A Minor Land Partition request which was approved by the City in April of 1993. 2. Vicinity Information: The subject site is located east of SW North Dakota Street, and south of SW Scholls Ferry Road. Properties to the east and north are zoned C-G, and C-G (PD) (General Commercial, Planned Development). The property to the west is zoned C-P (Professional Commercial). The property to the south is zoned R-25 (Residential, 25 units per acre) and is substantially developed. 3. Site information and Proposal Description: The subject parcel is approximately 0.37 acres in size. Access to the site will be gained from SW North Dakota Street. The proposed site plan and the applicant statement indicates that a secondary access will be gained from SW Scholls Ferry Road. The applicant proposes to construct a 1,176 square foot oil change and lubrication facility with related site improvements. 4. Other Staff Comments: The City of Tigard Water Department has reviewed this proposal and has offered the following comments: The plans submitted does not show the location for fire 3e:vice or domestic water service. All portions of the proposed building must be within 250 feet of a fire hydrant, minimum line size of six (6) inches. Review of a water facility plan, with fire hydrant placement, will be coordinated with the Tualatin Valley Fire & Rescue and the Tigard Water Department. The City of Tigard's Public Works Division, Tigard Police Department and the Tigard Building Division have reviewed this application and have offered no comments or objections. Agency Comments: The Tualatin Valley Fire & Rescue #1 has reviewed this proposal and has offered the following comments: Fire hydrants are required within 250 feet of all portions of the structure measured around the outside and along access roadway. Portland General Electric and General Telephone & Electronics have reviewed this application and have offered no comments or objections. SECTION III. ANALYSIS AND CONCLUSION A. COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Use Classification. The proposed new use of this site is for an Automotive and Equipment: (Repairs, Light Equipment) . Code Section 18.062.030 allows Automotive and Equipment as a permitted use in the General Commercial zone. Minimum Lot Area. Section 18.062.050 states that there is no minimum lot area for parcels in the C-G zoning district, The average minimum lot width is 50 feet. This site is approximately 16,117 square feet in size with an average minimum lot width of approximately 156 feet. Developments within the C -G zoning district are required to provide a minimum of 15% landscaping on the site Of the approximately 16,117 square foot site, the applicant has proposed to retain approximately 14,941 square feet of existing land for landscaping and other improvements. Applicant has proposed to devote approximately 3,672 square feet (22.54) for landscaping. The proposed landscape plan will surpass the minimum landscape requirement. Therefore this code requirement has been satisfied. Setbacks. Section 18.062.050 requires specific setbacks for developed sites in the C-G one which abut residential zoning districts. Properties to the north and east of the site are zoned C-G, and C -G (PD) (General Commercial, Planned Development) . The Property to the west is zoned C-P (Professional Commercial) , and property to the south is zoned R -25 (Residential, 25 units per acre) . Therefore, no building setbacks are required for the north, east and west of the site. The setback requirement for the southerly portion of the site which abuts the multi- family zoning NOTICE OF DECISION SDR 03.0024 OIL CAN HENRY'S PAGE 4 :p • district, shall be a minimum of twenty (20) feet, This requirement is satisfied. The preliminary site plan indicates a ninety (90) foot building setback from the south property line. This code section is satisfied. Minimum Off-Street Parking. Section 18.106.030(C)(1) requires one (1) parking space for each 500 square feet of gross floor area, but not less than three (3) spaces for each establishment. The proposed oil change and lubrication facility is approximately 1,176 square feet. The site plan and the applicant statement indicates that five (5) parking spaces will be provided. A total of three (3) parking spaces are required for this development. Therefore, this code requirement has been satisfied. The Americans with Disabilities Act ADA . Became effective on January 26, 1992. It requires one disabled person parking space if one (1) to twenty -five (25) parking spaces ce provided. The proposed site plan shows provision for one (1) disabled person parking space. Therefore, this code requirement has been satisfied. Drivew.u,. The applicant statement and the preliminary site plan indicates that two common 30 foot driveways provide access to SW North Dakota Street, and SW Scholis ferry Road. This satisfies Code Section 18 ►108.080 which states that commercial development with 99 or less required parking spaces provide a minimum access width of 30 feet and a minimum pavement width of 24 feet. Bicycle Parking. Code Section 18.106.020 (P) require. one (1) bicycle parking rack space for each fifteen (15) vehicle parking spaces in any development, Since five (5) parking spaces are to be provided on this site, one (1) bicycle parking rack space is required for this development. The site plan shall be revised to show a minimum of one (1) bicycle parking rack space. Walkwa . Code Section 18. 108.050 (A) requires that a walkway shall extend from the main ground floor entrance of all commercial developments to the street which provides the required access and egress, The preliminary site plan shows no indication of the provision of such a pedestrian access. Therefore, a revised site plan shall be submitted to the Planning Division that shows provision of one (1) pedestrian walkway leading from SW Forth Dakota street to the main entrance of the building. NOTICE UP DECISION SDR 93 -0024 - OIL CAN HENRY'S PAGE 5 • , • • Visual Clearance Areas: Section 18.102 requires that a clear vision area shall be maintained on the corners of all property adjacent to intersecting right-of-ways or the intersection of a public street and a private driveway. A clee.r vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding three feet in height. The code provides that obstructions which may be located in this area shall be visually clear between three and eight feet in height (trees may be placed within this area provided all branches below eight: feet are removed). A visual clearance area is the triangular area formed by measuring a 30 foot distance along the street right-of-w.y. and the driveway and then connecting these two 30 foot distance points with a straight line. A revised site and landscape plan shall be submitted which shows compliance with this requirement. Street Trees. Section 18.100.030 states that all development projects fronting on a public street more than 100 feet in length shall be required to plant street trees in accordance with the standards in Section 18.100.035. This site abuts a vacant parcel on the west which fronts on SW North Dakota Street. Since the subject site does not have direct fronuage on SW North Dakota Street, street trees are not required for this development. Landlgtpipq Plan. Section 18.100.015 (C) requires that the applicant submit a landscaping plan. The applicant has indicated on the preliminary landscaping plan the proposed location of assorted trees along the westerly and boutherly boundaries of the site. Also shown are some mugo pine, arbo:rvitae, rhododendrons, viburnum davidi, sweetgu:m and a variety of other plants located around the site. This reqirement is satisfied. Screminal111LILLL Provisions: Section 18.100.110(A) states that trees shall be planted in landscaped islands in all parking areas and shall be equally distributed and on the basis of one tree for each seven parking spaces in order to provide a canopy effect. The minimum dimension of the landscape islands shall be three feet and the landscaping shall be protected from vehicular damage by some form of wheel guard or curb. The proposed site plan shows provision of one parking lot tree. In addition, since the subject site abuts a residential zoning district to the south, a twenty (20) foot wide landscape buffer is required along the southerly portior of the site. Buffer areas must be occupied by a mixture of deciduous and evergreen trees and shrub and must also achieve a balance between vertical and horizontal plantings. This code requirement has been satisfied. Signs. Section 18.114.130 (D) lists the type of allowable signs and sign area permitted in the C-G zone. All signs shall conform to the provisions listed in this code section. All signs shall be approved through the Sign Permit process as administered by the Planning Division and shall comply with vision clearance requirements. Tree Removal. Chapter 18.150 contains standards for obtaining a required permit for removal of trees having a trunk 6 inches or more in diameter when measured four feet above the ground. Applicant will be required to obtain a tree removal permit if trees are to be removed on this site. Mixed Solid Waste and Rec clables Store: Section 18.116 requires that new construction incorporate functional and adequate space for on-site storage and efficient collection of mixed solid waste and source separated recyclables prior to pick-up and removal by haulers. The applicant shall choose one of the following four methods to demonstrate compliance: Minimum standard, Waste assessment, Comprehensive recycling plan, or Franchised hauler review and sign-off. The applicant; will need to submit evidence or a plan which indicates compliance with this section. B. PUBLIC FACILITY CONCERNS: Sections 18.164.030 (F a) (Streets) , 18.164.090 (Sanitary Sewer), and 18.164.100 (Storm Drains) shall be satisfied as specified below: 1. STREETS: The site will take access from a private driveway in a 30 foot easement that interconnects between SW North Dakota and. SW Scholls Ferry Road. Both public streets are fully improved. SANITARY SEWER: The site currently has a 8 inch public sanitary sewer line located within the private easement. The line has the capacity for this development and no additioral public improvements are required. 3. After reviewing the size of the site and the available portion of land to construct a water quality facility it does not appear feasible to do on this site. This site is less than one -half of an acre. In addition, the ditch provides a very low level of phosphorous removal. The methods outlined in the water qualicy manual do not have any treatment options that will adequately remove phosphorous.
