When the Westphals contacted the City regarding a building permit, for a pole building to be used as a garage and shop, it was brought to their attention that Site Development Review approval was also necessary for any improvement of the site from its prior undeveloped status. This application seeks approval of the prior improvements and use as well as proposed additional landscaping and construction of a 1,680 square foot pole building to be used as a shop and garage. The site shares a paved, 24. foot wide driveway with both I ' Centrex Construction and the bark dust business. An access easement for this shared driveway on the Centrex property has already been recorded. The application seeks to continue using the gravel parking lot for fleet storage. No specific parking spaces for passenger vehicles are to b e provided on the subject site.te. ,, The perimeter of the site is already fenced with a six foot high chain link fence, The landscaping plan for completion of site improvements provides for the addition of several deciduous trees to be located at the entrance to the site and to the rear of the proposed building, and a variety of shrubs as well as low groundcovers and barkdust around in a four to six foot wide'buffer around the site. 3. Agency Comments The Tigard Water District and the Tualatin Valley Fire and Rescue District have reviewed the proposal and commented that a fire hydrant must be located within 250 ' feet o f all portions of the facility. ANALYSIS AND CONCLUSION A proposal to develop a vacant parcel in the City of Tigard with a use other than single family residential uses or other limited disturbance land uses must be approved subject to the review and approval standards of Community !Development Code 1 Chapter 18.120 (Site Development review) prior to establishment Y , of the new use (Section 18,120.020 - Applicability) , The Westphal's use of tax lot 2900 for vehicle fleet storage use commenced prior to review and approval subject to these 1•, requirements, but they have been very cooperative in submitting the necessary application materials subsequent to finding out that land use and development approval was required. This review is therefore somewhat of I an aftex, the fact approval of some elements of the site plan and a before the fact review of additional site improvements. The approval standards for a Site Development Review of this sort requires compliance with t4"4' a variety of separate Community Development Code Chapters as listed below. Staff finds that the other approval standards 2 1 and Code Chapters listed at Section 18.1 .0. 80 are not applicable to this review. The proposal osal is consistent with the req uirements of Community Development Code Chapter 18.70 (I-L zoning district) . Construction vehicle fleet storage facilities are a permitted use in the I-L zoning district. The driveway from Hunziker Aoad (the nearest public right-of-way) to the site is paved and is approximately 200 feet long. The site is not within 100 feet of any residentially zoned or developed area and is not within 100 feet of any water course. Therefore, a gravel parking area is permitted for this type of use. The Code provides that the Community Development Director may require�1re t hat 3. property owner enter ex into an agreement to pave a permitted gravel parking area: a) within a specified period of time after establishment of the area; or b if there . is a change in the types or weights of vehicles utilizing the parking area; or c) ' if there is evidence of adverse effects upon adjacent roadways, water courses, or properties. As a condition of this development approval, the property's owners will be required to enter into such an agreement with the City prior to issuance of an occupancy permit for the proposed building. �. j r i Community Development Code Section 18. 106.030.C.1.b requires that fleet storage uses must provide one parking space for each employee of the largest shift. Ed Westphal has reported that, the maximum number of employees his firm has per shift is three; therefore, three passenger vehicle parking spaces are T. . required. No specific parking spaces for passenger vehicles have been designated on the site plan. Due to the approved gravel surface for this parking lot and the substantial amount of area, it is not necessary that the spaces be specifically designated. There clearly is more than sufficient area on the site to provide the required parking.
