They ![lave • made a conclusion Which fulfills our desire to restrict external traffic from The Fountains, without making a negative impact on emergency access to the , Northern portion of our development. If the Naeve Road entrance is blocked by a brick wall rather than a gate then emergency access is Impacted as pointed in sub ject ' decision. In addition whenever 1114th Ct is blocked north of the fountain,' for whatever reason, the Northern portion of The Foun.t,° ins is totally isolated. Another factor which should be kept in mind is the possibility of 109th St being closed. That is the desire of Summerfield as was evident at a zoning hearing earlier this year. If that were to happen we would essentially have only one entrance, that being Summerfield Dra . A majority has indicated they favor closing the Native Rd entrance. Although the residents apparently feel that the turn-around structures do not do onou h to discourag e through h traffic and slow traffic movements, ' the Fire District: finds that the turn-around structures along with the narrow streets slow vehicles don, especially large emergency vehicles. The Fire District has commented that emergency vehicles currently I have a difficult time e maneuvering through the site and that closing the Naeve street exit will significantly increase the District's emergency response times to buildings i:n the northern portion of the (development that would normally be accessed from Naeve ,Street. The northernmost buildings within the development would be in excess of 900 feet from the nearest access Point from a public street if the access would be closed as proposed, Because of the concerns raised by the Fire Dir ,r,ict, the Planning Division is unable to conclude that the proposal to totally close the S.W. Naeve Street access to the Fountains would provide, an adequate circulation pattern throughout the development designed to accommodate emergency vehicles as required by the Site Development Review approval criteria. They related to the original requirement of the development to provide access to Naeve Street along with half street f- 1 . improvements and the modification approved recently by the Planning Commission M to eliminate. the Naeve Street access. She felt that this kind of reversal of a 1 ' previous decision makes the City decision makers look bad by appearing 1 arbitrary. The Fountains at Summerfield was originally approved by the Commission in , August, 1984 (PD 3-84) with a driveway access onto Maeve Street and a ',,t ,to provide street improvements alon g the Naeve Street frontage- The street improveme nts were imposed primarily because of the. required driveway access. The Fountains Condominiums Association submitted an . application (SDR 89-10) this spring to close this driveway with a wall. The , , approved the use of break- proposed a wall,�. but away gate denied wthel a design closure was acceptable to the Fire District. This deciion was appealed to nnin�g Commission and on July 24, 1989, the commission ssion approvedthe complete closure of the driveway. Subsequently, the wall haw been constructed but the required street opening permit t'a . . .. c ermit � replace the driveway apron with ' a standard. curb has not boert obtained. It was their recommendation r that we install some form of emergency gate that would allow only emer enc , vehicles onto our g y property.., ' This Proposal is not only beyond our financial budget but does not accomplish what I have previously stated as our goal. At a cost of only $1,450 we can build a brick fence that conforms to our existing fence and eliminates all of the previously noted forms of traffic from Naeve Street. we are not anti-skate boards, bicycles, or any other small vehicles, but we are involved in a possible liability situation and, as owners of this property, we feel that we should be entitled to regulate who enters from our access roads Mr. Birchall of the Washington County Fire District during , our interview on the subject ct in.dicated that in the event of an emergency situation in our upper area (noted in yellow on your sketch Whieh we provided) the permanent closure of the Naeve exit . i would isolate that area to only l one access road for Street era.t.. his vehicles and if by some unusual circumstance and time frame there was 'a vehicular accident at that access road, his 511 vehicles could not respond into that area without undue delay. The Fire Dstriot had commented that without such a gate, emergency vehicles attempting to serve the northernmost buildings within the Fountains would need to travel greater than 900 feet from a public access point through the develo p ment and that the narrow widths and pastern of roadways s within the development make fs truck y access to the northern portion of the development from the cult. The 'applicant/appellant has appealed the decision based upon the imposition of the condition of approval requiring the emergency access gate. Attached are the May 25, 1989 Director's Decision for SDR 89-10 the applicant/appellant's appeal filing form; and letter from Fountains' resident c.S. The applicants, the Condominium Homeowners Association, have requested permission to close the Naeve Street access to the Fountains by continuing an existing 42 inch tall brick wall on the development's Naeve Street frontage across the existing driveway. Because the proposal„ changes accessways to an existing development in a way that could affect off-site traffic, the • proposal is required to be reviewed as a major modification to an approved site plan through the Site Development Review Process. 4. The Fire District commented that such gates often become` problems because of lack of maintenance and later confusion regarding who has responsibility for maintaining the gate. The narrative submitted with the original planned development application for the Fountains noted that: To minimize the tendency of off site traffic to use the private streets as a short cut such as the street connecting S.W. The primary functions of these structures is to slow vehicles down and discourage thru traffic. . . ." ' Although the residents apparently feel that the turn-around structures do do' enou h to discourage through traffic and slow traffic movements, not g g g the Fire District finds that the turn-around structures along with the narrow streets slow vehicles down, especially large emergency ;vehicles.
