Background The subject site was platted on July 9, 1908 as part of the Tigardvill.e Park Tract. This parcel was 'included within the original City of Tigard boundary when the City incorporated on September 11, 1961. No other land use or development applications for this parcel have been reviewed by the City of Tigard.. 2 Vicinity Information The subject parcel is bordered on the northwest and southeast sides by properties which are also zoned Commercial Professional (C-P); the property to the northwest has been developed as a dental office. An additional garage and carport are located along the site's SW Lincoln Avenue frontage. This garage and carport serves the southern residence. An access easement is located along the duration of the, east property line (15 by 180 feet) to allow the parcel to the east (tax lot 400) vehicular access, to the rear portion of the property. This easement has been, developed with pavement and a small retaining wall. There are also a few mature trees located on the site. The applicant requests Site Development Review approval to allow the conversion of an approximately 1,326 square foot residential structure to an office facility with related site improvements. This development is proposed to provide parking located along the northeast frontage of the site. A bicycle parking rack will be located near the northeastern corner of the building, 4. Agency and NPO Comments The Engineering Division has reviewed the request and provides the following comments: 1. Install half-street improvements along frontage of SW Lincoln Avenue. Plans to be approved prior to any work within the right-of-way. A street opening permit is required. 2. Improvements along SW Greenburg Road are currently being installed. All other utilities, are available to the site. The Tualatin Valley Fire and Rescue District, City of Tigard Building Division, City of Tigard Field Operations Division, Tigard Water District, Portland General Electric have reviewed the proposal and have issued no comments or objections. No other comments have been received. C. ANALYSIS AND CONCLUSION General Office and Medical/Dental Use are both listed as permitted uses in the C-P (Commercial Proi,sional) zoning district. Single family residential utle is not listed as either a permitted or conditional use in the C-P one Section 18.132 states that legally nonconforming uses may be allowed to continue so long as this nonconforming use is not increased, enlarged or extended. The effect of this NOTICE OF DECISION - SDR 91-0009 - WEBER PAGE 3 e.', • , • ,..N, application is that the nonconforming use of this property is being reduced, by the conversion of one of the existing residences to a permitted C-P use Code Section 18.64.050(A) ( 4) of the Community Development Code (CDC) allows ,a maximum building height of 45 feet. The applicant has stated that no additions are planned for the office conversion. The only modifications are interior modifications. Therefore, the conversion of the single - story residential building is within this code requirement The C-P zoning district does not require minimum setbacks from any property lines (Section 18.64.050(A)(3). Therefore, no setback requirements apply to this site. The applicant has stated that the northernmost residence will be converted into a general office use or medical /dental use As listed in Section :18.106.030(C) (Minimum off - street parking requirements) , Administrative and Professional Services and. ;Medical /Dental Services specify different requirements for the provision of adequate parking. In determining ng the total number of on -site parking spaces which shall be required, the more stringent parking requirement shall be used This shall provide adequate parking for the more intensive use on the site The Community Development Code recognizes the more intensive use as being the Medical and Dental Services. This requires one parking space for every 200 square feet of gross floor area The size of the building's which is being remodeled is approximately 1,326 square feet. Therefore, it is required that a minimum of 7 vehicular arkin spaces p g ac � e ' be provided. The site plan provides for five (5) parking spaces. Therefore the preliminary site plan does not meet the number of parking spaces required to satisfy the Code requirements for Medical and Dental uses, Code Section 18.106.020(F) states: Owners of two or more uses, structures, or parcels of land may agree to utilize jointly the same parking and loading spaces when the hours of operation do not overlap; 2. If a joint use arrangement is subsequently terminated, . .. the requirements of this title thereafter apply, to each Separately . , • f Additionally, Code Section 18.106.020(H) (2) states that off- street parking spaces for non-residential uses shall be located not further than 200 feet from the building or use they are required to serve, measured in a straight line from the building. Therefore, if the applicant can meet these conditions as' stated above, then shared parking with another property may be approved as a portion of the minimum parking requirements. However, if the applicant does not or cannot meet these conditions then those spaces provided by a shared parking arrangement shall not be counted as 'a portion of the minimum parking requirements. State of Oregon House Bill 2084, which became effective September 3, 1990, requires one disabled person parking spaces if 6 to 25 parking spaces are provided. The proposed plan provides for the one disabled person parking space which is required. The site plan notes that bicycle parking will be provided on the northeast corner of the building which is to be converted. Space for one bicycle will be provided. Code Section 18.106 (P) requires one bicycle parking space for each 15 required vehicle parking spaces. Therefore, this code standard is satisfied. The site meets the minimum access standards through the Provision of one 30 foot wide access driveway from SW Greenburg Road, Code Section 18.108.080(A) requires that industrial use parking areas with less than 100 parking spaces be provided with one access drive with a minimum access width of 30 feet. The accessway must be paved to a minimum width of 24 feet. The applicant is proposing a paved 24 foot wide paved accessway and therefore satisfies this access requirement. Code Section 18.108.050 requires that a walkway extend from the ground floor entrances or from the ground floor landing of stairs of all commercial and industrial uses, to the streets which provide the regv.4.red access and egress, Tho proposed site plan indicates that a walkway will be provided. It is proposed that this walkway be constructed of spaced stepping stones or pavers so as to provide additional landscaping between the on-site parking area and the paved accessway located on the property to the east. Therefore, this code requirement has been satisfied. Code Section 18,100.110 (Screening: Special Proviion) states that trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed and on the basis on one tree for each Seven parking spaces in order PME 5 NOTICE OF DECISION - SDR. 91-0009 - WEUR to provide a, canopy effect. Since there are only seven parking spaces required on this site, and there are two trees indicated near the parking lot on the preliminary site plan, this code requirement has been surpassed. Developments within the C -P zoning district are required to provide a minimum of 15% .landscaping on the site. This site is being only partially redeveloped with a permitted C-P use with the remainder of the property retaining the current residential use. Therefore, only . that portion of the site shall be subject to this requirement. , Of the approximately 5,715 square foot portion of the site which is being redeveloped,' the applicant has proposed to landscape 2,054 square feet. This :surpasses the minimum landscaping requirement by providing approximately 35.9 percent landscaping coverage whereas the Code requires only 857 square feet of landscaping for the redeveloped portion of this site. Section 18.102 (Visual Clearance Areas) requires that a clear vision area shall be maintained' on the corners of all property adjacent to intersecting right-of-ways or the intersection of a public street and a private driveway. ° A clear, vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding 3 feet in height, except that obstructions, which may be located in this area shall be visually clear between 3 and 8 feet in height (trees may be placed within this area provided all branches below 8 feet are removed) Visual clearance area shall be that triangular' area formed by measuring a 30 toot distance along each of the right -of -way' or property lines and then connecting these two 30 fort distance points with a straight line. The proposed development conforms with all visual clearance requirements of this code section. Chapter 18.15,0 requires a permit and contains standards, for removal of trees having a trunk 6 inches or more in diameter four feet above the ground on undeveloped land'. A permit for tree removal must comply with the 'fallowing criteria: a. The trees are diseased, present a danger to property, or interfere' with utility service or traffic safety; b . The trees are not needed to protect nearby trees as windbreaks or as a desirable balance between shade and open space; The aesthetic, character, in the area will not be visually adversely affected by the tree removal; and f. New vegetation planted by the applicant, if any, will replace the aesthetic value of trees to be cut. The preliminary site plan shows that the proposed development's private access will require the removal of one tree. No tree removal shall be 'allowed to occur prior to Planning Division staff review and approval of a tree removal permit.
