SANITARY SEWER - PERMANENT
Steve Davis and Barbara Davis, husband and wife, hereinafter called the Grantors, grant and convey unto the City of Tigard
a perpetual easement for constructing, reconstructing, operating, maintaining, inspecting, and repairing of an underground
sewer line and appurtenances, together with the right to remove, as necessary, vegetation, foliage, trees, and other
obstructions on the parcel of land described in the attached Exhibit "A" and shown by attached "Exhibit B" situated in the
City of Tigard, Washington County, State of Oregon.
THE TRUE CONSIDERATION for this conveyance is $ 0.00 . However, the actual consideration consists of or includes
other property or value given or promised which is the whole consideration.
IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any right, title, or interest except those expressly
stated in this easement, nor otherwise prevent Grantors from the full use and dominion thereover; provided, however, that
such use shall not interfere with the uses and purposes of the intent of the easement.
IN CONSIDERATION of the premises, Grantee agrees that if said Grantee, its successors or assigns should cause said
easement to be vacated, the rights of the Grantee in the above - described easement will be forfeited and shall immediately
revert to the Grantors, their successors and assigns in the case of such event.

The bearings noted hereon are based upon a Geodetic Bearing Base utilizing the NAD
83 Oregon State Plane (Polyconic) North Zone Coordinate System.
Legal Description:
A 10.00 foot wide strip of land located over a portion of Lot 8, "Greenberg Heights ",
situated in the Southwest 1 /4 of Section 35, Township 1 South, Range 1 West of the
Willamette Meridian, City of Tigard, Washington County, the State of Oregon, more
particularly described as follows:
Beginning at a point on the east line of said Lot 8, which bears S01°32'33"W, 143.88 feet
and S86 °51'31 "E, 20.01 feet from a 3 /4" Iron Pipe marking the Northeast corner of Lot 7,
said "Greenburg Heights "; thence leaving the east line of said Lot 8, N86 °51'31 "W, 10.00
feet; thence parallel with and 10.00 feet west of the east line of said Lot 8, N01 °32'33 "E,
164.37 feet to the south boundary of that tract of land described in Document Number
