TRAFFIC IMPACT FEES
In 1990, Washington County adopted a county-wide Traffic Impact Fee (TIF)
• ordinance This action placed into effect an increased street development
fee on all new development in Washington County. The City of Tigard has
— adopted the county's program. , .

The City Traffic Impact Fee program will collect fees from new development
,
' based on the development's projected impact on the transportation system.
Developing properties will be required to pay based on the number of trips
they are projected to generate. The TIF is calculated based on type of
used size of project, and a general use based fee category. The TIF shall

be calculated at time of building permit issuance. In limited
. circumstances, payment of the TIF may be allowed to be deferred until
issuance of occupancy permit. Deferral of payment until occupancy is
permissible only when the TIF is greater than $5,000.00.

The Unified Sewerage Agency has established and the City has agreed to
enforce, ResolutioA No. 90-43, Surface Water Management Regulations,
requiring the construction of on-site water quality facilities or fees in

, construction of a water quality facility be built. The fee is based on

Applications must be accepted by a Planning Division staff member at the
. Community Development Department counter at City Hall. Applications
submitted by mail or dropped off at the counter without Planning Division
acceptance may be returned. Applications submitted after 4 PM on Thursday
will be batched for processing with the following week's applications for •
processing. No applications will be accepted after 4:30 PM. /

Maps submitted with an application shall be folded in advance to 8.5 by 11
inches. One 8.5 inch by 11 inch map of a proposed project should be
submitted for attachment to the staff report or administrative decision.
The Planning Division and Engineering Division will do a preliminary
review of the application and will determine whether an application is
complete within 10 days of submittal. Staff will notify an applicant if
additional information or copies of the submitted materials are needed.

The administrative decision/public hearing typically will occur
approximatelydays after an application is accepted as complete by
the Planning Division. Applications involving difficult issues or
requiring review by other jurisdictions may take additional time to
review. Written decisions are issued within 10 days of public hearings.
A 10 day appeal period follows all decisions. An appeal on this matter

This letter is to confirm the status of the Site Development approval at

. 7086 SW Beveland Street, The property received approval with
conditions, to change from a residence to a commercial establishment in
1992 (SDR 92-0023). Generally, with a Site Development approval, there
are conditions required in order to receive final site plan approval and

obtain building permits. Prior to occupancy, all improvements must be
completed in accordance with the Final Site Plan. In this case, because
the proposal involved a change in use, it is likely that the site was not
inspected to insure that all improvements were installed as required.
Based on a recent visit to the site with Janet Shim, it appears all required
improvements have been completed with the exception of the installation
of 3 street trees. In order for the site to be in compliance with the SDR
approval, these trees must be installed.
With the installation of the 3 trees, the planning conditions will be satisfied,

SECTION I - DECISION: Notice is hereby given that the Planning
Director's designee for the City of Tigard has APPROVED the above
request subject to certain conditions. The findings and
conclusions on which the deciston is based are noted in Section II.
THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO THE ISSUANCE
OF BUILDING PERMITS. UNLESS OTHERWISE NOTED, THE STAFF CONTACT
SHALL BE CHRIS DAVIES OF THE ENGINEERING DEPARTMENT.
1. The applicant shall submit a revised site plan which
demonstrates the provision of the following: a walkway from
the front entrance of the facility to SW Beveland Street,
three additional street trees, and one bicycle rack space.

2. An agreement shall be executed by the landowner, on forms
provided by the City, which waives the property owner's
right to oppose or remonstrate against a future Local

work in the public right-of-way or public easements.
4. The applicant shall provide evidence to the Engineering
Department that the existing septic system meets the
requirements of the Washington County Health Department.

applicant shall apply for and receive approval for sign

The City of Tigard Building Division has reviewed this
proposal and has offered the following comments:

standards set forth for a commercial building. These
. standards shall include (but not limited to: ) stairs
and landings, ramps/ exits, setbacks from property ,
lines, bathroom facilities, fire extiguishers, glazing
subject to human impact, disabled persons parking
stalls, and structurally able to support the design
loads for an office use.
o A building permit will be required for any changes made
to the existing structure.
o Four (4) sets of scaled plans shall be submitted to the
building division for review, that includes: A floor
plan which identifies the proposed use of each room;
locations and size of doors and windows; Any walls,
doors, or windows to be added or deleted; A plan that
shows the size, spacing and location of supporting
floor joists, beams, and footings; A site plan
indicating the location of the building from all

building will be required to conform to the American
Disability Act requirements for accessibility.

SECTION III. ANALYSIS AND CONCLUSION
A. COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS:
The applicant has indicated that the proposed new use of
this site is as a professional office. This use is
classified in Code Section 18.42 (Use Classifications) as •
business equipment sales and se.rvices. Code Section
18.64.030 allows business equipment sales and services as a
permitted use in the Commercial Professional zone.
Section 18.064 .050 states that the minimum lot area for a
parcel in the C-P zone shall be 6,000 square feet and that
the average minimum lot width shall be 50 feet. This site
is approximately 27,200 square feet in size with an average
minimum lot width of approximately 170 feet. Developments
within the C-P zoning district are required to provide a
minimum of 15% landscaping on the site. Of the
approximately 27,200 square foot site, the applicant has
proposed to retain approximately 23,652 square feet of
existing land for landscaping and other related
developments. Proposed landscape plan will surpass the
minimum landscaping requirement and this code requirement is
therefore satisfied.
Section 18.64.050 requires specific setbacks for developed
sites in the C-P zone which abut residential zoning
districts. Since this parcel is surrounded on all sides by
other properties which are also zoned C-P, no building
setbacks are required.

Requirements - Business Equipment Sales and Services)
requires one parking space for each 350 square feet of gross
floor area. The office building is approximately 2,288
square feet in size. An of fide building of this size
requires the provision of a minimum of seven parking spaces.
The site plan indicates that seven parking spaces will be
provided. Therefore, the preliminary site plan meets the
number of parking spaces required and therefore satisfies
this Code requirement.
The Americans with Disabilities Act (ADA) , which became
effective on January 26, 1992, requires one disabled person •

parking space if 1 to 25 parking spaces are provided. The
proposed plan provides for one such space for disabled
person parking. Therefore, this code requirement has been
satisfied.
The preliminary site plan indicates that one driveway near
the northeast portion of the building is to provide access
to seven parking spaces. Therefore, the requirements for
Code Section 18.080 minimum access for commercial use has
been satisfied.
Code Section L.8m) ,2421 requires one bicycle parking
space for each 15 vehicle parking spaces in any development.
, Since there are only seven parking spaces to be provided on
this site one bicycle parking space is required for this •
development. Therefore, the site plan shall be revised to
show a minimum of one bicycle parking space.
As per Section 18O8 oul the accessway is shown on the
•
preliminary site plan to provide the required 24 foot
pavement width for a two-way commercial accessway.

Code Section 1[1. 10.11,15O/A1 requires that a walkway shall
extend from the main ground flcer entrance of all commercial
developments to the street which provides the required
access and egress. The proposed site plan does not indicate
the provision of such a pedestrian access. Therefore, this
code requirement has not been satisfied.
Section 18. 100 .030 (Street Trees) states that all
development projects fronting on a public street more than
100 feet in length shall be required to plant street trees
in accordance with the standards in Section 18.100.035.
11 This site fronts on SW Beveland Street for approximately 160
feet. Therefore, street trees are required.
Section 18. 100.035 requires that street trees be spaced
• between 20 and 40 feet apart depending on the size
classification of the tree at maturity (small, medium or
large) . The preliminary site plan indicates the existence
of one street tree already present on the site. Applicant
shall be required to plant three additional street trees to
satisfy this requirement.
Section 18. 102 (Visual Clearance Areas) requires that a
• clear vision area shall be maintained on the corners of all
property adjacent to intersecting right-of-ways or the
intersection of a public street and a private driveway. A
clear vision area shall contain no vehicle, hedge, planting,
fence, wall structure, or temporary or permanent obstruction
(except for an occational utility pole or tree) , exceeding

three feet in height, measured fron the top of the curb, or
where no curb exists, from the street center line grade.
Trees exceeding this height may be located in the clear
vision area, provided all branches below eight feet are
removed. No plantings or structures which obstruct vision
are located within the clear vision area.
Chapter 18. 150 contains standards for obtaining a required
permit for removal of trees having a trunk six inches or
more in diameter when measured four feet above the ground.
The preliminary site plan does not indicate a need to remove
any trees. If it becomes necessary to remove any trees,
please note that no tree removal shall take place prior to
issuance of a Tree Removal permit.
Section 18,100,11151a requires that the applicant submit a
landscaping plan. The applicant has indicated on the site
plan the proposed location of four additional trees located
•
' in the rear of the building. Also shown are lawns along the
northern property line.
Section 18. 114. 130(P) (Signs) list the type of allowable
signs and sign area permitted in the C-P zone. All signs
shall conform to the provisions listed in this code section.
All signs shall be approved through the Sign Permit process
as administered by the Planning Division and shall comply
with vision clearance requirements.
B. PUBLIC FACILITY CONCERNS:
Sections 18. 164 .030,aWa4,a.). (Streets) , 18. 164.090 (Sanitary
Sewer) , and 18. 164. 100 (Storm Drains) shall be satisfied as
specified below:
1. STREETS:
Access to the site is provided from SW Beveland, a
local street. Currently. SW Beveland Street has minimum
improvements. There is approximately 20 - 24 feet of
pavement (full width) , open ditches for drainage, and
no curb or sidewalk, The existing right-of-way is 25
feet from centerline, Typically, street improvements
are required as development occurs, as would be the
case in this application.
• The site is located in the Tigard "Triangle" which is
currently under review by the Planning Department. The
major emphasis of the review is to determine what the future
I/ zoning of the area should be to best meet the needs of the
City and the citizens. While this area is under review it

is our opinion that the street improvements should be
delayed for the following reasons:
1. Plans are still in the process of being developed
for the Tigard Triangle. As a result, the nature
and extent of future development in this area is
unknown. Subsequently, this portion of SW
Beveland Street is still in question.
2. Since plans have not been completed for the
Triangle, no capital improvement plans have been
established.
3. Half-street improvement requirements for the
frontage of this site do not provide a
significant improvement to street safety or
capacity.
Therefore, the applicant should be required to sign a non- 1 ..'
remonstrance agreement. :.,h
, 2. SANITARY SEWER: I
The existing single family home is currently on a septic
system. The nearest public sanitary sewer line is located
within SW 72nd Avenue, which is over 300 feet from the site.
It is the City's policy that a septic system is an
acceptable alternative if a single family home, or its _ ,
equivalent in use, is over 300 feet from a public line.
The applicant will be required to provide evidence from the
Washington County Health Department that the existing system
is capable of meeting the demands of the proposed
development.

3. STOR1t SEWER:
The site slopes towards the southeast. There is an open
ditch along the frontage of the site which carries the storm
water from the street. The applicant is not proposing any f
improvements which will increase the storm water run-off.
Therefore, no additional improvements are required.

forth for a commercial building. These standards shall include (but
not be limited to) : stairs and landings, ramps, exits, set-backs
from property lines, bathroom facilities, fire extinguishers,
glazing subject to human impact, disabled persons parking stalls,
structurally being able to support the design loads for an office
use.
o A building permit will be required for any changes made to the
existing structure.

division for review, that include: A floor plan which identifies
the proposed use of each room; locations and size of doors and

within the C-P zoning district are required to provide a

satisfied.
The preliminary site plan indicates that one driveway near
the northeast port.ion of the building is to provide access
to seven parking spaces. Ther$fore, the requirements for
Cod� Secti�n 18.0$0 minx.mum access for commercial use has
been satisfied.
Cod� Section �. 1�6•020 (p�, requiras one bicycle parking
space for sach 15 vehicle parking spaces in any develnpnaent.
Since thexe are only seven parking spaces to be pravided on
th�.s site, one bicycle parking sgace is require� far this
development. Therefore, the site plan shall be revi�ed to
show a minimum of one bicy�cle parking space.
As per Section 18. 108,080�A) the accessway is shown c�n the
preliminary site plan to provide the requirPd 24 foot
pavement width for a two-v�ay commercial a�cessway.
Code Section 18. 108.050{A) requires that a walkway shall
extend from the main ground flaor �ntrance o€ all coannercial
developments to the streex which provides the required
accsss and egress. The propo��d site plan does not indicate
the pravision of sueh a pedestrian access. Therefore, this
code requirement has not been satisfiecl.
Section 18.100.030 (Stree� Trees) states that all
development proj�cts fronting on a public street moxe than
100 feet in lenqth shall be required to plant str�et trees
in accordance with the standards in Sectiar� 18. i0Q.035.
�his site fronts on 3W Beveland Street for approxi.mateZy 160
feet. Therefore, street trees are rec�uired.
Section 18. 100.035 requires that street trees be spaced
betwee:� 20 and 40 fee� apart depending on the size
classification of the tree at maturity (small, medium or
l�rge) . The preliminary �ite plan indicates the existence
of one street tree already present on the site. Applicant
shall be required to p3.ant three additional street trees to
satisfy this requirement.
Section 1 . 1 (Visual Clearance Areas) requires that a
clear vi$ion area shall be maintained on the corners of all
property adjacent to intersec�inq right-of-ways or the
intersection af a public street and a private driveway. A
clear vision area shall �:ontain no vehicle, hedge, pllnting,
fence, wa11 structure, or temparr�ry nr permanent obetruction
(except for an occational utility po]� or tree) , exceeding

Trees exceedinq thi� h�ight may be loca�ed in the clear
vision area, provided all branches below eiqht feet are
removed. No plantings or structures which ohstruct vision
are located within the c].ear vision area.
Chapter 1 . 1 contains standards for obtaininc� a required
permit for removal of trees ht�vinq a trunk six inches or
more in diameter when measured four feet above the ground.
The preliminary site plan dnes not indicate a r�eed to remove
any �rees. If it becoaaes necess�ry to remove any trees,
please n�te that no tree reiaoval shall take place prior to
issuance of a Tree Remaval permft.
Section a8� 100.015(�) requires that the applicant submit a
lan�3scaping plan. The applicant has indicated on the site
plan t�e proposed location of four additianal trees located
in the rear of the building. Also shown are lav�rns alonq the
no�thern praperty line.
Section 18. 114. 130(U) (Signs) list the type of allowable
signs and sign area permitted in the C-P zone. A11 siqn�
shall conform to the provisions listed in this +�ode section.
All signs shall be approved throuqh the Sign Pr mit gr�cess
ss admini�tered by the Planning Division and shall comply
with vision clearance requirements.
B. PUBLIC FACILITY CONCERNS:
Sections 18. 164.030(E) ( 1) (a1 (Streets) , 18.164.090 (Sanitary
Sewer) , and 18. 164. 100 (Storm Drainsj shall. be satisfied as
� specified belows
1. STREETS:
Access to the site is provided from SW Beveland, a
local street. Curr_ently SW Beveland Str.eet has minimum
improvements. There is a�proximately 20 - 24 feet of �
pavement (full width) , npen ditches for drainaqe, and
nd curb or sidewalk. The existing right-of-way is 25
feet from centerline. Typi.call�, street improvements
are required as develapment accurs, as wouls! be the
�ase in this applicatian.
The site is located in the Tiqard "Trianqle" which is
currently under review by the Planninq Department. The '
ma jor emphasis of the review i.s to determf.ne what the future
zoning of the area should be to best m�aet the neede of the
City and the citizens. While this area a.s under review it

is our opinion that the street i.mprove�uents should be
delayed fr,r the following reasons:
1. Plans are still in the process of being developed
f�r the Tigard Trianqle. As a resuli:, the nature
and extent of future development in this area is
unknown. Subsequently, this portion of SW
Bevel.and Street is �till in question.
2. Sincs plans have not been completed for the
Trianqle, no capital improvement plans hav� been
established.
3. Half-street i.mpro�ement requirementg for the
froa�tage of this site do not provide a
significant :improvement to street safety or
capacity.
�herefore, the applicant should be required to sign a non-
�emonstrance agreement.
�. SANIT.ARY SEWER:
The exista_ng sinqle �amily home is currently on a septic
system. The nearest public sanftary sewer line is located
within SW 72nd Avenue, which is over 3Q0 feet from the site.
It is the City's policy that a septxc system is an
acceptable alt�rngtive if a single family hazne, or its
equivalent in use, is over 30Q feet from s public line.
The applicant will be required tc� provide evidence fram the
Washinqton County Health Department that the existing system
is capable af ineeting the demands of the proposed
development.
3. STORM SEWER:
The site slopes towards the �outheast. There is an open
di�ch along the frontage of the eite which carriea the stnrm
water from the street. The applicant i.s not proposing any
improvements which will increase the storm water run�off.
Therefar�, no additional i.mprovements arQ required.
