AMENDING ORDINANCE No.70-26 WITH RESPECT TO • CONDITIONAL USE OF LANDS OF IRON MOUNTAIN INVESTMENT COMPANY - ZONED C-11 Neighborhood. Commercial - IN Section 10, T2S, R1W, W.M. , WITHIN T} a CITY OF TIGARD, REQUIRING APPROVAL OF THE CITY COUNCIL FOR ALL RESTAURANT USES AND DEVELOPMENT OTHER THAN A SINGLE RESTAURANT FACIL- ITY HERETOFORE APPROVED AND DECLARING AN EMERGENCY. WHEREAS, by Ordinance No. 70-26 , adopted by the Council on July 13, 1970, conditional use of the lands described on Exhibit "A", by reference made a part hereof, within the C--4 zone classification • (Neighborhood Commercial) was authorized for p`..rposes of development "• of a single restaurant facility as therein stated; and WHEREAS, it was the intention of said ordinance that conditional use thereby authorized would conditionally extend and authorize future additional restaurant facilities and it is desired hereby to amend Ordinance No. 70-26 to so reflect, NOW, THEREFORE, • • THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section That Section 1 of Ordinance No. 70-26 as adopted by the Council on July 13, 1970, be, and the same is, hereby • amended to read as follows: • "Section 1: That conditional use in accordance with the City of Tigard Zoning Ordinance of 1970, No. • 70-32, within the lands of Iron Mountain Investment Company described on Exhibit "A", now zoned 0-4 (Neighborhood Com- mercial) for restaurant purposes, be, and the same is hereby authorized; provided that with respect to each pro- posed use of any portion of said lands for restaurant purposes, the following requirements are met: (a) That detailed site lay-out showing specific location, size, type and design of space to be occupied for restaurant purposes shall be submitted to the City Council and approval obtained as a condition precedent to issuance of any building permit, and as a condition precedent to the exercise of any conditional use rights hereunder with respect to the use of any pre-existing facilities or the devel-y opment of any additional facilities for restaurant purposes. ' Section 2: The City Recorder is hereby authorized and directed to certify a true copy of this Ordinance and forward same to the applicant forthwith. Conditional Use DUANE COMPANY (Fred Meyer) , applicant A request for a conditional use for an outside sales area in conjunction with a new "home improvement and decorating center" building to be constructed a part of the 11 acre Fred Meyer shopping center, The propery involved is located on the south side of S.W. Spruce St. between its intersections with 71st and 72nd Avenues (Map #151 36A0 tax lots 3400 and 3401) 1 Staff recommendation for conditional approval. . . 1 2. Public Hearing - , ) a. Mr. Harold Lapp, 7121 S.W. Spruce St© , asked if public access through the Fred Meyer complex was going to be continued. Mrs. Wied answered that there has been no discussion with the City regard- . That there will be no display or storage of goods or materials outside the confines of the wall of this proposed outside sales area. 2. That the parking spaces shown on the west side of the outside sale area be eliminated and replaced with a landscaped area which would connect with that along Spruce Street and run along the concrete block screen, providing definition to the edge of the access road and vision clearance around the sew , corner of the approximately 12 ° high concrete block screen. 3. That this conditional use shall expire in one year if the project has not been started and continual progress toward its completion is not in evidence. B. Conditional Use Application ATLAS STEEL BUILDING COMPANY, applicant A request for a conditional use for outside storage and the , temporary use of a trailer for an office. The property is located at 9380 S.W. Tigard Avenue (Map #2S1 2AB tax lot 1900) • 1. Staff recommendation for conditional temporary approval. 2. Public Hearing a. Mr. Vern Risberg, 5123 Soy.. Beaverton Hillsdale '• Highway, owner of the adjacent tax lot 1801, spoke in opposition to this use and to the M-4 zoning in the area. He said he felt the original A-2 zoning was better and the M-4 zoning had devalued his property. b. The public hearing was closed. 3. Commission discusbion and action a. Mr. Lewis asked what kind of business was proposed here. Mr. Allred, applicant, said it is a metal products asecilibly business - steel buildings. Mr. Lewis said he felt this was the wrong location for this kind of business. b. Mr. Woodard and Mr. Harris expressed their concern for the view of the property from 99W, and said that outside storage should not be permitted where it cannot be adequately screened. c. It was moved (Lewis) , seconded (Goslin) , and passed by majority vote of the Commission presr,nt (Mr. Fletcher abstaining) that application be 1 denied. O.
