(b) Director of Public Works stated when Canterbury Lane
Improvement District was formed, property owners were
told City would realign S.W. Canterbury Lane. Director
• of Public Works recommended Council initiate street
vacation and set public hearing for December 27, 1971,
8:00 P.M.
(c) Motion to adopt: Councilman Moore, seconded by Councilman
Norton.

9. APPROVE AGREEMENT - S.W. SANDBURG STREET
• (a) Director of Public Works stated developers would comply
with conditions set forth in the agreement and recommended
. City Recorder & Mayor be authorized to execute, with the
. effective date to be upon acceptance by the City Council.
, 1 (b) Motion to authorize Mayor and City Recorder to execute
agreement: councilman Norton, seconded by Councilman

o 10. APPROVE SPECIFICATIONS FOR INCINERATOR BUILDING
(a) Director of Public Works stated City had agreed with
School District to cover the incinerator with steel

Works recommended bids be received at 2:00 P.M. December
13, 1971.
(b) Motion 40o approve specifications: Councilwoman Paisley,
seconded by Councilman Norton.

11. AWARD BID COMPREHENSIVE LIABILITY POLICY - Marsh 6 McLennan
(a) City Administrator and City Attorney recommended awarding
bid to Marsh & McLennan for $500,000 single limit coverage
for one year. Coverage is the same presently carried.
Premium for one year will be $4677.
• (b) Motion to approve awarding bid to Marsh & McLennan:
Councilman Norton, seconded by Councilman Bergmann.

of S.W. Hunziker Street, approximately 100 feet north-
, east of S.W. 72nd Avenue (Map 251 1A0, tax lot 1800)
1. Staff Recommendation
a. The staff recommended approval with conditions.

a. No one spoke in opposition.
b. Mr. Paul Hiransomboon and Ron Klemp, applicants,
testified in favor of the request.
0. Commissioner Fletcher asked if they intended to
landscape.
d. Mr. Hiransomboon stated that they had started
landscaping.

over the trees being cut that were behind
the building.
f, Mr. Hiransomboon stated that the two
. trees in question were too close to the building
and were a hazard.
g. Commissioner Whittaker asked if there were any
alternatives in case the variance wasn°t

h. Mr. Klemp stated that the slope of the land
would prevent them from adding an addition
to the east. 4
i. Public hearing was closed.
3. Commission Discussion and Action
a. Commissioner Whittaker asked if the first
• condition could be changed to read Planning
, : . Commission, instead of Planning Department.
b. Ray Rangila explained that the zoning ordinance
has requirements for landscaping in the M-4 zone.
c. Commissioner Goslin asked if the zoning ordinance
had a time period in which the landscaping had
to be done.
d. Mr. Hiransomboon explained that a company had
been contracted to do the landscaping.
e. Commissioner Whittaker asked what the Highway
Departmentns intention is in the area.
I1. -�• f. Ray Rangila explained that the City had received
a letter from the State Highway Department
which stated they were taking a closer look
at the intersection of Hwy. 217 and 72nd Ave.

g. Mr. Ron Klemp explained that the State Highway
Department has already reserved the land needed
for an on and off ramp in that area.
h. Commissioner Whittaker expressed concern about
setting a precedent in allowing a building so
close to the highway.
i. Commissioner Nicoll stated that he felt that
I screening along the highway would be impossible.
j. It was moved (Pletcher) , seconded (Severson)
and passed by a 5 to 1 vote (Commissioner Goslin
voting no) to approve the request with the
following conditions:
10 That a detailed landscaping and tree
planting plan be submitted to the
t Planning Commission prior to issuance of
building permits.
i 2. That the State Highway engineer review
and approve the plans.

a. Mrs. Laura Johnson testified in opposition
to the request. She expressed concern over
the image the proposed use might give Main
Street.
b. Mr. Dennis Meyer, 'Vice President of Mobile
Homes Holding, testified in favor of the
request
r c. Mr. Pat Mahony explained the way the site
would be developed.
d. Mr. Meyer explained that the mobile home sales
. facility would be an interim use.
e. Public hearing was closed

3„ Commission Discussion and Action
a. Commissioner Nicoli stated that he was
opposed to approving the request because
he had visited another of the applicant' s
lots (Division St. ) and found it to have
poor landscaping, too many units, and
only 3 skirted units.
b. Mr. Mahony stated that land use controls
in the area of their Division Street lot
were weak.
. c. Mr. Meyer stated that they would comply with
all the conditions the staff recommended, but
r- , they couldn' t regulate the week days the units
might be delivered.

' r, d. Mr. Mahony said that 65 per cent of the units
would go directly from the manufacturer to
the purchaser. ,
e. Commissioner W'littaker expressed concern over

the number of units that would be taken into

and off of the lot per month.
f. Mr. Meyer stated that an average of 3 or 4
units would be taken in and off the lot per
month.
g. Commissioner Goslin stated that he felt the
; ). site plan should be submitted to the Planning
°i Commission instead of the Planning .Department.
h. Commissioner Nicoli stated he felt this type
of business should locate further out of Tigard.

a possible traffic conflict if the request
were approved.
JO Commissioner Whittaker asked if a penalty
clause could be included in the conditions.
k. Commissioner Goslin stated that, condition
number 1 could be changed to read as follows:
The conditional use shall be in effect for a
period of 2 years, subject to revocation by
the Planning Commission if any violation of
the conditions is not remedied after a period
of 2 weeks.
1. It was moved (Goslin) and seconded (Fletcher)
to approve the request. The request was denied
by a 3 to 3 vote (Commissioners Fletcher, Goslin
and Whittaker voting yes; Commissioners Nicoli,
Severson and Chairman Paterson voting no) .

commercial uses and a junior high school. The
abutting parcels to the west and east support a
used car dealership and a service station. Another
car dealership is located 400 feet to the east.

industrial uses on the adopted Plan. The commercial-
. industrial area is intended to accomodate commercial
uses which require outsiee storage or display, The

uses are intended to be located near the Main Street

The staff finds that the proposed use would be
compatible with surrounding land uses, but would
not be clearly in conformance with the adopted
Community Plan.

The staff further finds that there are presently
no mobile home display lots within the City.
It is recommended that the request be approved with
the following conditions:
l The conditional use shall be in effect
for a, period of 2 years, at the end of
which time the Planning Commission shall
review Plan Supplements to determine the
subject use' s conformance with designated
land uses in the Community Plan.
2. A detailed site plan shall be submitted
to the Planning Dept. for review and approval
prior to occupancy. Said site plan shall
indicate mobile home display sites, driveway,
off-street parking, landscaping and customer
path system.
• • 4• 3. All mobile homes, including the temporary
sale office; located within 100 feet of
Pacific Hwy. shall be provided with land-
, soaping, skirtin and awnings. Existing
trees shall be preserved and maintained.
4. One driveway shall be provided into the
subject property at the north end of the
lot. The entrance shall be of sufficient
dimension that no backing movements ' or
stopping of traffic on 99-W will be
necessary for access and egress. Access
for said driveway shall be subject to
permit by the Oregon State Highway Dept,

maximum of 15 mobile homes or 20 frames,

Re: Request for Conditional Use
Dear Mr. Rangila:
Enclosed, please find our check for $100.00 and our application
for the conditional use of property in your city as a mobile home sales
facility.
At the present time, we have three other sales facilities in the
Portland-Salem area. Each of the locations is set up in such a manner
that they offer a clean, pleasing view.
We sell new mobile homes through the use of display models at thes
• sales facilities, Each of these sales models is set up and displayed
with furniture, We solicit orders from these models; the majority of
which are shipped directly from our factories to the customers.
The mobile home sales facility, while it requires a good traffic
flow by it will not generate any additional traffic. We find that at
average of five customers drop into our sales locations each day.
We plan to develop this facility in Tigard in such a way that it
will esthetically blend in with the environment and we will not remove
. . any trees that are now on the premises.
