The findings and conclusions on which the decision is based • are noted below. A. FINDING OF FACT 1. Background No previous land use applications regarding this parcel have been reviewed by the City of Tigard. 2. Vicinity Information Properties to the north, east and wet of the site are zoned R-12 (Residential 12 units/acre) . Site Development Review approval (SDR 88-24) was granted to develop 1.2 apartment units on the property immediately to the north and west of the subject parcel. Also, on the property further to the west and northwest another , , • Site Development Review approval (SDR 89-08) had been granted for an additional 12 apartment units. These two projects are intended to use a common driveway to Durham Road, but construction has not yet begun. The Unified Sewerage Agency'e wastewater treatment plant is located south of the site across Durham Road. This property i8 zoned I-P (Industrial Park). 3. Site Information and Proposal Deacription The subject property is approximately 13,940 Square feet in size. It contains One single-family residence and a carport. Most of the , property is wooded. The applicant proposes to construct three additional apartment units and also keep the existing single-family residence, Access to these three units and the house iS proposed to be provided by • the common driveway noted above which is to serve the other 24 apartment units. The ekisting driveway for the house to Durham Road or the house is to be removed. The required parking for the three apartment units is to be provided by adding several spaces on the east side of the proposed Common driveway and also to add three garage spaCeS to the preposed apartment complex to the north. The applicant intends to develop thiS proposal along with the 12 units to the north as one project. Agency and NPO Comments The Engineering Division has the following comments: a. The subject site has 100 feet of frontage on Durham Road. The • access and adjacent proposed developments have 200 feet of frontage, creating 300 of total frontage for the combined apartment complexes. The access, approved for the previous , complex, is also proposed to be used by the subject complex and is approximately 350 east of Hall Blvd. Engineering staff has no objections to this proposed access. In order to • improve the access, we would prefer that it be constructed • 4. 4 with curb returns so that cars would not have to slow down from Durham Road to enter as much as they would for a typical driveway apron. We still require an apron, but as long as the . storm drainage is directly along Durham Road, the apron can be much flatter than that of the standard apron. • b. Durham Road is a two-lane, paved State highway. The pavement is widened west of the access to 28 feet from centerline to provide a right-turn lane at Hall Blvd. The necessary improvements are currently being evaluated for the installation of a signal at the intersection of Hall Blvd. and Durham Road. No additional pavement widening ie anticipated beyond the right-turn lane for the signal on the north side of Durham Road at this time Half-street iMprovements typically required of developments such as this for Durham Road are ' normally 25 feet from centerline. The half-street " improvements should include eidewalks, streetlights, and underground utilities, The existing right-of-way is 30 feet from centerline. Righte,of-way along Durham Road is typically required to be 45 feet from centerline. c. The Site is proposed to drain to the north or rear of the property. The drains would connect to public storm and sewer lines proposed to be constructed just north of the subject property. The lines have been proposed to provide service to Tigard Friends Church being constructed on Hall Blvd— The storm and sanitary Sewers will then drain to the existing facilities in Bond Street at 81st Ceurt. 0, The Building Division has no objection to the proposal but indicates that the two tax lots would have to be consolidated into one lot in order to meet building setback requirements. The Consolidated Fire and Rescue District comments that portions of the exterior first floor of the structures Shall be within 150 feet of emergency vehicular access and 250 feet within a fire hydrant. TheBe measurements from the fire hydrants Shall be made around the outE4ide of the structures. I The Shate Highway Division indicates that an access permit is • required from ObOT. In a case where the structure is to start ,within the drip line, the visual barrier should be as far away from the trunk of the tree as possible. Site Development Review approval (SDR 88-24) was granted to develop 12 apartment units on the property immediately to the north and west of the Bubjeot parcel. These two projects are intended to use a common driveway to Durham Road, but construction has not ` yet begun. Site Information and Proposal Description The subject property is approximately 13,940 square feet in size. It contains one single-family residence and a carport. The access, approved for the previous complex; is also proposed to be used by the subject complex and its approximately 350 east of Hall Blvd. Engineering staff has no objections to this proposed access. In order to , improve the access, we would prefer that it be constructed with curb returns so that care would not have to slow down front Durham Road to enter as much as they would for a typical driveway apron. We still require an apron, but as long as the storm drainage is directly along Durham Road, the apron can be much flatter than that of the standard apron. d a b. Durham Road is a two-lane, paved State highway. The pavement . is widened west of the access to 28 feet from centerline to provide a right-turn lane at Hall Blvd. The necessary improvements are currently being evaluated for the installation of a signal at the intersection of Hall Blvd. and <, Durham Road. KENNETH A. PAULSEN, ARCHITECT The original 12 unit Durham Estates Design (now referred , to as phase one) recieved site development approval on January 9, 1989. (See SDR 88-24. ) Since that time, the property and . devlopment plans have been aquired by Prime Development Co. In addition, they have purchased tax lot 1600 (referred to as • phase two) which is situated on Durham Rd. immediately loth of phase one This application is submitted for approval of the proposed three townhouse unit development on the phase two property. . The lans also show phase one as a p phase approved but with minor revisions. Phase two will continue the same character of high quality development begun in phase one. Again, the primary concern in this project was to save all existing large' fir trees. This objective required shifting the three unit building far to the east, which preserves all trees. The resulting forested open area framed by the existing house, the new three unit building and the proposed six unit building in phase one will help present a secluded residential flavor to the entry sequence. However, to maintain a privacy buffer to the existing single family house to the pant, we felt it necessary to provide a site obscuring fence between the two properties. This fence has been also added near the trash enclosure in phase one.
