BUFFERING AND SCREENING
In order to increase privacy and to either reduce or eliminate adverse
- noise. ,)r visual impacts between adjacent developments, especially between
different land uses, the City requires landscaped buffer areas along
certain site perimeters. Required buffer areas are described by the Code
in terms of width. Buffer areas must be occupied by a mixture of
deciduous and evergreen trees and shrubs and must also achieve a balance
between vertical and horizontal plantings. Site obscuring screens or
fences may also be required; these are often advisable even if not
required by the Code. The required buffer areas may one be occupied by
• vegetation, fences, utilities, and walkways.

Street trees are required for all developments fronting on a public or

measured four feet above grade. Street trees should be spaced 20 to 40

STORMWATER QUALITY FEES
The Unified Sewerage Agency has established, and the City has agreed to •
enforce, Resolution No 90-43 Surface Water Management Regulations which
requires the construction of on-sate water quality facilities. At the

discretion of the City, the applicant may be offered an opportunity to pay
• '; a fee in lieu of the construction of such a facility. The resolution
requires the construction of a water quality facility and/or the payment
of a fee. The fee Shall be based upon the amount of impervious surfaces
for every 2,640 Square feet, or portion thereof, the fee shall be $285.00.
The City of Tigard shall determine if a fee may be paid or a facility
shall be constructed.

TRAFFIC IMPACT FEES
In x,990, Washington County adopted a county-wide Traffic Impact Fee ('CIF)
ordinance. The Traffic Impact Fee program collects fees frost new
development based on the development's projected impact upon the City's
transportation system. The applicant shall be required to pay a fee based
upon the number of trips which are projected to result from the proposed •
development. The calculation of the IF is based on the proposed use of
the land, the size of the project, and a general use based fee category.
The TIP' shall be calculated at the time of buildings ' ermit issuance. In
,• ' limited circumstances, payment of the TIP may be allowed to be deferred•
until the issuance of an occupancy permit. Deferral of the payment until
occupancy is permissible only when the TIP' is greater than $5,000.00.

APPLICATION: A request for Site Development Review approval to allow
construction of a new 6,080 square foot concrete tilt-up warehouse building.
Zoning: I-L (Light Industrial) Location: 14865 SW 72nd Avenue (WCTM 2S1
12AC, tax lot 2100)
SECTION I -- DECISION: Notice is hereby given that the Planning Director's ,.
:i designee for the City of Tigard has APPROVED the above request subject to certain
conditions. The findings and conclusions on which the decision is based are
noted in Section II.
• THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED PRIOR TO THE
�. ISSUANCE OF BUILDING PERMITS. UNLESS OTHERWISE NOTED, THE STAFF CONTACT SHALL
BE GREG BERRY OF THE ENGINEERING DEPARTMENT,
1. Additional right-of-way shall be dedicated to the public along the SW
72nd Avenue frontage to increase the right-of-way to 30 feet from the
centerline.
2. Place utilities underground along the frontage of SW 72nd Avenue or pay
a fee in-lieu of undergrounding.
3. Install a six foot wide sidewalk along the frontage of the site on SW
72nd Avenue.
4. Cr.Instruction of the proposed public improvements and issuance of
Building Permits shall not commence until after the Engineering
Department has reviewed and approved the public improvement plans, a
street opening permit or construction compliance agreements has been
executed, and payment of all permit fees.
5. The applicant shall be required to pay the fees as established under the
guidelines of Unified Sewerage Agency Resolution and Order No. 91-47.
NOTE: This is a two part fee which may be paid at different times. The
first portion is paid with the public improvements which is for that
portion of the development which increase the impervious area within the
public right-of-way. The second portion is paid at Building Permit
issuance and is for that portion of the development which increase the
impervious area on-site.
6. A revised site plan shall be submitted which provides for a consistent
r•. .: 24 foot wide paved driveway and a walkway extending from the ground
floor entrance of the structure to SW 72nd Avenue. In addition, the
plan shall identify the location of the two (2) bicycle racks. ,' aff

7. One (1) of the proposed parking lot trees will be required within a
landscaped island within the parking area and shahs, be equally
distributed and on the basis of one tree for each seven parking spaces
in order to provide a canopy effect. The minimum dimension Of the
landscape islands shall be three (3) feet and the landscaping shall be
protected from vehicular damage by some from of wheel guard or curb. A
revised site plan shall be submitted Showing the location of this

8. A revised landscape plan and site coverage calculation shall be
submitted demonstrating that the minimum landscape requirement will be
satisfied. In addition, the plan shall show that the hedge along the
north property line be trimmed to a height of three (3) feet within the

• w 9. A tree removal permit will be required for the removal of the ash and
birch tree currently on the property. Screening shall be provided for
the maple tree from any potential damage from the demolition of the

SECTION II: FINDINGS OF FACT
1. Backround:
The subject site was previously developed with a single family residence
and a building used as a cabinet shop. No subsequent land use
applications have been filed with the City for this site.

2. Vicinity Information:
The subject parcel is located on the west side of SW 72nd Avenue, north
• of SW Cardinal Lane and south of SW Bonita Road. Properties to the
north, west and south are 7•,7ned I-L (Light Industrial) and are developed
with office and industrial uses. The properties to the east are zoned
I-P (Industrial Park) and are developed with office buildings.
3. Site Information and Proposal Description:
The subject parcel is approximately .97 acres in size and is presently
developed with a 14,112 square foot metal building and a single family
home, Access to the site is from a 25 foot access to SW 72nd Avenue.
An ash, maple and birch tree surround the existing home and there is an
existing hedge on the north property line.
The applicant proposes to demolish the single-family home and construct
a new 6,080 square foot concrete tilt-up warehouse building, as
Q, illustrated on the attached site plan. The site would include 22
parking spaces with one designated handicapped space and two bicycle
racks.

5. Agency Comments
The Tigard Water f istrict has reviewed this proposal and has offered the
following comments:

The developer will be responsible, to the Water Agency, for all
; costs associated with relocation of any Agency facilities.
Example: existing water meter and service will need to be
relocated from the driveway to a planter area. Water meters are
not allowed to be located within paved areas.
The Tua.Latin Valley Fire District has reviewed this proposal and has ..
offered the following comments:
Fire hydrants will be required within 250 feet of all portions of
the building. The applicant will be required to show hydrant
location on Building Permit Plans for review and approval. If the
required fire flow exceeds 3,000 GPM or the available in the area,
the building may be required to be equiped with automatic
sprinkler protection.
' City of Tigard Building Division, Portland General Electric, and Unified
Sewerage Agency have reviewed this application and have offered no
' .s comments or objections. No other comments have been recieved.
, y SECTION III. ANALYSIS AND CONCLUSION
A. COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS:
Use Classification: The applicant has indicated that the proposed
building is intended to be used as a mechanical parts - distribution warehouse. This use is classified in Code Section 18.42 (Use
Classifications) as Wholesale, Storage and Distribution. Code Section
18.70.030 allows Wholesale, Storage and Distribution as a permitted use
in the I-L zoning district.
Minimum Lot Area: Section 18.70.050 states that there is no minimum lot
.,,:� ; area for parcels in the I-L zoning district. The average minimum lot
width is 50 feet. The site has an average minimum lot width of
approximately 100 feet. Developments within the I-L zone are required
to provide a minimum of 15% landscaping for the site. The applicant has
4 proposed to devote approximately 6,040 square feet (15.23%) for
landscaping. It should be noted that the applicants calculations may
not include the vacant area behind the existing building which could be
landscaped. In addition, a walkway is required from the entrance of the
proposed building to connect with SW 72nd Avenue, the location of which
will likely reduce the amount of proposed landscaped area. Therefore,
a revised landscape plan and site coverage calculation shall be
submitted demonstrating that this requirement will be satisfied.
Setbacks Section 18.70.050 states that no side or rear yard setback
shall be required where the I-L zone abuts a residential zoning
district. This parcel does not abut a residential district and
therefore there are no applicable side or rear yard setbacks. As
indicated on the site plan, the front yard setback requirement of 30
feet is satisfied. In addition, the proposed building height is 22
`' feet, well under the maximum 45 feet allowed.
Minimum off-Street Parking: Section 18.106.030(D) (2), requires a minimum
of one parking space for every 1,000 square feet of gross floor area
plus one space per 700 square feet of patron serving area, but not less
than ten spaces for each establishment. The proposed building is
approximately 6,080 square feet, including 1,280 square feet of patron
serving area, Therefore, required-.�

statement indicates that 22 spaces will be provided, thereby satisfying

for removal of trees having a trunk six (6) inches or more in diameter

Landscapi ng Plan: Section 18✓100.015 requires that the applicant submit
a landscaping plan. This requirement has been satisfied as the applicant
has submitted a plan indicating the number, type and location of trees
and shrubs.
.. Slam: Section 18.114211QLEI lists the type of allowable signs and sign
area permitted in the 1-L zone. All signs shall conform to the
,. •. provisions listed in this code section. All signs shall be approved
through the Sign Permit process as administered by the Planning

' Screening: Special Provisions: Section 18.100.110(ALstates that trees ' ' ,
shall be planted in landscaped islands in all parking areas and shall
be equally distributed and on the basis of one tree for each seven
parking spaces in order to provide a canopy effect. The minimum
. , dimension of the landscape islands shall be three (3) feet and the
landscaping shall be protected from vehicular damage by some form of
wheel guard or curb. Three (3) trees are required for this site under
the provision of this code section. The proposed site plan indicates
the provision of five (5) trees located on the boundaries of the parking
lot. This site plan shall be revised to indicate the provision of one
(1) parking lot tree and landscape island to be located along the
parking area adjacent to the new building in accordance with the
provisions of this section.
B. PUBLIC FACILITY CONCERNS:
Sections 18.164,4.029.01/11/A1 (Streets), 18.164.090, (Sanitary Sewer), and
18.164.100 (Storm Drains) shall be satisfied as specified below:

The site is located along SW 72nd Avenue, a major collector south of
Bonita Street. The frontage is improved with a fully paved width, curb
and driveway apron. Adjacent parcels have been improved with sidewalks
and overhead utilities remain.
Additional right-of-way along the frontage is required to provide for
the required 60 foot right-of-way.
The applicant proposes to continue to use the existing 25 foot wide
driveway along the northern property line.

Accordingly, the applicant should install a sidewalk, dedicate
additional right-of-way to increase the width from centerline to 30
feet, and pay a fee in=-lies., of undergrounding utilities along the SW
72nd Avenue frontage.

Storm drainage is provided by an existing eight (8) inch line that
drains west to the railroad right-of-way and continues to a creek.
The Unified Sewerage Agency has established and the City has agreed to
enforce (Resolution and Order No 91-47) Surface Water Management ti
Regulations requiring the construction of on-site water quality
' h facilities or fees in-lieu of their construction. Section 7.1Ob of R&O
No. 91-47 permits acceptance of a fee in-lieu of improvements if "The
site is small compared to the development plan, and the lose of area for
the on-site facility would preclude the effective development, The
newly constructed impervious surface is limited to the area surrounding
the existing house. Moreover, this sate is less than one acre and the
remaining portion of the site is occupied by existing paving and an
■ existing building. Therefore, an on-site facility does not appear to
be feasible and the applicant should be permitter) to pay a fee in-lieu
of constructing a water quality facility.

1. Owner shall dedicate additional right-of-way as required (for -

2. A fee of 27. 50 per frontage ft. in lieu of burying utilities
