The findings and conclusions on which this decision is based are noted below: A. FINDINGS OF FACT } 1. Background No other land use or development applications directly involving the f' subject parcel have been reviewed by the City of Tigard. • 2. Vicinity Information' The subject property and surrounding properties are zoned C-P ; , (Commercial Professional) . Properties to the north and east are undeveloped and tree covered. Two single family residences are located south of the site along SW 68th Avenue. A counseling center is ,located across the street from the site. • SW 68th Avenue abutting the site is a 44 foot wide paved major collector street which includes curbs, sanitary sewer, and storm sewers. A sidewalk is located along the west side of the street, • although the sidewalk is not continuous. ' ' 3. Site Information and Proposal Description �. Tax lot 7600 contains a single story house, garage, and outbuilding. Several large trees surround the developed portion of the site. It was not clear to staff whether these trees are on the subject ' property. As noted above, access to the site is provided by SW 68th Avenue, a major collector. Section 18.1.0.8.060(B) of the Community Development Code discourages direct individual access to arterial or Collector streets. Section 18.108.110 of the Code provides for the Director to restrict the location of driveways on streets in order to provide for improved, f' traffic movement on congested streets and to eliiminate turning movement problems. While there is currently not a problem with congestion or turning movements on SW 68th, it is our opinion that as other properties develop along SW 68th, we will likely be facing these concerns in the, future. It is our .' desire to plan for these matters now and get solutions '. implemented before they become major obstacles to the City, `' developers, and the motoring public. Therefore, the a Engineering Department advises that the applicant should be required to sign an agreement to relocate the driveway when either the properties to the north or to the south develop and/or to allow the driveway on this site to serve as an access driveway serving future development on either or both Of those properties. , b. SANITARY SEWER: There is an existing 8 inch diameter public sanitary sewer , tix line located within SW 68th to which the applicant is proposing to connect. The existing line has sufficient, capacity to accommodate this development. c. STORM SEWER: There iS an existing public storm sewer system located within SW 68th. The Tualatin Valley Water District has not noted any objections to the proposed development, but has stated that the developer must bear the expense of relocating the existing fire hydrant, water • meter, or water lines if it is found necessary to construct proposed • improvements. • • The Tualatin Valley Fire and Rescue District has reviewed the proposal and has commented that a fire hydrant must be located within 250 feet of all portions of the facility. If a hydrant is not presently located within that distance from the facility, it will be the responsibility of the developer to provide a hycvant. The City of Tigard Building Division and PGE have reviewed the proposal and have offered no comments or objections. B. ANALYSIS AND CONCLUSION The proposal for construction of a 3,785 square foot commercial office building on this site conforms with Community Development Code C-P h (Commercial Professional) zoning district requirements for usage (many types of office uses are permitted uses in the C-P zone); with applicable minimum building setback standards; with the maximum permitted building height standard (45 feet maximum allowed - a single story building is proposed); with the maximum permitted site coverage standard (85 percent • maximum coverage allowed - approximately 81 percent coverage proposed); and with the minimum site landscaping standard for the C-P zone (15 percent minimum landscaping - approximately 19 percent landscaping to be provided). The proposed landscaping largely complies with the standards of Community Development Code Chapter 18.100. The landscaping plan provides for adequate numbers and spacing of trees surrounding the parking lot and lower level shrubs around the lot's perimeter providing partial screening of the parking lot from adjacent properties and from SW 68th Avenue. A eix foot high screening fence would be provided around the dumpster area on the south side of the building. Adequate numbers and spacing of street trees along the Oite's SW 68th Avenue frontage are proposed; however, the proposed planting Size for these trees is inadequate. Code Section 18.100.035 requires that street trees have a minimum caliper of two inches * at planting. The landscaping plan proposes one and one quarter inch caliper norway maple street trees. Therefore, the street trees will need to be increased in size to meet the minimum caliper standard. • The proposed Site improvements domply with Community Development Code Chapter 18.106 requirements for parking for most office uses that would be anticipated to iodate in this type and Size of building (11 spaces required for 80785 sq. ft. of building area at the minimum requirement of one space per 350 sq. ft. required for professional and administrative offices, businede and support services, insurance or real estate offices; 16 spaces proposed to be provided) . The Site plan provides for an appropriate number of designated handicapped parking spaces as required by the Oregon Revieed Statutes and the Ameridans with bisabilities Act (1 required; 1 provided) . Code Seetion 18.106.020.P requiree that one • bicycle parking spade be provided for every 15 automobile spaces. The site plan does not include provisions for bicycle parking. Therefore, at least one bicycle parking space within a tack must be provided prior to occupancy of the proposed building. While there is currently not a problem with congestion on SW 68th Avenue, as other properties develop along SW 68th congestion likely could occur. The Engineering Department is correct in pointing out that it is necessary to plan for future traffic levels now and get access solutions in place before major obstacles arise through uncoordinated access and development plans. To that end, under the authority of Section 18.108.110 of the . Code, the Director will require as a condition of approval of this request that the applicant enter into agreement to relocate the driveway when �+ either of the properties to the north or south develop so as to develop a joint driveway and/or to allow the currently proposed driveway on this site to serve as an access to serve future development on either or both . ` of these abutting properties. The site plan is also found to be consistent with Chapter 18.102 standards for vision clearance at the proposed driveway/roadway intersection. The ' site plan is also consistent with Chapter 18.164 standards for provision . of necessary public services (water, sewer, storm sewers), for the proposed use of the site. Ad described above in the Engineering Department comments, the applicant will be required to construct a sidewalk along the site's SW 68th Avenue frontage and pay fees in lieu of the construction of an on-site water quality facility, as well as a fee in lieu of placing overhead utility cables underground, unless the applicant and utilities agree to place these dables underground at this time. STREETS: The site is located and has frontage on S.W. 68th Avenue, a major collector. Minimum standards for a major collector include (all distances are from centerline) 30 feet of right-of-way, 22 feet of pavement, curb and sidewalks. Currently there is 30 feet of right- r of-way, approximately 22 feet of pavement, curbs, and no sidewalks. Therefore, the applicant should be required to install a sidewalk along the frontage of the site and underground the utilities or pay a fee in-lieu. As noted above access to the site is provided on S.W. 68th Ave. , a major collector. Section 18 .108 .060 (8) of the Community Development Code (CDC) discourages direct individual access to arterial or collector streets as designated on the Tigard Comprehensive Plan Map. Section 18 .108 .110 of the CDC provides authority for the << Director to restrict the location of driveways on streets in order • to provide for increased traffic movement on congested streets and ,.' to eliminate turning movement problems. While there is currently not a problem with congestion or turning movements on S.W. 68th, it is our opinion that as the properties develop along S .W. 68th we will be facing these concerns. It is our desire to plan for these matters now and get solutions implemented before they become major obstacles to the City, developers, and the motoring public. Therefore the applicant should be required to sign an agreement to relocate the driveway when either the properties to the north or south develop. ' • 2 . The applicant should be required to submit evidence that the a - existing system has the capacity to handle this development. The Unified Sewerage Agency has established and the City has agreed • to enforce (Resolution and Order No. 91-47) Surface Water Management Regulations requiring the construction of on-site water quality facilities or fees in-lieu of their construction. Construction of i+ an on-site water quality treatment facility is not appropriate because the site is small compared to the development plan, and the • loss of area for the on-site facility would preclude the effective development. In addition, requiring surface water quality facilities on small sites would result in numerous facilities that would become a maintenance burden to the City. Furthermore, the. applicant has not proposed any such facilities and there are no natural depressions or other areas of this site that are particularly suitable for water quality facilities. A Regional facilities, funded by fees in-lieu of construction of these facilities, would provide the required treatment with improved reliability and less maintenance. Therefore the applicant should be required to pay the fee`in-lieu of constructing an on-site facility.
