NOTICE OF TYPE I DECISION MINOR MODIFICATION (MMD) 2013 -00005 ■ ANYTIME FITNESS CHANGE OF USE TIGARD 120 DAYS = 5 -16 -2013 SECTION I. APPLICATION SUMMARY FILE NAME: Anytime Fitness Change of Use CASE NO.: Minor Modification (MMD) MMD2013 -00005 PROPOSAL: The proposal is a change of use for a tenant space, Suite A, at Tigard Towne Square. The space, approximately 6,710 square feet in size, is changing from eating and drinking establishment (other) to indoor entertainment. The C -G zoning district is designed to accommodate a full range of retail, office and civic uses with a City -wide and even regional trade area. A wide range of uses are permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.360.060.0 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV below. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information: The subject parcel is approximately 5.57 acres in size, and is located on the south side of Durham Road, between Pacific Highway and 113m Avenue. The parcel is fully developed as a strip mall (Tigard Towne Square) and contains a variety of land uses. In 1987, the original site development review (SDR87 -05) required 654 parking spaces and was approved with 955 spaces. The current site plan shows 920 MMD2013 -00005 Anytime Fitness Change of Use Page 1 of 4 parking spaces serving the strip mall. Surrounding land uses include commercial development to the north, multi - family residential to the north and east and single family to the south and west, which is outside the city limits. Proposal Description: The applicant is proposing a change of use classification in tenant suite A within Tigard Towne Center. Presently, 16200 SW Pacific Highway, Suite A is approved for an eating and drinking establishment (formerly Tin Tin Buffet), the applicant wishes to convert this to an indoor entertainment establishment to allow a new Anytime Fitness to open. Differenet use classifications are subject to different development standards, such as minimum parking requirements. This review is necessary to ensure the proposed new use meets all requirements. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: The proposed change in use requires a Minor Modification to approved plans or existing development. Section 18.360.060.0 states that a minor modification shall be approved, approved with conditions or denied following the Director's review and as follows: 1. The proposed development is in compliance with all applicable requirements of this title. The project conforms with all applicable requirements pertaining to off - street parking, permitted land uses, and development standards within the C -G zoning district and Tigard Triangle Plan Area. Therefore, this criterion is met. 2. The modification is not a major modification. Section 18.360.050.B states that the Director shall determine that a major modification will result if one or more of the following changes are proposed: 1. An increase in dwelling unit density, or lot coverage for residential development; There are no dwelling units on the property. Therefore, this criterion does not apply. 2. A change in the ratio or number of different types of dwellings; There are no dwelling units on the property. Therefore, this criterion does not apply. 3. A change that requires additional on -site parking in accordance with Chapter 18.765. The change of land use will not require additional on -site parking. Primary use... at 100% of the minimum vehicle parking required for that use... 2. Secondary use... at 90% of the minimum vehicle parking required for that use..." The site plan shows a total of 920 parking spaces. There is sufficient parking on the site to accommodate the change of use and therefore, this criterion is met. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code; The structure type would not change as a result of this project. Therefore, this criterion does not apply. 5. An increase in the height of the building(s) by more than 20 %; There is no proposed change in building height. Therefore, this criterion does not apply. 6. A change in the type and location of access ways and parking areas where off - site traffic would be affected; The proposal does not change the location or type of any access ways or parking areas on the site. Therefore, this criterion does not apply. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day; The proposal does not increase vehicular traffic to and from the site by 100 vehicles per day. Therefore, this criterion is met. 8. An increase in the floor area proposed for a nonresidential use by more than 10% excluding expansions under 5,000 square feet; The proposed project would not result in an expansion of floor area. Therefore, this criterion does not apply. 9. A reduction in the area reserved for common space and /or usable open space which reduces the open space area below the minimum required by this code or reduces the open space area by more than 10 %; The project is limited to interior work and would not affect common space or usable open space. Therefore, this criterion does not apply. 10. A reduction of project amenities below the minimum established by this code or by more than 10% where specified in the site plan: a. Recreational facilities; b. Screening; and /or c. Landscaping provisions. The proposal would not affect recreational facilities, screening, or landscaping. As a result these criterion do not apply. A modification to the conditions imposed at the time of site development review approval which is not the subject of B 1 through 10 above of this subsection. The proposal does not modify conditions imposed at the time of site development review approval which are not the subject of B1 through 10 above of this subsection. Therefore, this criterion does not apply. FINDING: Staff finds that the threshold criteria listed in TDC18.360.050.B.1 -11 are either satisfied or do not apply. Therefore, the proposed development is not a major modification. These criteria are met. CONCLUSION: The proposal is in compliance with the applicable requirements of this title and is a minor modification of existing site development. SECTION V.
