No previous land use or development applications regarding this parcel have been reviewed by the City of Tigard. 2. Vicinity Information e.. Properties surrounding the Site are zoned R-12 (Residential 12 unit/acre) to the north, R-7 (Residential, 7 units/acre) to the e"..{,yth, R-4.5 (Residential, 4.5 units/acre) to the west, and I.-L (be+ ht Industrial) to the east. Single family residences are developed on surrounding properties except to the east. To the east of the site is undeveloped paiture lands and the floodplain of Fanno Creek. 3. Site Information and Proposal The approximatey 4.5 acre Site is currently developed with a duplex, a single family residence, and several outbuildings. All buildings are on the western portion of the lot. The eastern ports.en of the site is open pastureland, ornamental and fruit trees are scattered throughout the developed port;i.on of the ,:bite. The applicant proposes to develop a forty-six unit apartment complex on i' •' the site. The apartment complex will include nc lode the existing duplex. The western-most 170 foot section of the driveway will be located within a 50 foot wide dedicated public right-of-way. The City has indicated to the applicant the need to dedicate this area for a possible future extension of Fanno Creek Drive. In addition, the site plan notes that 1... . - , an additional 6250 square foot, 250 long strip along the mite's southern , . boundary will also be dedicated for the possible future extension of the , road, although no road development within this section will be constructed at this time. The City's Transportation Plan Map calls for , development of road connections between Hall Boulevard, Hunziker Street, and Bonita Road in this general area although a specific alignment is . not shown. , The complex will be served by 92 parking spaces to be located along the ''''•. . . driveway including 53 covered parking spaces and four designated handicapped parking spaces. , • • ,• . The proposed development will be provided with sanitary sewer service , through a connection to the Fanno Creek interceptor to the ealet within 'i, the floodplain of Fanno Creek. Storm drainage will be collected by a • ' private storm sewer and directed to Fanno Creek. Water, gas, and . , electrical service is to be provided from facilities located along Hall ' Boulevard. 4. Agency and WO Comments . ; The Engineering Division has reviewed the proposal and offers the following comments: a. The site ie located within an area noted or the Comprehensive Plan Transportation Map which is to provide collector street connections between Hunziker Street, Hall Boulevard, and Bonita Street. Fanno Creek Drive has been stubbed to the south of the site with the . intention of extension to Hall Boulevard. A topographic map of the area Shows the adjacent street , the 100 year floodplain, and the tax lot boundaries. From this map it can • be concluded that development of this site gill not obstruct the , . , . intentions of the Comprehensive Plan. The extension of Fanno Creek • Drive to hall Boulevard dan be adcomplished along the southern edge of this site. . ■ . This future extension of Fenno Creek Drive will intersect Hall Boulevard approximately 400 feet north of McDonald Street. The exact alignment of this last segment could vary depending upon develop- . ment of adjacent properties. Because of this, improvement of this segment of the street is not warranted at this time. If all of this section of right-of-way is not utilized, it may be possible - that a portion of this right-of--way can be vacated in the future. • The initial 170 foot long northwestern segment of this street should be improved to local street otandards to a minimum width to provide two-way traffic and provide a minimum 30 foot curved radius onto Hall Boulevard with sidewalk on one side. This street segment - will serve only as access to the proposed development for now. b. Hall Boulelard is a state highway. Half-street improvements and right-of-way dedication to 45 feet from centerline are typically required for developments such as this. We recommend these - improvements be installed as part of this development. Half-street improvements typically include pavement to 25 feet from centerline plus curbs, sidewalks, streetlights, storm drainage, and associated utilities. c. The site drains to the rear of the property which contains Fanno Creek; therefore adequate storm drainage is available. ° d. A main trunk sanitary sewer line existe along Fanno Creek; therefore adequate service is available to the rear of the . property. The Building Division reviewed the proposal and has commented that a demolition permit will be necessary prior to removal of existing • buildings on the site. The Oregon State Highway Division has commented that an access permit must be obtained and that the applicant should provide details on the proposed local street intersection with Hall Boulevard with regard to its location relative to other accesses within 200 feet on both sides of the road. The Highway Division has also commented that additional right-of-way must be dedicated to increase the right-of-way to 45 feet from Hall Boulevard'a centerline and that half-street improvements must be installed from the curb face at 25 feet from centerline. The Park and Recreation Board has reviewed the site plan and hatii . , . commented that an eight-foot wide asphaltic concrete bicyCle path should be required to be constructed along Fenno Creek by the applicant in conformance with Plan Policy 312.3(d) and Code Sedtion 18.84.040(A) (4). /n addition, the Park Board has pointed out a need for a pathway connectiOn between the proposed development and the bikepath within the floodplain. Washington County Fire District 41 has Commented that fire hydrants must be provided within 250 feet of all portions of the buildings on the site*. Hydrants must be installed by the developer. The applicant should provide USA with preliminary engineering details on the proposed connection. , No,rthweat Natural Gas Co. has commented that an existing four inch , diameter steel gas main exists approximately six feet within the ,a. property's western boundary. This main should be identified and '� protected during any construction along the site's Hall Boulevard ; frontage, ,. General Telephone and the Tigard Water District have reviewed the proposal and have offered no comments or objections. ` No other comments have been received. B. ANALYSIS AND CONCLUSION proposed site developments comply with Community Development Code R-12 (Residential, 12 unite/acre) zoning district requirements for setbacks, • building height (36 foot maximum height) , lot coverage (maximum allowed " ,, : Elite coverage of 80 percent; less than 60 percent site coverage proposed), and landscaped area (20 percent minimum required; greater than 40 percent site landscaping provided) . For this particular site and proposal, land provided for private streets (approximately 11,500 square feet), land . i'', . within the 100 year floodplain to be dedicated for park purposes , (50,978 square feet), land to be dedicated as additional right-of-way for Hall Boulevard (4700 square feet), and land to be dedicated for . public right-of-way along the southern edge of the parcel within 170 , feet of Hall Boulevard (6,250 square feet) are subtracted from the gross . • site area (approximately 199,595 square feet) to determine net . , ., 1 developable area (Because of the uncertainty whether the additional . area to be dedicated along the site's southern boundary will ever be developed with a roadway, the irector's designee has chosen not to . . exclude this area from the net aavelopable area because it is possible that all or a portion of this area will revert to this parcel if the right-of-way is later vacated). Net developable area (126,167 square % feet) is then divided by the Minimum lot area per dwelling unit for the . , , R-12 zone (3,050 square feet per unit) to determine the base number of dwelling units allowed on the site (41.4 dwelling units). Community Development Code Section 18.92.030(A) allows for a residential density transfer from unbuildable areas (i.e., steep slopes, floodplain, . drainageways) to the remainder of the site. The density transfer is limited to 25 percent of the units that would have been allowed on the . unbuildable area if the Code had not declared the area to be ` unbuildable. In the present case, 4.2 dwelling units may be transferred . , from the floodpIain area in accordance with the Code provisiono. A .. total of 46 dwelling units can therefore be developed on the parcel. , a The proposal to construct 44 additional dwelling units and retain the existing duplex therefore ie consistent with the allowed dwelling unit calculation for the site. The Park Sod has requested that a bike path be constructed in the area to be dedicated in accordanee with Plan Policy 3.2.3 and the Pedestrian ' Bicycle Pathway Plan. DECISION THE DIRECTOR'S DESIGNEE APPROVES SITE DEVELOPMENT REVIEW SDR 89-14 SUBJECT TO THE FOLLOWING CONDITIONS. BUILDING PERMITS WILL NOT BE • ISSUED UNTIL THE FOLLOWING CONDITIONS HAVE BEEN SATISFIED: :1. Standard half-street improvements, including concrete sidewalk, driveway, apron, curb, asphaltic concrete pavement, sanitary sewer, storm drainage, streetlights, and underground utilities shall be • installed along the Hall Boulevard frontage. Improvements shall be designed and constructed to Oregon State Highway street standards and shall conform to the alignment of existing adjacent improvements or to an alignment approved by the City Engineer. The applicant shall obtain a permit from the State of Oregon P Highway Division to perform work within the right-of-way of Hall Boulevard. Standard two-thirds street improvements, including concrete sidewalk, driveway, apron, curb, asphaltic concrete pavement, sanitary sewer, storm drainage, streetlights, and underground utilities, shall be installed along the Fanno Creek Drive frontage. Improvements shall be designed and constructed to local street standards and shall conform to the alignment described in Condition #5. The pavement shall be a minimum width of 30 feet for a distance of 170 feet from the centerline of Hall Boulevard and / shall include a 30 foot curb return radius onto Hall Boulevard to the north and a 30 foot pavement radius to the south.
