Approval of Minutes: The minutes of April 18, 1978 were approved with the following corrections: Page 2, Wood's first comment should read "Single Family • Attached would be `: . the same a8 Single Family Detached"; the last comment prior to Public Testimony should read "one unit per salesman and do not market houses as investment pro erties";Page 9, third paragraph, Rossman voted yes; • 4. Communications: Quimby read an article from the Oregonian by the Attorney General requesting that the availability of school facilities be considered prior to approval of construction of,new subdivisions and also wanted a copy of this report. 5. Staff Recommendation: • •b' Based upon the preceeding findings of fact and comlusions staff recommends approval subject to the following conditions: 1. That the property not be developed until S.W. Varns St. has been brought up to City Standards. It is recommended that this be done by means of a local improvement district, with the applicant . initiating the request. 2, rive feet of additional right-of-way be provided along the SW 72nd Avenue frontage. 3. File with the City Recorder an agreement to not remonstrate against a future Local Improvement District (LID) for street improvements' to SW 72nd Avenue and SW Varns Street. ,a • E. Commission Discussion: Popp was concerned with the additional traffic and the development of the interchange in the future feeling it would serve lots of traffic o currently on Hunziker; he felt truck traffic should be brought off 217 in the vicinity of the Railroad Tracks; he was concerned with the. growth and control of traffic and with bringing the zoning into corn- pliance with the Comprehe°^sive Plan which this proposal would do and also stated the office supply was in short demand in Tigard. • °Quimby asked if this was the area of extreme air quality problems . according to DEQ? °Staff stated the DEQ report said that in 1985 this area would reach the maximum limits for air pollution standards, bPopp said the small traffic generated with thi$ small type of office complex would generate !:ar less air pollution; even though it was currently zoned R-7 he doubted whether anyone would build homes on the lot; this proposal was the best overall development of that property. °Wood asked why Varns St must be brought up to city standards and if . they were able to attach a condition on the development not specified by the zone in the Comprehensive Plan; also stated the trees would be answered in Design Review and preserved; this area was zoned for r , MINUTES • TIGARD PLANNING COMMISSION May 2, 1978 Page 3 development and they couldn't deny his application, ' °Tepedino asked staff about incremental increases of traffic addressed, °Brian stated that he felt if the plot was developed as R-7 into Single Family Residences probably more traffic would begenerated than by this Commercial Professional Development. °Rossman wanted Popp to clarify his position °Popp stated he was in favor • ' °Brian wanted some sort of control factor over the traffic and made a motion for approval based on staff findings and staff recommendations and added ''for the southern 115' of the lot" after #2. °Wood seconded The vote was unanimous for approval. Staff Recommendation: Based on the preceeding findings of fact and conclusions, staff recommends approval subject to the following conditions: 1. Five feet of right-of-way be provided..along the Cascade Avenue frontage. 2. The applicant file with the City Recorder an agreement not to re- monstrate against a Local Improvement District (LID) for street improvements to SW Cascade Avenue and the frontage road along the southeastern portion of the property. Applicant's Presentation: , Herb Jundt, stated that he had assumed the Bequest would be approved and when staff asked for a list of items to be on display there was a ►, misunderstanding as to what would actually be displayed. Under Staff Report Finding of Fact #I,6, concerning screening,' his drawing was only an approximate representation of the heighth and would actually be as high as necessary to screen the equipment; .• • the area would not actually be seen from Pacific Hwy and Gaarde as Gaarde was screened and was below grade-the site was not visible froim the northbound lanes of Pacific Hwy' • #II, the applicant further stated concerning Finding of Fact #II he q'P was not deliberately trying to make his storage area visible .. the &� area was not zoned for industrial construction use; this proposal would be a complete sports store allowing the customer the opportunity to try out several different types of recreation by being able to rent equipment - it would also cater to the do-it-yourself home repairperson Staff clarified its position as saying the basic intent of this report: , is to seek direction from the Planning Commission and not say whether he's specifically proposing to do it - only trying to clarify what type , of use is permitted. Opponent's Popp read a letter stating opposition to the project due to the increase in traffic and a general disapproval of this type of business in this area. Russell Ripley, 15655 SW Old Orchard Place, owner of the Furniture Store directly across Pacific Hwy for 20 years opposed, stating he had earlier had to blacktop and landscape the front of his lot at great expense to make the area look good and in keeping with the otherwise 'nice'area; he stated it was unfair to have so many restrictions on one side of the • highway and none on the other side, Mrs. Ripley, 15655 SW Old Orchard Place, cited increased traffic hazard as another reason for opposition. Wood stated he agreed with Tepedino; they should give direction to the school and the proposed new route was a good one; they needed to determine whether to fill the flood plain or not. Tepedino stated the issue of flood plain fill should be dealt with first. Wood stated as they needed a flood plain fill permit from the P.C. they might as well okay one of the routes now. • Tepedino stated the need for hydrological studies first. Popp stated the right-of-way exists for the current desig- nation either the new or old alignment, and if fill would be needed they would definitly need a permit, but would they need a permit if they were merely crossing the flood plain? He continued to say it would be a separate item to be heard. He also asked if 25 ' would be adequate access to the school property . Brian inquired as to the exact steps needed if they wel:e tc approve this request and would they be able to review the access? Also what cunstituted fill? The site is designated on the NPO #3 Plan as "Retail Commercial" and currently zone C-4 "Neighborhood Commercial" . . 1 2. Section 18. 32.030(8) of Tigard Municipal Code states "Any business , service, processing, storage or display essential or incidental to any permitted use in the C-4 zone and not conducted entirely within an enclosed building requires conditional use approval by the Planning Commission . 3, On April 18, 1978 the Tigard Planning Commission determined that the retail sales and rental store being proposed on the site was similar to a hardware or department store which are permitted uses in a C-4 zone. 4. The site is situated below the grade of Pacific Highway and the frontage road servicing Canterbury Square. A single family residence is located in the north westerly corner of the parcel , Surrounding ,Joe land uses are commercial and residential properties. 5, The applicant is requesting permission for two •') 1 outside storage areas approximately 52 x 132 feet in area. This storage is to be enclosed with a fence around the perimeter of both areas The applicant is further proposingthree outside display areas to be situated in the northeast corner of the site. Some equipment would be over 6 feet in height such as "power post hole diggers on trailers and tractors with • • front loader or trailer" . 6. Due to the grade difference between the frontage 7 road/Pacific Highway and the subject parcel , both the outside storage and outside display areas will be quite visible from either street. While some of the items are meant to be seen (in display areas) , proposed method of screening is not adequate. 7. Southwest Gaarde Street is designated on the NPO #3 Plan as a collector street requiring 60 feet of right-of-way. There is currently 40 feet. Therefore an additional 10 feet of right-of-way shall be necessary. II . Conclusionary Findings : 1 . The proposed site plan is unacceptable because of the proposal to display rental equipment, and because the areas for storage will be partially visible from the roadway . There are design alternatives which can be employed to minimize the visual impact of the storage . The submitted plan is attempting to make the wares being rented and sold both visiblo and partially visible as a form of advertis*_ng. This is a common operating technique for this type of business; Power Rents, Barbur Rental, and Bob 's Rental on McLoughlin all being examples. Any site plan should screen the storage area as much as possible and no display should be permitted. Staff is of the opinion that the relevant issues are, first the appropriateness of the land use and secondly, the design review related question. The Planning Commission should therefore serve to provide the following guidance: 1 . Is the land use appropriate i .e. outside storage at this location? , , • STAFF REPORT AGENDA 5.4 TIGARD PLANNING COMMISSION Page 3 2. What are the relevant criteria to be used in the design review process? Concerning #1 above, it is staff's opinion • that a sales and rental facility serving the needs of primarily residential customers is .? appropriate at this location. However, this is not an appropriate site to serve the construction industry from. Businesses serving the construction industry (such as Power Rents) should locate in industrial zones (as they are) . ' In fact , this aspect of the use is, in staff 's opinion, not similar to any of the permitted uses in the C-4 zone which is designed primarily to provide goods and services to the residential community. In addition, the applicant 's submission states that outside display is a necessity of the operation. If this is true, then this land use is not appropriate at this location . • Concerning #2, it is the staff's dpinion that the following criteria should be used for evaluating any site plan. t A, The storage areas should be screened from vicw as much as possible with the most suitable location for outside storage being in the rear of the parcel and directly behind the Cantebury Shopping Center buildings. The applicant 's building could then be located • between the Highway andthe storage area, (This has been done rather successfully with a rental outlet in Beaverton on T.V. Highway) , B. The screening should include landscaping as well as fencing and additional landscaping should be provided on Gaarde Street, C. No outside display areas should be permitted. III , Staff Recommendations • Based upon the proceeding findings of fact and conclusions staff recommends that this request be denied. • If the Planning Commission chooses to approve this • request staff recommends. We believe we would readily conform with Tigard Compreheeive Plan by reducing some of the traffic flow through the city by consumers having to travel thru Tigard six extra miles to arrive at a similar outlet located in the Portland City limits to satisfy their needs. Through our growth record we feel the , public has shown a need or desire for our type of operation. To show more clearly how we would be a benefit to the community, lets look at the close surrounding mode of dwellings, King city; a group of people on the large that have ho desire to invest in equipment that they would use seldom. The mobile home court by King clty indicates as well; but with storage of the equipment a major problem, also a percentage of the people live in apart- ments„ another etorage problem. What we can proviee the people is the equipment 0 000 to beautify, anti build for them and their familiee aitt-out having to create . ' extra traffic and pollution problems by traveling reater distance thru the city. We do not see any change to the existing environmental, economic or social / condition. Any change to the environment would be compensated for by equal , restruotor of plant life and plant location as stressed in the existing plan. As an economic change I can only see that we would only help solidify the cos- munity in being compatable with the existing operations adjacent to us. We find that this location is more suitable to our operation because as our plan proposes there will be no access or exit to a major highway. As is our understanding a traffic light is under consideration at Pacific Highway and Gaarde street this will aid in keeping traffic flow very orderly. As all entrance and exit will be on Caarde street we feel that this makes it more suitable for our operation. \\\, 1 As stated preiiously we feel that we can only enhance the adjacent sites.
