NO'TIC F DECISION - SDR 91-0016 - ANDERSON y FINDINGS OF 'FACT Background The City of Tigard ' , has reviewed no prior land use :er development' applications for this site Vicinity Information The subject ect arcel is bordered on all sides by properties � parcel �'` p which are zoned General Commercial (C-G). A single family residence is located immediately the north of the site. Properties directly to the south and west and east of the site are vacant. The Tigard Cinema is located ,o the southwest of the site. Site Information and Proposal Description The site is presently developed with a single famil3ril residence. There are currently six near mature trees located along the northern edgeHof, the property and one tree located near the southwest corner of the property. The developed portion of the site is currently, landscaped. The applicant requests Site Development Review approval to allow the conversion of an existing single family residence of approximately 2016 square feet into an automobile detail facility (cleaning, waxing, vacuuming). This development proposes to provide new asphalt for an additional parking area to be located along the western portion of the site The applicant proposes to retain the seven existing trees. Agency and NPO Comments The Engineering Division has reviewed the request and provides the following comments Streets The site is located on SW 72nd Avenue which is classified as a major collector and which requires 60 feet of right-of-way and 44 feet of pavement. Currently, SW 72nd Avenue has approximately 28 feet, of pavement with open ditches on both sides of the road within a 40 foot right -of -way. The applicant IS not proposing p �� � street improvements to the frontage of the �te and they should not be required at this time f or the following reasons: A. A partial improvement is not feasible due to the inability to achieve proper design standards ; � partial i Ms may create a potential safety hazard to motorists or pedestrians; NOTICE OF DECISION PAGE 1,t11. a.. • C Additional planning work is required to define , the appropriate design standards for the street and the application is for a project which would contribute only a minor portion of the anticipated future traffic on the street. Therefore, the applicant should not be required to install half- street improvements along the frontage of the site at this time. Rather, the applicant should be required to sign a Non- Remonstrance Agreement to the formation of a Local Improvement District for the future improvements to SW 72nd :Avenue. In addition, the applicant should be required to dedicate additionad right -of- -way so that it is 30 feet from centerline. 2. SANITARY SEWER: The existing structure is currently connected to the public sanitary sewer system. Therefore, no additional improvements are required. 3. STORM SEWER: There is a existing public storm sewer lines available in SW 72nd Avenue. Effective December 1, 1991, the City is required , to comply with a new requirement of the State Environmental Quality Commission (EQC) The EQC is requiring that all new developments that add additional impervious service area within the Unified Sewerage Agency (USA) area must include a water quality treatment facility. Previously, developments without a suitable site for water quality treatment were allowed to pay a fee in lieu of ° on -site water quality treatment, with the fees to be used to construct regional facilities The City Engineering Department feels that the new requirement is inappropriate. For many small developments, it is not feasible to build an on -site facility. Construction of numerous small facilities will create . jai ntenan ce problems for the cities for USA: Roem er, the City ha s no choice. Effective December 1st, the City must require the facilities or be in violation of State regulations. This ,issue was not addressed in earlier Staff reports, as we expected the issue to be resolved. between USA and the E� Er�ixeerlr g Department is �®�that he issue will be resolved within the next three months. I E The City of Tigard Building Department has reviewed this proposal and has offered the following comments; i , building permit will be required. The Tualatin Valley Fire and Rescue District has proposal and has the following comments: A fire hydrant is required within 250 feet of all exterior portions of the structure and all access roadways. Hydrant location approval will be coordinated, with. Tigard Water District. Tualatin Valley Water District has reviewed this proposal and has offered the following comments: This development may require a bac]kf low device on the water service. Tualatin Valley will review this facility after it is built. Neighborhood Planning Organization #4 has reviewed this proposal and has offered the following comments: NPO #4 has reservations about this business at this location. There are many concerns, specifically: } A business of this nature having a "used car lot" appearance. 2 } The ingress and egress of vehicles. Perhaps these issues could be considered.' It has been noticed, in some cases, that a' business has improved the area. No other comments have been received. ANALYSIS AND CONCLUSION I ON Code Section ,.�1.. 622.050 (A) ( ) (Dimensional Requirements) of the Community, Development Code (CDC) allows a maximum building height of 45 feet, in the C -G zone. The residential structure which is to be remodeled is a one -story building and is well within this height' allowance Therefore, this code section is satisfied. There setbacks which are applicable to this site. � Therefore r this site plan complies the this code requirement. The applicant has indicated that the building be used for the cloaning, waxing and vacuuming of automobiles. N' DECISION - SDR 91 -0016 - ANDERSON5 • q. y. These uses are classified in Code Section 18.42.020 6) (a)„ (Use Classifications) as Automotive and Equipment Cleaning. Code Section 18 Y62.030 (A4 d 2 lists this use as a permitted use in the C -G zoning district. Section 18.106.030(C) (7) (a) requires that an automotive and equipment cleaning facility provide a anini;nuuxn of 1 parking space for every 500 square feet of gross floor area. The proposed building's size of approximately 2,016 square feet requires a minimum of 5 vehicular parking spaces The dimensions of parking stalls are: standard space 9 X 1,8' feet; compact space 8.5 X 15 feet; handicapped space 12 X 18 feet. The current site plan does not indicate the location of individual parking stalls. Therefore, it is not possible for staff to determine if this code requirement has been satisfied. Additionally, State of Oregon House Bill 2084, which became effective September 1, 1990, requires one disabled person parking spaces if 1 to 25 parking spaces are provided. The proposed plan does not provide for the one required disabled person parking space. Therefore, this code :requirement has not satisfied. The site plan does not indicate an allocation of space for the provision of bicycle parking. Code Section i8 106.020 m requires one bicycle parking space for each 15 vehicular parking spaces in any development. Therefore, space for parking one bicycle shall be provided.. This code standard has not been satisfied. Code Section 18.108.050 requires that a walkway extend from the ground floor entrances or from the ground floor landing of stairs of all commercial and industrial uses, to the streets which provide the required access and egress. The proposed site plan does not indicate that a walkway has been provided. Therefore, this code section has not been satisfied. Therefore, this site plan should be revised to indicate the location of the five required parking spaces (one of which rust be a disabled person parking space) and to provide for the required bicycle parking space and the required pedestrian walkway. The site meets the minimum access standards through the provision of one 30 foot wide access driveway from SW 72nd Avenue. Code Section 18.10 3.080 (: ,j requires that commercial uSe parking areas with 1,ess than 100 parking spaces s pc provided with drive with access width dbe o f 3 0 feet . Therefore, this code section has been. satisfied. Code Section 18.100.110 (Screening: Special Provisions) states that trees shall be planted in landscaped islands in . all parking areas, and shall be equally distributed and on the basis on one tree for each seven parking spaces in order to provide a canopy effect. The proposed landscaping plan indicates that six existing trees located along the, north property line shall be, retained. One other existing tree, which is located adjacent to the paved area in the southwest portion of the site, shall also remain. The site plan has surpassed this requirement by providing a total of seven parking lot trees whereas, the Code requires only one tree for a parking lot of this capacity. Developments within the C-G zoning district are required to provide a minimum of 15% landscaping on the site (Section 18.6 .05fl A) ( . Of the approximately 17,013 square foot site, the applicant has proposed to cover less than one third with impervious surfaces„ The site is presently landscaped and exceeds the 15% minimum landscaping requirement. Section 18.102 ('Visual Clearance Areas) requires that clear vision area shall be maintained on the corners of all property adjacent to intersecting right -of -ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding 3 feet in height, except that obstructions which may be located in this area shall be visually clear between 3 and 8 feet in height (trees may be placed within this area provided all branches below 0 feet are removed) . Visual clearance areas shall be that triangular area formed by measuring a 30 foot distance along each of the right -of -way or property lines and then connecting these two 30 foot distance points with a straight line. Finc3.inas 1. STREETS: The site is located on S.W. 72nd which is classified as a major collector which requires 60 feet of right -of -way and 44 feet of pavement. Currently, S . W . 72nd Ave has ' only approximately 28 feet of pavement with open ditches on both sides of the road within a 40 foot right -of- -way. The applicant is not proposing any street improvements to the frontage of the site and they should. not be required at this time for the following reasons: convert a residence to' an auto detail A. A partial improvement is not feasible due to the inability to achieve proper design standards; A partial improvement may 'create a potential safety hazard to motorists or pedestrians; C. Addition6.1 planning work is required to define the appropriate design standards for the street and the application is for a project which would contribute only a minor portion of the anticipated future traffic on the street: Therefore, the applicant should not be required install half- street street improvements along the frontage of the site at this time, but should be required to sign a Non° - Remonstrance agreement to the formation of a Local Improvement District for the future improvements' to S.W. 72nd Ave. In addition, the applicant should . be required to dedicate additional right -'of -wad so that it is 30 feet from centerline. ENGINrERSNG'COMMENTS: SbR 91 -16 ANDERSON 2 SANITARY SEWER The existing structure is currently connected to the public sanitary sewer_ system. Therefore no additional requirements should be required at thus time 3. STORM SEWER,: There is a existing public storm sewer lines available in S.W. 72nd Ave. Effective December 1,, 1991, . we axe required to comply with a new requirement of the State Environmental Quality Commission (EQC) . The EQC is requiring that all new, developments, that add additional, impervious service area, within the Unified Sewerage Agency (USA) must include a water quality treatment facility. Previously, developments without a suitable site for water quality treatment were allowed to pay a fee in lieu of on -site eater quality treatment, with 1-he fees to be used to construct regional facilities. We, feel that the new requirement is inappropriate. B or many small developments, it is not feasible to build an on -site facility. Construction of numerous small facilities will,'' create maintenance problems for the cities and USA. However, we have no choice. Effective December 1st, we must require the facilities or be in violation of State regulations. This issue was not addressed in our earlier staff reports, as we expected the issue to be resolved between USA and the EQG We are still hopeful that the issue will be resolved within the next three months. Therefore, the applicant should be required to install a water quality facility, or alternatively the City Engineer may waive, this requirement to the extent allowed by the regulations. Additirnal 'right -off -way shall be dedicated, to, the Public along the S.W. 72nd Avenue frontage to increase the right -of -way to ',30 feet from the centerline The description shall be tied to the existing right -of -way c in enterline: The applicant shall i nstall a water y facility meeting the requirements of Resolution and Order No 91--47 as approved and adopted by the Unified Sewerage Agency of Washington' County.
