COP�SPLI�.NG� �WITH COMMUNITY DEVELOPMENT CODE, SECTIONS: : The applicant has indicated that the proposed new uSe of this site is as a professional office. This use is classified. in Code Section 18.42 (Use Classifications) as professi Section 18.106.030(C1 (1.1 (Minimum Off-Street. Parking Requirements - Administrative and Professional Services) requires one parking space for each 350 square feet of gross floor area. The office building is approximately 2,478 square feet in size. An office building of this size requires the provision of a minimum of seven (7) parking spaces. The site plan indicates that 7 parking spaces will be provided. Therefore the preliminary site plan meets the number of parking spaces. required and therefore satisfies this Code requirement. ' The Americans with. Disabilities Act (ADA), which became effective on. January 26, 1992, requires one disabled person parking space if 1 to 25 parking spaces are provided. The proposed plan provides for one such space for disabled person parking. Therefore, this code requirement has been satisfied. The preliminary site plan indicates that one driveway near the south end of the site IS to provide access to six parking, spaces. There is also a second driveway looted near the north end of the site which is intended to provide the access to one additional space. Section 18.1©8.050(l_1_. states that in no case Ethan the design of a service drive require or facilitate the backward movement or other manuvering of a vehicle within a street. Since the use of this one parking space will require backward movement onto the street upon exiting the site, staff will not be able to count this space as one of the required parking spaces. Therefore, the site plan shall be revised to show a minimum of seven parking spaces within the parting lot on the south side of the site. Code Section 18.106.02G {PJ requires one bicycle parking space for each 15 vehicle parking spaces in any development. Since there are only seven parking spaces to be provided on this site, one bicycle parking space its regi fixed. The site plan indicates that one 'bicycle parking rack is to be provided on this site. The applicant proposes to convert an existing residential home on a • parcel that is zoned commercial to a professional office building. Findings 1. STREETS: Access to the site is provided from S.W. 67th a local street. Currently 67th Avenue has minimum improvements. There is approximately 20 - 24 feet of pavement (full width) , open ditches for drainage, and no curb or sidewalk. The existing right-of--way is 30 feet from centerline. Typically, street improvements are required as development occurs, as would be the case in this application. The applicant would have been required to install half-street improvements along the frontage of the site. In a previous decision (SDR 92-0002, which is the property north of this site) the applicant appealed the , decision to the Planning Commission. The appeal specifically requested that the half-street improvements not be required at this time and that a non- remonstrance agreement be executed. In review of the appeal the Planning Commission unanimously approved it based on the following information presented by staff: 1. Plans are still in the process of being developed for the • Tigard Triangle. As a result, the nature and extent of future development in this area is unknown. Subsequently, this portion of SW 67th Ave. is still in question. 2 . The Unified Sewerage Agency has established and the City has agreed to enforce (Resolution and Order No. 91-47) Surface Water Management Regulations requiring: the construction of on-site water quality facilities or fees in-lieu of their construction0 Construction of an on-site water quality treatment facility is not appropriate because the site is small compared to the development plan, and the r loss of area for the on-site facility would preclude the effective p' development. In addition, requiring surface water quality facilities on small sites would result in numerous facilities that , would become a maintenance burden to the City. Furthermore, the applicant has not proposed any such facilities and there are no natural depressions or other areas of this site that are particularly suitable for water quality facilities.
