DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. BACKGROUND INFORMATION Site Information: The subject parcel is located at the northwest corner of the Bridgeport Shopping Complex near the intersection of 72n Avenue and Lower Boones Ferry Road. It was developed as a conditional use through an intergovernmental agreement by the City of Tualatin. Proposal Description: The proposal is to create an open -air outdoor dining area that will include removing four parking spaces. The spaces will be replaced across the private drive. The proposed spaces will be standard size as were those removed. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS MINOR MODIFICATION OF SITE DEVELOPMENT REVIEW: Section 18.330.020.C.3 states that a minor modification shall be approved, approved with conditions or denied following the Director's review based on the findings that: 1. The proposed development is in compliance with all applicable requirements of this title; and FINDING: Upon review of the proposal's plans and narrative, staff finds that all applicable requirements of this title are satisfied. This criterion is met. 2. The modification is not a major modification. FINDING: Staff finds that the criteria listed in TDC18.330.B.2.a -g do not apply. Therefore, the proposed development is not .a major modification. This criterion is met. CONCLUSION: The proposal is in compliance with the applicable requirements of this title and it is a minor modification of a conditional use. SECTION V. As such, the Director's decision is final on the date it is mailed or otherwise provided to the applicant, whichever occurs first. The parking spaces declined in depth from west to east. I drew in red a revision that works without parking stop blocks (you can use them if you wish, but the leading edge must be 3 ft from shrubs and trees). The new curb will also provide this protection. Call me Dec 31 or Jan 2 or after if you have questions. This is the fast route for incomplete letters and revisions....saves days and days and I have your structural plans on my desk for review.
