The findings and conclusions on which the decision is based are noted below: • FINDINGS OF FACT • Background A Director's Decision was issued on September 13, 1990 regarding this development proposal. The applicant has stated that a paved surface with curves would di1rupt traffic circulation when trucks are parked at the proposed; loading docks. This problem appears to result from the owner's use of the site rather than special circumstances peculiar to the lot. Consequently, the requirements of paragraph two are not met. Furthermore, the requirement of paragraph five requiring that the hardship be not self imposed is similarly not met. Accordingly, approval of the requested variance is not recommended. The Unified Sewerage Agency has established and the City has agreed to en.xorce, (Resolution 90 -43) Surface Water Management Regulations requiring the construction of on -site water quality facilities or fees in lieu of their construction. Requiring surface water quality facilities on small sites would result in numerous facilities that would become a maintenance burden to the City. Furthermore,; the applicant has not proposed any such facilities and there are no natural depressions or other area of the site that are particularly suitable for a water quality facility. Regional facilities, funded by fees in lieu of the construction of these facilities would provide the required treatment with improved reliability and less maintenance. No other comments have been received. B. ANALYSTS AND CONCLUSION This proposal has been reviewed for compliance with this applicable sections of the Community Development Code, The review of these issues follows below: s T��L Zone u�. RearPlnen proposal The ro p osal is consistent with s etback requirements for the I -L zone, with the exception of the setback for the new building adjacent to Sequoia Parkway. The Community Development Code requires that a 20 foot front yard setback be provided but the proposal calls for an 11 foot building setback. The height for the proposed building is in conformity with the maximum height requirements of the I -L zone. 2 Outdoor Storage. The area immediately east of the existing building is not shown for any particular use on the site plan. However, after visiting the property it is apparent that this area is intended to be. paved. Also, the plan indicates that several doors will open onto the 10 foot yard area 'co the south. The use of these doors and the 10 foot area between the proposed building and the property line is not apparent. Landscaping. The detailed landscaping plan has not been submitted with this application. The code requires that one parking space be provided for each employee of the largest shift's The number of employees at this site has not been provided by the applicant and this will need to be verified as a condition of approval. Also, the Code requires that handicapped parking spaces he provided. In this case, one handicapped parking space should be located on the property with easy access to one or preferably both of the office areas. Finally, bicycle parking is required a ratio of 1 bicycle parking space for ` every, 15 required automobile spaces., It appears that this proposal will require one or two bike rack spaces for the development. • Access and:_ Earesd.` The plan is not clear as to how many accesses there will be to and from the property. The property' presently has one driveway to the north door of the existing building. A second ; driveway is located immediately. to the west which serves as the primary access to the Site. A driveway is also developed on Sequoia Parkway. The 20 foot wide driveway access from Bonita into the Road into site is apparently intended for one -way traffic and the 20 foot width would require one -way' traffic. FTowever,it has not been noted on the site plan or in the submittal that this is intended by the applicant. Two -way drives are required to have a width of 24 feet. In addition to the standard Code requirements, the applicant has requested a variance to be able to utilize the northwest portion of the property as it is presently being used today. This area now is occu p ied Y Y number �s, gravel areas, grass areas, and is partial used for outdoor storage andparking. It proposed that this area would continue to be used in this manner so that overflow truck and automobile parking could be acoornmodated. The proposed Variance is not consistent with the above criteria for the following reasons: p p paving requirement is to provide for 1. Also the paving requirement helps in minimizing the problem with dust and stream sedimentation. 2. There are no special circumstances relating to this property. It is level, regularly shaped property, and there are no apparent development constraints. Also, there is sufficient room to required p g sufficient o provide for the re .red l.aridsca. iin for adequate parking area of 15% as well as or a,de uate ark�:n and maneuver area for employees and vLsitors to the site. The light industrial or manufacturing activity on the property iss permitted by the Code. However, the Variance is not necessary to make reasonable economic use of the property. There :iss sufficient land available to provide for both parking and maneuvering of vehicles as well as the 15% landscapihhg requirements. Existing physical systems would be adversely affected because the applicant is not providing for sufficient space for maneuvering of vehicles. The area intended to be both landscaped and graveled for occasional maneu vering of vehicles is not sufficient for either purpose: Staff suggests that a portion of this y for landscaping and another portion be developede r accessways and maneuvering of vehicles. ` p, if is ' one, is Self - imposed because 5. It is intended that automobiles would enter the site via the northern driveway and use the 17 diagonal parking p ' lg spaces provided on either" side of the driveway immediately west of the existing industrial building. The applicant proposes the parking spaces on the west side of this driveway he left in a gravel condition. The remaining northwest portion' of the property is 'intended for parking as well as %or overflow maneuvering for trucks and other, vehicles. (since the. Community' Development Code requires that pavement be provided for all areas intended to accommodated vehicular traffic or storage, a variance is required i n order to a gravel 'surface. The applicant intends to preserve most Of -the . existing trees on the site. However, a detailed landscaping plan has not been submitted with the application. . Agency and NPO Comments The Engineering Division has reviewed the request and provides the following comments: The site fronts to SW Bonita Road and Sw I Sequoia Parkway. The Unified Sewerage Agency has establLshed and the City has agreed to enforce, (Resolution 90 -43) Surface Water Management Regulations requiring the construction of on-site water quality facilities or fees in lieu of their construction. Requiring surface water quality facilities on small sites would result in numerous facilities that would become a maintenance burden to the City. I Furthermore* the applicant has not proposed any such facilities and there are no, natural depressions or other areas of the site that are particularly suitable for a water quality facility. Regional facilities, funded by fees in lieu of the construction of these facilities would provide the required treatment with improved reliability and less maintenance. The State ,Highway ,Division, the Building Division, and Portland General Electric have no ob jections to the proposal. Based upon the information shown, there , are a number of modifications that will need to be reflected in the detailed landscaping plan. The Code requires that 15% of the area of the property be devoted to landscaping. The plan shows that approximately 8% of the property will be landscaped.
