FINDINGS OF FACT • Background Two Sign Code Exception applcationsa regarding the existing Landmark Ford development (SCE 86-09, SCE 89 -14) and one Sign Code Exception application regarding tax lot 6400 (SCE 87-02) have previously been reviewed by the City. (A410 if Information and Proposal Description The properties involved in this application include 9 separate tax lots located between SW 66th Avenue and SW 68th'Avenuo north of Franklin Street. Tax lot 6400 contains a single story office building currently occupied . by Nendel's and FoneAmerica. Tax lot 5700 contains a single - family residence. The remaining involved, parcels are vacant and mostly` wooded. Lot line adjustment approval is requested to transfer approximately 4611 feet from the south side of tax lot 640]. to tax lot 6400 with ; an equal amount from the west side of tax lot 6400 to be transferred to tax lot 6401. The portion of tax lot 6400 to be transferred is the former right -of -way of SW 67th Avenue which was vacated by Council action in 1988. Map One illustrates the proposed lot line adjustment. The applicant proposes expansion of the existing car dealership located on the adjacent parcels to the north onto the parcels involved in this application. A 49,400 square foot single story service and parts building will be constructed in the southwestern corner of the site The service building will include a roof deck with parking for 76 cars. Access to the roof deck will be from the parking lot to the northeast via a bridge over the pavement below. Also proposed is a 2,550 square foot single story used car, sales building located west of the existing dealership building and north of building proposed service /parts building. The plan provides for a significant amount of grading and tree removal' to accomplish the proposed improvements. The majority of, this site will include expanded paved parking area for the car dealership. Approximately 370 display and inventory parking spaces will be distributed throughout the site including 76 parking spaces on he, roof deck of the service and parts building. The site is designed so that customers bringing their cars for service will approach the building from the northwest and be greeted underneath an open -sided canopy attached to the building. Dealership employees will move the customer vehicles to the 'customer vehicle parking area. Also adjacent to the service and parts building, 26 employee parking spaces are proposed in the southwest corner of the site. The applicant proposes a "Truck Only" exit from the employee parking lot to SW 68th Avenue. As previously mentioned, the plans will require a substantial amount of grading and tree removal. However, p the site plan does call for retention of a number of the existing mature trees on this site, including a large oak tree adjacent to the used car building, two other oak trees in the southwestern corner of the proposed service and parts building, and a number of fir trees along the SW 68th and SW 66th Avenue frontages In addition, a few other scattered mature trees will, be preserved throughout the site The landscaping plan provides for a number of new deciduous street trees to be located along the newly developed site frontages. Hornbeam trees are proposed along the SW 66th Avenue frontage as well as the retention of a number of existing evergreen trees. A number of zelcova trees are proposed as street trees along the Franklin Street and SW 68th Avenue frontages. In addition, a number of fir trees are to be preserved at the southeastern corner of the site adjacent to these streets Flame ash trees are to be planted along the southern edge of the inventory lot's boundary with the Foneerican and Nendel site to the south. A variety of other trees and shrubs are to be located within landscaped islands within the proposed parking areas. The Community Development Code normally requires that 15 percent of a site within the C-G zone be landscaped. The applicant requests that an exception to this standard be granted. Access is provided by SW Franklin Street and SW 68th Avenue. SW` Franklin Street is a local street with no curb or sidewalk along the frontage. SW 68th Avenue is a major collector street improved with a curb but no sidewalk. Both streets have an adequate right -of -way of 60 feet. The applicant has proposed to not construct curb or sidewalk along the SW 66th Avenue frontage. 18.164.030 A.1.c.(iii) of the Code permits the Director to accept a future improvement guarantee in lieu of street improvements if, "due to the nature of existing development on the adjacent properties it is unlikelj;t that the street improvements would be extended in the fol' 'Iseeablr? future and that the improvement associated with the proje:t under review does not, by itself, provide a significant improvement to street safety or capacity." acit S p y SW 66th Avenue is a frontage road along the 1-5 freeway and dead ends near the northern Property line of the parcel to the north that is part of this facility. There is one parcel along the SW 66th Avenue frontage between the site and SW Franklin Street. Although the y p r along the site is cull developed, the curbs and sidewalk a frontage have not been installed. Since installation of curb and sidewalks along either adjacent properties is unlikely and the street does net provide for through traffic, it appears that installation of curb and sidewalks would not provide a significant improvement to street safety or capacity and should not be required. Storm drainage is provided by an existing 24 inch culvert under SW 68th Avenue and existing an 18 inch culvert under SW Franklin Street. Both lines were installed by the Oregon State Highway Division as part of the construction of SW 68th Avenue. Sanitary sewer service ,€or the proposed building is provided by an existing line in SW Franklin Street. The Unified Sewerage has established, and the City' has agreed to enforcer (Resolution 90-43) Surface Water Management Regulations requiring the construction of on -site water quality facilities or fees in lieu of their construction. Requiring surface, water quality facilities on small sites would result in numerous facilities that would become maintenance burden to the ,'City. Consequently, a. fee in lieu of the construction of on -site water quality facilities should be assessed. The Tualatin Valley Fire and Rescue District has reviewed the proposal and has commented that turning radii for the access roadways through the site shall be no less than 45 feet outside and 25 feet inside. In addition, fire hydrants are required within 250 feet of all exterior portions of structures or 500 feet if the buildings are sprinklered. Hydrant locations should be coordinated with the Metzger Water District as well as the Fire District., The Building Division, Oregon State Highway Division, Portland G:aneral Electric, Northwest Natural Gas, General Telephone, and Metro Area Communication Commission (Cable Television) have reviewed the proposal and have made no comments No other comments have been received. ANALYSIS AND CONCLUSION Lot Line Adj uetment The proposed lot line adjustment between tax lots 6400 and 6401 complies with applicable Code standards. No minimum lot size is required in the C-G zone. Neither lots' size would be altered by the proposed adjustment. Both parcels will cont.i.nne to exceed the 50 foot average minimum lot width standard, of the C-G zone'. No building setbacks would be adversely affected by the proposed adjustment Site Development Review The proposal for expansion of Landmark Ford complies with Community Development Code C -G (General Commercial) zoning district requirements for setbacks, building height, and usage. Autornobile sales and repairs are permitted uses in the C -G zone. The proposal is not consistent �,n with C-G zoning district requirements for minimum on -site landsca P` g (15 .. The proposal conforms with general Site Development Review requirements as well as applicable code requirements related to vision clearance at intersections, number and location of required parking spaces, screening of service facilities, and provision of street trees and internal site landscaping. Parking, access, and landscaping are discussed further below. The site plan, however, does not note how many bicycle spaces will be provided in the racks. Community Development Code Section 18.106.020.P requires that one bicycle parking space within a rack be provided for 15 automobile parking spaces. Ninety-two combination used car customer, service customer, and employee parking spaces are provided. Therefore, the bicycle racks shall provide for no less than 7 bicycle parking spaces within the racks. Recent changes to the Oregon Revised Statutes have increased the requirement for designated handicapped parking , spaces Based upon the State Statutes, three required handicapped spaces are required for a parking lot with between 50 and 150 customer- serving parking spaces. The site plan appropriately proposes provision of three handicapped parking spaces. The 'spaces are appropriately located adjacent to the building entrances and are appropriately sized to provide for a six- foot wide aisle on the passenger side of the space. The site plan provides for approximately 370 display and inventory parking spaces for the needs of the car dealership. This includes 76 parking spaces on the roof deck of the service building. Staff p applauds the use of the roof deck for this additional parking and will encourage other auto - intensive uses to follow this example' in providing for their parking needs. Access, Street Improvements The plan provides for an adequate number of access driveways and appropriate locations for accesses 4,,,. g "Truck to the ,:kin lot. Staff agrees to allow the gross site area landscaping to substitute for compliance with the 15 percent net site area landscaping standard. However, staff notes that some of the area included within the landscaped area shown on the site plan dated August 29, 1990, is currently mowed weeds and barkdust without plantings. A revised landscaping plan will need to be submitted for staff review and approval that indicates proposed landscaping materials to be, installed in all areas within public rights -of -way that t.,re intended to count towards the 20 percent gross site area standard. Acceptable landscaping materials must consist Of domestic grasses, shrubs, trees or groundcovers. Use of gravel or bark dust must not be more than a minor part of the proposed landscaping. The proposed development will necessitate removal of a number of the mature trees on the property. The site plan, however, calls for retaining quite a few of the larger mature trees, especially on the site's perimeter. Reasonable care has been taken to design the site so as to reduce the trees to be removed, especially because of the auto - related nature of the use with its need for extensive parking areas. Nevertheless, staff finds that one additional significant tree,' located in the southwestern corne- of the site should be preserved. This includes the large oak tree adjacent to the proposed used car sales building. In addition, the plans should be revised to provide for retention of the 24 inch diameter fir tree in the southwestern corner of the site as shown on the Survey. We were pleased that our second phase had progressed through the pre - application and planning stages to construction of improvements. We have completed most of the basic site work and 1 have over $500,000 spent towards this phase but now we are presented with a few roadblocks 1) Building fire rating is different than expected. This resulted in significant cost increases and limited future expansion. Some progress has been made on this issue. 2) 'Inadequate offsite storm drainage was discovered after the basic site drain system was installed. We were informed that street- opening permits would not be issued by the City until we improve drainage conditions in this offsite area at our expense. This requirement is unacceptable to us since it is clear that the existing culvert condition is a nonfunctional installation carried out by other 'parties and left in an inoperable condition since it was built. Discussions to date reflect a solution consisting of ditch excavation to the bottom of the culvert and installation of , concrete pipe and backfill a distance sufficient suf f icient to " daylight: the pipe. It is our understanding that backfilled pipe is required because of the depth of the required ditch and safety concerns. The City has offered to provide the pipe, leaving ditch construction, pipe installation, and backfilling to Landmark Ford. We reject the position of the City on the basis of the existing culvert condition and the fact that the storm system development charges to be paid by Landmark Ford amount to $23,500. It is our position that the culvert condition is a City maintenance issue or State installation issue and has no p drainage beyond storm ainage improvements that have mbeen Ford u on our project in accordance with permit application procedures. 3) The last issue is the sidewalk half street improvement requirements on. 68th Avenue. Reluctantly I have agreed to do whatever the City required to the permit process and that was to install improvements to major collector street standards and to install them from Franklin to the Interstate on/off ramp. The condition was not imposed when we originally did the site work on the northerly section during our phase one project in 1988 nor during the pre - application meeting for phase two in 1990.
