CITY OF TIGARD NOTICE OF DECISION. SITE DEVELOPMENT REVIEW SDR 90-0020 ROACH (WESTERN PARTITIONS) APPLICATION: A request for Site Development Review approval to construct a 20,470 square foot warehouse and office building on a 45,730 square foot p Zoning: ( ) A 8300 SW Hunziker Street, parcel. Zonx.n I--P (Industrial Park Location. approximately 500 feet east of GW Hall Blvd. (WCTM 281. 1BC, Tax Lot 2201). DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APPROVED the above request subject to certain conditions. ns. The findings and conclusions on which the decision is based are noted below: FINDINGS OF FACT 1. Background The subject property was created as the result of a minor land Partition (File No MLP 9-86), which approved division of the original parcel of 140,000 square feet into three parcels. This property represents the eastern parcel created by this partition. The Planning Division previously reviewed an application for Construction of a 16,000 square foot industrial building on this site (SDR 88 -29). No action on construction of that proposed building occurred. No other land use or development applications regarding this parcel have been reviewed by the City of Tigard. Vicinity Information p northwest across Hunziker Street are zoned R-4.5 Pro ertes to the noa,t (Residential, 4.5 units /acre) , and are developed primarily with single y p the , east, are family residences. Properties to the north east south and west ar zoned I -P (Industrial Park) and are developed with a mixture of office and light industrial uses. Site Information and Proposal Description The property ib presently 'undeveloped. The property slopes gently' away from Hunziker Street. The applicant' proposes tt construct a 20,470 square foot warehouse and office building adjacent to the western property line. An access drive and, parking spaces ` are to be provided in, the eastern and southeastern portions of ` the property. One driveway entrance IS proposed at the eastern end of the Hunziker'' Street frontage. Twenty parking spaces are to be provided, plus four loading spared. The southeastern portion of the site will be paved for truck maneuvering and access to two at -grade overhead door loading NOTICE OF DECISION - SDR 50-0020 ROACH' PAGE 1 areas and one loading dock. In addition, one at- grade loading door will be provided adjacent to the parking area. Four loading parking spaces will be provided. ' The plan provides for 20.2 percent of the site to be landscaped. In order to take advantage of the I -P zone's allowance for 20 percent of landscaped area rather than the standard 25 percent, the landscaping plan provides for five sunset maple street trees with diameters of 3 inches or greater to be planted along the Hunziker. Street frontage. Tn addition, a ten -foot wide landscaped area separates the parking area from the street frontage. Finally, a number of trees and shrubs are located throughout the site including a combination of shrubs and trees along the site's eastern and western sides are intended to serve as a landscape buffer between the site and adjacent properties. . Agency and NPO Comments The Engineering Division has reviewed the request and provides the following comments: a. The site accesses to S.W. Hunziker Street, a major, collector street. The existing right of way of SO ' feet is the required width for a major collector. Along the frontage of the site, existing street improvements include a 36 foot wide pavement with and s3 a curb, a sidewalk street lights have curb; not been previously installed and will therefore be required. • A sanitary sewer is available in S. W. Hunziker Street about 90 feet west of the site. A pump station with a force main is proposed. The route of the force ma.i n is not shown but • appears to requirelan easement from the adjacent parcel. • The Unified sewerage District has established and the City has agreed to enforce, (Resolution No. 90 -43) '' surface water management regulations requiring the construction of on -Nita w 'rer quality facil:aties or fees in` lieu of their construction. Requiring surface t Ater quality` facilities on small sites would result in numerous 'facilities that could become a maintenance burden to the City. Furthermore, the applicant has. not proposed any Such facilities 'and there arS no natural depressions or other areas'of thih site that particularly suitable for water duality facilities Regional facilities, funded by •fees in lieu of construction of. these facilities' would ` provide the reruired treatment , with improved reliability and less, maintenance:. Cons ecsue tly a fee in Lieu of the construction of on -site water quality facilities should be assessed. • Storm drainage is provided by connecting to an ek sting private storm drain that is connected to a public storm public storm sewer, has inadequate capacity. NOTICE I 0P DgdISION - ODR 90 0020 - ROACH PA0,E 2 • Therefore detention of storm drainage is required. Also, a joint use /maintenance agreement between the owners of the site and owners of the private storm sewer should be executed,_ The Building Division has noted that the storm drain line along the rear property line is a private storm line. The applicant will need to show proof of right to access this storm drainage line or else will'; need to arrange for other means of storm drainage. The private storm drainage connects Public storm that ma y b be undersized' The applicant shall coordinate with the Engineering Divis ion to determine whether on -site retention of storm drainage is necessary in order to avoid exceeding the capacity of the public storm sewer. The Tualatin galley Fire and Rescue District has reviewed the proposal and has commented that the required fire flow for this structure is 3348 GPM, therefore, automatic sprinkler protection will be required. In addition, hydrants must be located within 500 feet of all portions of the outside wall of the building, to be measured around the, outside. Also one hydrant will be required within 70 feet of the fire department connection on the sprinkler system. NPO #5, the Tigard Water District, General Telephone, and Portland General Electric have reviewed the proposal and have issued no comments or objections No other comments have been received. ANALYSIS AND CONCLUSION proposed development with Community Development Code The ro osed develc meat.... conforms via. requirements for type of use, building setbacks, building height, maximum site coverage, visual clearance at drive /road intersections, Sign . location, off-street loading area, and vehicular and pedestrian access. However, the following aspects of this proposal, warrant further discusssionc Parking. Comunt y Development Code Section 18.106.030.D2 requires parking to be provided at a ratio of one parking space per 1,000 square feet of building area for an industrial warehouse. Ther efore, p requires Parking p for the 20,470 square foot this develo merit re zres 21 Arkin s aces f'o building. The site plan states that 24 parking spaces including 15 standard spaces, 4 compact spaces, one designated handicapped apace,; and 4 loading spaces will be provided.' However, the Code'S parking qui' a intended to include loading spaces as part of the requirement is not rote qu p p 0A requires that at required Arkin s aces: Code .Sectiori 18,108.08 least two off -street loading a p aces be provided for ,,a commercial' or industrial building between 101,001 square feet in. Size and. 30,000 s are exclusive of the minirum off - street parking space requirement, i we, the site plan will r provide t lherefo. lees to be revised to rova.de for a least one additional off-Street parking space. NOTICE OP DECISION - Spit 90- »0020 ROACH PA(E" 3 4 •, i.andscapinq. The Community Development Code requires that 25 percent of a developed parcel in the I-P zone be landscaped- If additional landscaping amenities are provided,' including '3 -inch caliper street trees and a minimum 10-foot la p ndsea ed buffer between the front lot link and the parking area, the total landscaped area of the development can be reduced to 20 percent. The site plan provides for five red sunset maple trees to be provided along the site's Hunziker Street frontage. The landscaping plan notes that all are to have a minimum caliper of 3- inches at planting- In addition, the site plan provides for a 10- -foot wide landscaped area to separate the Proposed new sidewalk along the street from the parking area'. The landscaping plan therefore satisfies the requirements for a reduction in the total landscaped area to 20 percent of the completed development. w DECISION Based upon the above findings and conclusions, the Director's designee APPROVES Site Development Review SDR 90 -0020 subject to the following conditions: BUILDING- PERMITS WILL NOT BE ISSUED UNTIL THE CONDITIONS LISTED' BELOW ARE SATISFIED OR AN ACCEPTABLE PERFORMANCE ASSURANCE IS POSTED. 1'. Hunziker Road, approximately 500 feet east of S.W. Hall Blvd. Findings: 1. The applicant has submitted the following plans; site, erosion control, planting, floor, and e levation. The site plan shows the proposed building la y out , grading plan, storm drainage, sanitary sewer, and o ther proposed improvements The site accesses to S.W. Hunziker Road, a major collector. The existing right of way of 60 feet is the required width for a major collector. Along the frontage of the site, existing street improvements include a 36 foot wide pavement with a curb; a sidewalk and street lights have not been installed and will be required. A sanitary sewer is available in S. W. Hunziker Road about 90 feet_ west of the site, a pump station with a force main is proposed. The route of the force main is not shown. but appears to require an easement from the adjacent parcel. The Unified Sewerage Agency has established and the City has agreed to , (resolution ., 90-45) - Management Regulations enforce resolution 10 90 4 Surface W ater requiring the construction of on site water quality facilities or fees in lieu of their construction, Requiring surface water quality facilities on small sites would result in numerous facilities that would become a maintenance burden to the City. Furthermore, the applicant has not proposed any such facilities and there are no natural depressions or,other areas of this site that particularly suitable for water quality facilities, Regional facilities, funded by fees in lieu of construction of these' facilities would provide the required treatment with improved reliability. and less maintenance. Consequently a fee =in -lieu of the construction of on -site water quality facilit:.es should 'be assessed, Storm drainage is provided by connecting to an. existing private storm drain that is connected to a p storm sewer , The p ublic st orm sewer has inadequate capacity so detention ers of the rivate storm is required. Also a joint use /maintenance g the Hers of the site and awn p agreement between i.he ow sewer should be executed, E / S - E NGZNIJERI CJMMENZ' TO.AGI- MCl,1N SDi. 9 0002 0 PAC • Recommendation The applicant shall install streetlights and a 5 foot wide city approved sidewalk along the site's frontage road, S.W. Hunziker Road. Details of the sanitary force main and its connection to the existing public sewer shall be provided as part of the site improvement plans. Designs submitted shall be stamped by a Registered Professional Engineer licensed to practice, in the State of Oregon. A copy of the recorded private sanitary sewer easement shall be provided to the Engineering Division. Storm drainage detention details and calculations shall be provided as part of the site improvement plans, Designs and calculations submitted shall be stamped by a Registered Professional Engineer licensed to practice in the State of Oregon. A joint use and maintenance agreement for the private storm sewer between the owner of the site and the owrner of the sewer shall be executed and recorded after it has been approved by the Engineering Division. The agreement shall be referenced on and become part of all applicable parcel deeds. 6.. Two (2) sets of detailed improvement plans and profile construction drawings shall be submitted for preliminary review to the Engineering Department, Seven (7) sets of approved construction cost estimate, all prepared by a Registered Professional sional Engineer licensed to practice in the State of Oregon shall be submitted for final review and approval (NOTE: these plans are in addition to any drawings requited by the Building Division and should only include sheets relevant to public improvements) 7. (WCTM[251 1BC T. L. 2201). Zone: I -P (Industrial Park). DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has approved the above described application subject to certain conditions. The findings and conclusions upon which the decision is based are noted below. T 1'INDINC . OF' 'i.0 1. Background The subject property was recently created as a result of a minor land partition (File No. MLP 9 -86 ):which was a pproved divide the ,parcel of 140, 263 s qu are fe et into three p arcels . T his P pert re resents the ro y~ P eastern parcel. created by this partition. Vicinity; Information Properties to the northwest across Hunziker Street are zoned R -4.5 esdentia.l fv 4..5.. units /acres) and are developed primarily, with 'Single y residences. Properties to the north, east, south, and west are all zoned I4-P (Industrial Park)' and are developed with a mixture of of fice and light industrial uses. 3. Site Information and Proposal The property is presentl' y undevelo d and it slopes gently down away from Hunziker Street. The applicant proposes to construct a 16,200 square foot industrial building adjacent to the western property line. An access drive and parking spaces are to be provided in the eastern and southern portions of the property. One driveway entrance is ro osed at the east I p ern' end of the Nuntiker Street aced are to be_ provz.ded. s The frontage and f offal. of 3 f parking spaces area adjacent t: the eastern and southern section of the building will be paved for maneuvering trucks near three loading doors. SDR 88-29 PAGE 1 . Agency and NPO Comments The Engineering Division has reviewed the proposal . and , offers the follow comments: a. The applicant has submitted a site plan showing a preliminary design of the proposed on-site improvements. b. The site will have access to Hunziker Street, which is a major collector. The existing 60 foot right -of -way is consistent required such a street. Along the with the re .red width for frontage, existing street improvements include a 36 foot wide pavement with a curb, but a sidewalk and street lights have not been installr..rd. c. A sanitary sewer is available in Hunziker Street about 90 feet west of this site. A pump station on the site with a 3 inch force main is proposed. The route of the force main is not shown, but it appears to require an easement from the adjacent parcel to the west. Storm drainage is provided by connecting the d y g proposed catch basin to an existing private storm drain which in turn is connected to a ° public storm sewer' The public storm sewer not have adequate capacity and therefore, stormwater detention is required. Also, a oint use /maintenance agreement between t he owners of the site and owners of the private storm sewer should be executed. General Telephone and Portland General Electric, have no objections to the proposal. The Tigard Water District has no objections to the request, however, the District does note that the applicant should contact the District regarding water requirements for both fire protection and domestic use. Washington y Eire District 1 No. indicates that a hydrant Should' be County within 250 feet of all portions of the structure. If the building is fully s rinklered this distance may be expanded to 500 feet. The Building Ins ection Division plans j ow a j; .storm connection to an existin storm system which i Lana sh g notes that, the s private. NC%'ICE GV DECISION HFCSER (S A D n CONST SDR 88-2 PAGE 2 ANALYSIS AND CONCLUSION The proposed pDeed dev elopment conforms with Community Development Code requirements for building height, setback, yard area requirements, visual clearance, off;istreet parking and loading, and access and egress. However, there aspects of this p which warrant - P there are several as Proposal further discussion. • Parking The Code requires parking to be provided at a ratio of one parking space per 1,00' square feet of building area for this type, of activity. Therefore, this development requires 17 parking spaces and, as noted earlier, 36 spaces are proposed. The applicant has shown the one necessary handicapped parking space in an appropriate location, as well as bicycle parking. The plans for the specific type of bicycle rack should be submitted to the Planning Division for approval prior to installation. . Access Proposed y y ated and the The ro Deed drivcwa entrance is su.tabl l,oc majority of the driveway within the site is over 2 over 4 feet in width. However, at the south side of the building, the driveway is only shown to be 20 feet 7 inches where the Community Development Code requires a driveway eway width of 24 feet. The site plan should be amended to provide this slight expansion of driveway width. • Landscaping The Code requires that 25 percent of a parcel in the 1-P zone be retained for landscaping. If additional amenities are provided, including 3 inch caliper street trees and a minimum 10 foot landscaped buffer along the front of the project, the landscaped area can be reduced to 20 percent. Prior to the issuance of building permits, the applicant must `submit a landscaping plan which - and around9the' parking and loading area, any the Hunziker Street fronts e trees and screening alon IP ' g d a description of the types of ground cover and other planting Materials to be used. It is :recommended that the pp it applicant caztsu with the Planning staff prior to developing this landscaping plan.
