DECISS®N: Notice is hereby given that the Planning Director's designee for the City of Tigard has 1'APPROVED site Development Review SDR 90 -07 and has APPROVED a 'Variance (VAR 90-12) to allow a 15 foot wide access drive, subject to certain conditions. The findings and conclusions on which the decision is based are noted below: FINDXT G OF FACT . Background The subject t parcel was created as a result of a minor land partition (MLP 88-15) approved in Decembers 1988. No other land use applications regarding 't hi s parcel have been reviewed by the uie y o Tigard Plann i ng Division. • Vicinity Information Properties to the northeast and southwest are also zoned C-P and are developed with a mixture of residential single- family dwelling and converted office uses. Properties to the northwest are zoned R -7 (Residential, 7 units /acre) and are developed with s1.ngle -� family dwellings, The property just north of the mite is zoned R-: 12 (Residential, 12 units /acre) and is occupied by an apartment complex. Pacific Highway is directly South of the parcel, across Center Street and an embankment which provides Screening. 3. Site Information and Proposal Description The site is approximately 7,961 square feet in size, and has an average lot depth of approximately, 127 feet. The Center Street frontage is approximately 63 feet in length: ' The ' parcel had an Pp downward slope to the southwest towards a ditch a roxi�ia�.Q 5% cow located along the west property line,. A garage is located near the southwest corner Of the lot. The applicant has identified 9 trees with a diameter greater than 5 inches, these include mature elm, fir, pine, cedar, and maple trees, According to the existing features site plan the applicant intends to remove four of the existing trees (2 elms, a cedar, and a maple) NOTICE OF D37CISION SDR 90- 07 /V'AR 3'0 -12' -- B & F /NICOLZ PAGE 1 b • 4 44 to accommodate construction of the proposed 3,128 square foot office building. The remaining trees have been integrated, into the development plan. Seventy -two percent of the site is to be covered with impervious surfaces, the remaining 27.5% is to be landscaped. An exsta,n existing garage is to be removed. Nine parking spaces are proposed including 5 standard, 1 handicapped, and 3 compact spaces. Improvements include a 5 foot wide sidewalk along the Center Street frontage and a 5 foot utility easement. The accessway and parking area are to be paved with concrete and concrete pavers are proposed along the proposed building'S , south face and within the drip line of two existing trees, one located on the southern property line, the other located in the northeast corner of the proposed parking lot. The applicant has also requested a variance to allow a 15 foot wide access drive where 24 feet is normally required. The accessway is to be located along the southern property line and is intended to provide ingress and egress. The applicant has indicated that he has made arrangements easement created by the adjoining g to have an e property owner to provide additional width if necessary. Agency and NPO:Comments The Engineering Division has the following comments: a. The applicant has submitted a site k plan and a grading; and utility plane b. The subject parcel was ,created by a minor land partition (YLP 88 -15) That application required additional dedication of right- o£�wa y for Ce nter Street and described the improvriments that were required upon application of a site deveLepment review. c. Approval of the requested variance that would permit a 15 -foot' wide aceeas driveway where the code requires a 24.-f0ot wide driveway, requ ices meetin g the standards 'set" oxt i n Section 18.134:05O of the Code. Paragraph 2 of that section requires that there be "Special circumstances that exist which are peculiar to the lot size or 'shape,' topography or other circumstances over which the applicant has no 'control, and which ar which are not applicable to other ; proper`bes in the assns zoning district." There appear to be no such special circumstaneee' and applicant' has suggested none. Moreover, Paragraph 5 of that section requires that the hardship be not self- impoeed.' It appears that the applicant could have avoided this hardship by increasing the width of the lot nor decreasing the width of the proposed building. Since neither of these criteria are met, the variance request Shoud be denier. NOTICE OF 0E018'014,-, Bbit 90-07/VAR 90 1 B .. General Telephone, Tigard Water Districtr and the proposal and have no objections to it No other comments have been received. ANALYSIS AND CONCLUSION Section 18.120.080 (Approval Standards) of the Community Development Code contains the criteria that must be applied to an application for .. p applicable the sections Site development review. Also a l.icable in this case ,.are:. t concerning landscaping and screening, visual clearance areas, off - street parking and loading, access, egress, and circulation, Signs and the standards of the C-P zoning district in which the proposal is located. The proposal satisfies the standards of the C -P zoning designation and off-street parking and loading requirements. are�entd. Staff has identified thre e areas of concern. First is the request for a variance to allow a 15 foot accessway where 24 feet is normally requied. Second is the condition and location of some of the existing trees that the applicant intends to preserve. And third is the location of an existing fence that the applicant intends to use to satisfy screening requirements for the proposed parking area. These concerns are discussed below. The Variance to the Access Width The applicant has requested approval to allow a 15 foot wide access drive. He maintains that there will be so little traffic entering and exiting the site that a 15 foot wide access will provide adequate room for ingress and egress. Staff concurs with this assessment with respect to interior portions of the driveway but is concerned that an access this narrow will create hazardous traffic conditions at the driveway entrance on Center Street. specifically, if the driveway apron is only 15 feet wide it will be impossible for a vehiOle to enter the accessway at the same time as a vehicle is exiting, This means that an entering vehicle would have to stop on center Street or, even worse, back onto Center Street to allow the exiting vehicle to proceed. This presents a i traffic p ators of the entering and exiting vehicles. to The applic nt has indicated that he has entb,red into an agreement with the adjacent property owner to provide additional easement along the southern property line which would eventually be used to widen the driveway: However, no evidence of this agreement h9.s been presented to the Planning Division. Staff concludes that the applicant must either 1) revise the site plan to provide at least a 20 foot w ide access located w! holl y vitha n the bou nds o the NOTICE OF DECIStoN SbR 90-01/VAR 90 -12 8 e F%NICCLI PAGE 3i .ti . y subject site or 2) provide adequate width (20 feet) along the common property line between tax lot 2000 and 2003 for a minimum distance of 40 linear feet from the curb by arranging to obtain the easement prior to obtaining building permits. This latter arrangement would provide adequate width for vehicles to maneuver it and out safely between tween the existng tree located on the common property line and Center Street without creating a safety hazard. The 15 foot wide access ad, acent to the tree is acceptable. Landsca.pinq and Screening The applicants effort to preserve existing trees and to use them as . part of the landscaping scheme is commendable. He has identified 9 trees on the subject, site with a diameter greater than 6 inches. He proposes to remove 4 of these trees to accommodate the placement Of the office building, parking area and other impervious surfaces. Two trees are ° proposed to be used as street trees. A pine tree on the southern property line, a spine tree located in the northeast corner of the proposed parking lot, and an elm located in the ditch at the rear of the property are also included in the landscaping plan. The applicant has ' site plan that the tree on the southern property ' line indicated on the and the tree located in the corner of the proposed parking 'lot are'to'be surrounded with concrete pavers to provide a surface over which vehicles may travel. Staff is concerned that this arrangement may lead to the destruction of these trees and will, therefore, request that an arborist: be consulted to determine whether or not this arrangement is suitable. Additionally, staff questions the health of the existing tree located on the southern property line. The applicant may use the services of the City's _arborist, at the expense of the City, or employ the services of an arboriet of his chst >osing, at his own expense, Parking Lot Arrangemev : a�ad Screen net Although the applicant has provided an adequate number of parking spaces for the proposed development, the compact space in the northeast corner of the lot, beneath the existing pine tree, should be relocated for two reasons. First, the placement of paving on all sides of the tree for the parking may present a threat to the life of the existing tree. This concern must be addressed in the arborist's report referred to in the previous paragraph. Staff recommends that the applicant l g 1 Cate` this compact parkin space adjacent to the other two compact spaces along the west side of the proposed office building, This arrangement would eliminate the problem of vehicles driving over and parking within the, entire drip line of the tree and eliminate the confusion mentioned above. kOTXCE OF DECISION SDI 90, -07 /VAR 90 -12 - B & F /NICOLr PAGE 4 0 Code Section 18.100.110 (Screening: special Provisions) contains the standards for parking lot screening. The applicant proposes a variety of landscaping maerials that will define the appearance of the parking area and provide adequate screening for adjacent land uses. Along the western property line, the existing fence and the proposed screening should provide an adequate buffer between the two uses. The existing fence is setback about 7 feet from the property line and is located on the abutting property, it should be noted here that each of the properties sharing the common lot line will be held responsible for maintaining their respective buffering and ,screening materials. Vision Clearance Area The landscape materials proposed for the vision clearance area a/9 acceptable, however, staff notes that the vision clearance area betwee x 3 and 8 feet in height must be maintained over time. ▪ DEC:i S ION The Planning Director's designee approves SDR 90 -07 And approves VR 90-- 12 to allow a 15 foot wide access easement subject to the ,following conditions: UNLESS OTHERWISE INDICATED ALL CONDITIONS MUST BE MET PRIOR TO THE ISSUANCE OF A BUILDING PERMIT. • The applicant shall submit a revised Elite plan showing either 1) a y wholly within the boundaries of the 20 fact. wide accesswa located whol subject site or 2) an easement at least 5 feet wide and 40 feet long obtained from the abutting property south of the subject site which will provide a 20 f6ot wide accessway for a distance of at least 40 feet along the southern property line of tax 2001. A reduction # n width g to 15 feet shall be ermitted be ondtthe f irst redu p y 40 feet of the accessway, adjacent to the existing pine tree and continuing into the parking area. It appears when the apartment units were constructed approximately five feet off is due to the sanitary sewer line and an open ditch for is required at the rear of units. There is currently off of the property line that this fence was built The reason the fence is fact that there is both a storm drainage purposes. The owners of the apartment complex do not provide any maintenance of this five foot strip. During the process of removing the overgrowth I discovered that over several years tenants from the apartment complex have, been throwing their garbage and furniture over the fence. These trees will make a good back drop ,for the building. 1. The two ash trees need ,a class III structural pruning and the undesirable trees and brush removed from around them. Any major disturbance to the trees 'and /or their environment will cause the tree sever harm. E'quipment'in this area will do sever damage to the roots and the soil in which the y live. It is mY recommendation that the area around the trees be cleared by hand and kept as natural as possible . 2 ar Fencing of the area should be done as far out towards the construction a s' p ossble and m � ain, d ined during the construction time.
