Recently, a sanitarian with our Department visited your building site to evaluate it for the
placement of an on -site sewage disposal system. As is indicated on the attached reporting forms,
the site was found to be in compliance with_the Administrative Rules (OAR Chapter

specifications are listed on the attached report. Since thus is not a permit to install your system,
information has been attached on how to obtain this permit. No system construction is to take
place until a permit has been obtained.
A couple of words of caution, developing a site for a residence usually involves heavy equipment
and considerable earth moving. The area you proposed to install your septic system should be
kept free of this equipment and must not be altered in anyway. The proper operation of your
septic system is dependent upon this. You should also be aware that unless you install your own
system, your septic system installer must be licensed with the Department of Environmental
Quality. Our Department can supply you with the name and phone numbers of those installers
who work in Washington County.
Included with the approval report is a Land -use Compatibility Statement form. You must
complete this and have the appropriate land -use authority sign it before a permit will be issued.

COVENANT
THIS COVENANT, made and entered this NM., day of , 2003 by and
between Clean Water Services, a municipal corporation (hereinafter c led "District ") and Brian
G. and Karen M. Pautz (hereinafter called "Owner "), and the burdens and benefits created hereby
shall run with the land and inure to the parties hereto, their heirs, successors and assigns.
WHEREAS:
1. Owner owns the parcel of real property commonly known as 13450 SW Sunrise
Lane, Tigard, Oregon, Washington County, Property ID R1295654, Tax Lot 2S105.DD-
00201 (hereinafter called "the Property "); and
2. Owner desires to build a new home on the Property, which will require sewer
service; and
3. District's Ordinance 27 requires connection to public sewer when such sewer is
available; and
4. District would normally oppose the issuance of a permit for an on -site sewage
disposal system by Washington County when public sewer is available; and
5. Connection of the Property to the closest available public sanitary sewer requires
acquisition of easements from other parties who are unwilling to grant such easements;
and
6. District has determined it is in the public interest to allow issuance of a permit for
an on -site sewage disposal system to Owner under the circumstances, in exchange for the
promises made herein.
NOW THEREFORE, in consideration of the mutual covenants herein contained, Owner and
District agree as follows:
1. District shall not take action to enforce any legal requirement that Owner connect
to public sewer, until three years after public sewer is available to the Property without the need
for acquisition of public sewer easement.

2. District shall not oppose the issuance of a permit to Owner allowing an on -site
sewage disposal system to be built on the Property.
3. Owner shall he responsible for all costs and liabilities associated with the
construction, operation, maintenance, and abandonment of the on -site sewage disposal system to
serve the Property. The on -site sewage disposal system described herein shall serve only the
Property. Any future subdivision or development of the Property that requires expansion of the
on -site system or extension of the public sanitary sewer system is outside the scope of this
Covenant.
4. Owner will connect the Property to public sewer and abandon the on -site
sewage disposal system within three years after such sewer becomes available as determined by
the District, notwithstanding extensions of time to connect that are otherwise provided by
District ordinance.
5. Owner hereby waives the right to file a written remonstrance or provide
written or oral testimony against proposed improvements, or to file a written objection or provide
oral testimony against the levying of an assessment against the Property in any Local
•
Improvement District that benefits the Property with sanitary sewer service, and waives the right
to appeal the imposition of a Local Sewer Improvement Fee for connection to any Local Sewer
Improvement Project that benefits the Property with sanitary sewer service.
6. Owner hereby waives the right to take legal or equitable action to oppose the
formation of a Local Improvement District, the construction of improvements therein, the
levying of assessments therefor, the construction of a Local Sewer Improvement Project, or the
imposition of a Local Sewer Improvement Fee.
7. Except as agreed to herein, the rights that Owner may have in the future as the
owner of property benefited by a Local Improvement District or Local Sewer Improvement
Project are controlled by District ordinance.
8. Notwithstanding the agreements made herein, District may take necessary action,
including compelling Owner to connect to public sewer, to abate a nuisance or threat to public
health or the environment caused by failure of an on -site sewage disposal system serving the
Property.
