No other land use or development applications for this parcel have been reviewed by the City of Tigard. 2. Vicinity Information The subject parcel is bordered on the north and west by properties which are zoned R-12 (Residential, 12 units per acre) . The property to the north is developed with the Gethsemane Evangelical Lutheran Church. The property to the south and across SW Lehmann Street is zoned C-P (Commercial Professional) and is developed with the Cascade Business Center. Properties located to the east and southeast are zoned R-4.5 (Residential, 4.5 units per acre) . 3. Site Information and Proposal Description The site is presently developed with one single-family residential home. The garage which serves this residence is 1octed along the SW Lehmann Street. frontage. A second garage is located further to the east. There are a variety of deciduous trees and shrubs on the site. Of particular notice are two large Monkey Puzzle trees which are located near the site's road frontage. The applicant requests Site Development Review approval to allow the construction of a seven unit apartment building on an approximately 0.61 acre site. This development is proposed to provide parking located along the western portion of the site. 4 . Agency and NPO Comments The Engineering Division has reviewed the request and provides the following comments: 1. S'PREETS: Access to the site is provided from S.W. Lehmann, which is classified as a local street. Currently, there is a 60 foot right-of-way that fronts the development whereas local 6 street standards require 50 feet of right-of-way. Therefore, no additional sight-of-way iS required. The existing street is a mixture of improvements. Adjacent to the site and along the north side of S.W. Lehmann there is an approximately 12 feet wide pavement strip. There no other improvements along this section. On the south side of S.W. Lehmann and for a distance of approximately 250 feet, he are half-street improvements including pavement, curb and sidewalk. Therefore , the applicant should be required to install half-street improvements for the north side of SW Lehmann Street along the frontage of this development site. 2 . SANI TARY SEWER: , There is an existing 8 inch sanity sewer .line located within S.W. Lehmann Street. It appears that this line has the capacity to handle this development. Therefore, the applicant should be required to connect to the existing - sanity sewer system. 3. STORM SEWER: After reviewing the storm sewer system maps it was not readily apparent if there is an existing storm system that could serve this development. There are two systems within the vicinity of this development; A) The system which is located in S.W. Greenburg Road appears to be at to high an elevation for connection to be feasible; B) The second system is located adjacent to this development: There is a catch basin on the south side of S.W. Lehmann with a 12 inch pipe which then runs . south to S.W. Coral and into another catch basin with a exit pipe that appears to be 18 or 24 inches in . ��'• diameter. It appears that this system may work however there may be a couple of complications: (1) The elevation may be too high; and ( . (2) • after tracing the system it appears the , 18/24 inch pipe is connected to a 12 inch , Pipe which then goes into an open ditch. �.. Location approval will be coordinated with Tualatin Valley Water lAstrict. Neighborhood Planning Organization #8 has reviewed this proposal and has offered the following comments: NPO 8 suggests that no wood stoves be permitted within this development. The NPO also voiced concerns regarding the height and size of the residential units. Tualatin Valley Water District has reviewed this proposal and has offered the following comments: The water main shown on plan is on the south side of Lehmann Street. General Telephone has reviewed this proposal and has offered the following comments: The developer should contact GTE Engineering Office for requirements. Allow 45 days lead time from completion 4 of GTE Engineering review to trench open date. The City of Tigard Building Division, Portland General Electric and Tigard-Tualatin School District 23j have reviewed this proposal and have issued no comments or objections. ° No other comments have been received. C. ANALYSIS AND CONCLUSION Section 18 .54 .050(A) (4) of the Community Development Code (CDC) allows a maximum building height of 35 feet. The submitted elevation drawings show that the apartments are planned to be approximately 24 feet in height. Therefore, thiS proposed building height is viithin guidelines of this • code requirement. Section 18.54 .050 of the R-12 zoning district regulations • requires minimum setbacks for multiple-family dwellings as follows: front yard - 20 feet, rear and setback - 20 feet, garage - 20 feet, side yard -10 feet. This side yard of rear yard setback shall be a minimum of 30 feet when this site abuts a more restrictive zoning district. This proposal complies with the 1 -12 requirements for the front yard, garage and rear yard setbacks. The r•. submitted site plan shows a side yard setback of 24 feet on • the east side. Code section 18.120. 170(A) (Exception to Standards) states that the director may grant an exception to the setback requirements based on findings that the approval will result in the following: 1) An exception which is not greater than 20 percent; 2) no adverse effect to adjoining properties in terms of light, noise levels, and fire hazard; 3) safe vehicular and, pedestrian access to the • ;1; site as well as on-site: 4) a more efficient use of the site which would result in more landscaping; and 5) the preservation of natural features which have been incorporated into the overall design of the project. With reference to the above criteria, staff finds the following: 1) The reduction of the required 30 foot side • yard setback to 24 feet is not greater than a 20 percent; 2) granting this setback reduction will not create adverse effects on adjoining properties in terms of light, noise levels, or fire hazard; 3) this exception will not compromise safe vehicular or pedestrian access either to the site or on-site; 4) this exception will produce a more efficient use of the site than the alternative of flipping the apartments to the other side of the site. Reversing the site plan would reduce the side yard setback requirement to a 10 feet for each side of the site. Therefore, the parking lot may be located 10 feet from the R-4.5 parcel to the east with the apartments being located 10 feet from the property to the west and therefore reduce the amount of on-site landscaping. Granting this exception would preserve a •. greater amount of landscaping as well as providing a greater distance between this development and the adjoining R-4.5 ` zoning district; and 5) granting this exception would help b . to preserve the two large Monkey Puzzle trees which are located between the proposed driveway access and the southern lost apartment. Therefore, Staff grants an exception to the eastern side yard setback to 24 feet whereas the code requires 30 feet. Subsequently, code section 18.54.050 is satisfied. Section 18. 106 . 030 A 4 c (Minimum off--street parking requirements - Multiple Dwelling) requires two parking spaces for each dwelling unit if there are more than two bedrooms per unit. The preliminary plans show that each unit shall contain three bedrooms pet unit. Therefore, it vehicular p dwelling units. PACE 9" • 91-0010 WATSON NOTICE o� DECISION SDR ��-•too P n, I , . t State of Oregon House Bill 2084, which became effective September 1, 1990, requires one disabled person parking spaces if 6 to 25 parking spaces, are provided. The proposed plan does not provide for the one disabled person parking ! space which is required. Therefore, a revised site plan �.--'"�� • should be submitted which addresses this requirement. Code Section 18. 106 .020 (1') requires one bicycle parking space for each 15 vehicle parking spaces in any development. Since there are 17 parking spaces to be provided on this site, two bicycle parking spaces are required. The site ; lan does not indicate the location of any bicycle parking plan on this site. Therefore, a revised site plan " " should be submitted which addresses this requirement. The site meets the minimum access standards through the provision of one 24 foot wide access driveway from SW Lehmann Street. Code Section 18 . 108.070(D) requires that a multi-family development with a parking area providing between 3 and 19 parking spaces be provided with an access drive with a minimum access width of 30 feet. The accessway I .. must be paved to a minimum width of 24 feet. The applicant is proposing a paved 24 foot wide paved accessway and therefore satisfies this access requirement. Code Section 18.108.050 requires that within all multi- ' developments, each residential dwelling units shall �, :' • be connected to the parking area by a walkway system having a minimum width of four feet and constructed of an all weather material. The proposed site plall indicates that pedestrian access to the parking area will be provided in that the front of each individual apartment opens onto the parking area. Therefore, this code requirement has been . satisfied. Code Section 10. 100 . 110 (Screening: Special Provisions) states that trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed and on the basis on one tree for each seven parking spaces in order to provide a canopy effect. There are seventeen parking spaces provided on this site, and there are seven trees indica.ted near the parking lot on the preJ.iminary site plan. Lehman which is currently under application for development into a seven unit apartment compiex.: I am concerned about the two "monkey puzzle" trees which are on the property. Shirley Cook told !1 ` me that her father, Arthur Lehr, planted the trees on his father's land in 1906 when he was six years old, Bruce McFarlan, owner, of_the property for s ome thirty years, told me that they are the second tallest such trees in Oregon and that they are a matched pair of one male and one female. I / have also been told that the,,trees are on a City of Tigard map of points of historical interest. I . I I do not know what the current owner, Mr. James Watson, intends to do with.the "monkey puzzle" trees when he constructs • g r for a parking lot for his tenants will be his building, however cut down to make I assume the worst: the trees w�.l e way parking his a. Lehmann, which is classified as a local street Currently, there is 60 feet of �right-of-way that fronts the development and local street standards require 50 feet of right-of-way. Therefore, no additional right-of-way is required. The existing street is a mixture of improvements; 1) adjacent 11 to the site and along the north side of S.W. Lehmann there is pavement, approximately 12 feet in width, with no other, improvements; 2) on the south side of S.W. In September, 1990, the Washington County electorate overwhelmingly approved expanding the TIC program throughout all jurisdictions within the county. This action placed into effect an , increased street development fee on all new development in Washington County. The City of Tigard has adopted the county's program. The City Traffic Impact Fee program will collect fees from new development based' on the development's projected impact on the transportation system. Developing'properties will be required to pay based on the number of trips , they are projected to generate. The TIF is calculated based on type of use, size of project, and a general use based fee category. The. TI.Y' shall be calculated at time of building permit issuance. In limited VI q circumstances, payment of the TIF may be allowed to be deferred until issuance of occupancy permit.. Deferral of payment until occupancy is permissible only when the TIF is greater than a,000.00. O) S9e0i110421.TEIR QUALITY FEES t d The Unified Sewerage Agency has established and the City has agreed to enforce, Resolution fl.:. 90-43, Surface Water Management Regulations, requiring the construction of on-site water quality facilities or fees in 4 lieu of their construction.' The resolution requires that a fee and/or W construction of a water quality facility be built. The fee is based on the athount of impervious surface; for every 2640 square feet or portion thereof, the fee shall be $375.00.
