revolutionary features of our product are
both timely and important to the environment and Car Wash ;industry. This
will give us immediate acceptance over the existing equipment now being used.

We realize we do have to change the stigma associated with car washers at
present. Not only the Public but Government Agencies, Planning Commission,
D.E.Q. and financial institutions that have had unpleasant relationships
with present machines. To do this we are placing machines in conveniently
located areas so one can see the "Swab Bee" in action, Once a purchaser
or user has witnessed the "Swab Bee" in operation or driven their car
through the washer, they will immediately recognize all the advertised
features of the machine to be facts. Our president, Mr, Evans is a former
member of the Hanna organization and for the past five years has owned and
operated a Hanna System. In spite of over $11,000.00 dollars paid out in
maintenance and repair parts in 1974 and considerable loss of revenue due

to "down-time", Mr. Evans showed a profit. So we do know our competition
as will as our own product and know we can present a positive and profit-
able picture to prospective customers.
Because the "Swab Bee" requires such a low initial investment, minimal
space, practically no environmental impact, no costly repair parts and

for the "Car Wash" industry. In our humble opinion once we have demonstra-

USERS PROFIT PROJECTION
The following is a projection of purchaser's additional profit after pur-
'.,I chasing a "Swab Bee" car washer. One projection deals with a station other oper-
ating under allocation and the oer on a pro-forma basis. These figures
are based on actual performance, not on an estimate or guesstimated basis.
They reflect only the sales, costs and profits as a result of installing the
"Swab Bee' cat wash0 which averages approximately 85% of the customers, The
remaining 15% buy gas only, which is not reflected in these figures.
These projections are made on the basis a customer must fill his tank to
obtain a free wash. Our records show an average purchase of 12 gallons to

wash by 12 gallons we arrive at 3,000 cars washed. This represents 60% of
