In May of 1986, the Planning Director approved a Site Development Review (SDR 10-86) for development of a 32,250 square foot mixed industrial use building on the site. The building has since been constructed. A zone change proposal was approved by the Tigard Planning Commission (ZC 88-05) in May, 1988, subject to two , conditions. The approval granted a zone change from I-.L (Light „It , Industrial) to I-P (Industrial Park) . 2. Vicinity Information . . ' • . , Properties to the east and southweSt are also zoned and developed I-P. Properties to the west and south are zoned I-L (Light • Industrial) . The site is bordered by Upper Boones Ferry Road to the . • south, SW 72nd Avenue to the west, and the Southern Pacific Railroad SO /1 right-of-way to the northeast. 3. Site Information and Proposal The property is a relatively narrow, 2.52 acre, triangular shaped I , parcel. A 32,250 square foot two-story industrial office building 4 has been constructed on the southern portion of the Site, along with 103 parking spaces, a loading area on the east Side of the building and landscaping coverage amounting to about 21 percent of the site. . . Parking The original site plan for phase one of this project inidcated 103 parking Spaces where only 65 were required. Phase two will require a minimum of 22 on-site parking spaces. Because the southerly access from SW Upper Boones Ferry Road connects the two phases, staff has determined that the on-site automobile parking requirements for both phases will be satisfied. However, two spaces for bicycle parking are also required, These should be indicated on a revised site plan. , . , b. Signage No plans or drawings have been submitted by the applicant relating to • tor signage. Therefore, all signage must be reviewed separately in the 4 future and be approved for sign permits by the Planning Division. City sign permits are required before the erection of signs. Staff notes that the entire site (phase 1 and phase 2) will be permitted no more than one freestanding sign. Wall signage may cover up to 15 percent of the wall face on which a sign is mounted. C. Building Setback In the Industrial Park zoning district, the required front yard setback for any structure is a minimum of 35 feet from the front property line. The applicant proposes a setback variance to allow a 10 foot building setback from the front property line. Section 18.134.050 of the Code Contains criteria whereby the Director can approve, approve with modifications or deny a variance request. They are: (1) The proposed variance will not be materially detrimental to the pvrposes of this Code, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies of the Community Development Code, to any other applicable policies and , standards, and to other properties in the same zoning district or vicinity. (2) There are special circumstances that exist which are peculiar to the lot site or shape, topography or other circumsLances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; (3) The use proposed will be the same aa permitted under this Code and City standards will be maintained to the greatest extent r. possible, while permitting Some economic use of the land; (4) Existing physical and natural Systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely afected any more than would odour if the develorrnent were loCated as Specified in the Code; and STAFF REPORT - SbR 89-04/V 89-09 - PACIFIC MALTY - PAGE 3 r ( N 3 • r. • (5) The hardship is not self-imposed and the variance requested is ..• • the minimum variance which would alleviate the hardship. The variance as proposed will not be in conflict with other applicable policies and standards of the Community Development Code and the i Comprehensive Plan. The configuration of this northern portion of the parcel, a narrow triangle, makes it impossible to build d any sizeable '• :., structure on the property meet the 35 foot setback : , �' rt and �� still. ' ' requirement. The peculiar shape of the lot indeed severely limits not only the location of any building but also the size of a potential building. The use proposed will be the same as permitted under the Code ' and City standards will be maintained to the greatest extent possible while permitting some economic use .of the land. The variance is the minimum requested, the building cannot be placed any further back on the property as it is proposed to be located ;v. directly abutting the rear property line shared with the Southern . Pacific Railroad. Staff therefore recommends approval of the building setback variance for the front yard. d. Landscaping Normally the site landscaping requirement in the I eP zoning district requireS that a minimum of 25 percent of the entire site be landscaped. �. However, a new provision contained in section 18.65.050.A.6. allows this requirement to be reduced when all of the following standards are met 1) Street trees must have a minimum caliper of 3 inches i nst ead of the usual inch es at four feet in height; 2) The landscap in g between the parking lot and the street property line shall have a minimum width of I0 feet; and 3) all applicable buffering,' screening and setback requirements oan be satisfied. The proposed street trees are proposed to have a caliper o two inches. Vision clearance is important to pedestrians and motorists, who need to be able to see around intersections of public streets and private driveways in order to enter . and exit safely. Staff will have this confirmed by the Engineering staff prior to final approval of the landscaping plan. J. • DECISION The Community Development Director's designee for the City of Tigard hereby approves site development review SDR 89-04 and variance V 89-09 subject to the following conditions: 1. The applicant shall obtain approval from the Engineering Division to locate the red maple trees as shown on the proposed or revised landscaping plan to determine whether the trees will pose a vision clearande problem. DESCRIPTION OF THE PROPOSAL This is a proposal for Site Design Review and an administrative variance to facilitate construction of a multi-use office/warehouse building on Tax Lot 200, Map 2S1-12DD. The site lies between S.W. 72nd Ave. and the Southern Pacific Railroad, north of SW Upper Boones Ferry Rd„ • An existing building on the site was constructed in 1986. The northerly portion of . the site was not, developed at that time,, largely due to the site's configuration, and its potential use as a "card lock" fueling station for adjacent businesses.. Since that use of the site will not occur, a small building with parking has been designed • for the site. The design of the building is consistent with the established portion of the site. A The proposed front yard variance is in response to the site`s narrow triangular shape , and the need to maintain standard module dimensions in the building. ' • II. DISCUSSION OF THE PROPOSED FRONT YARD VARIANCE • • The I.P. zone requires a 35 ft. front yard setback. In most instances, a site alio' 1 the building to be set back far enough to provide parking and landscaping between the building and the street, often as much as 65 ft. However, in this case, the site is IP n only 110 ft. deep at its deepest point, narrowing in a triangular shape to the north. . If the 35 ft. yard were respected, the building envelope would be 75 ft. deep at its deepest point, and 45 ft, deep at its narrowest point. Since building walls need to be perpendicular to each other in plan, and in order to maintain acceptable module dimensions it will be necessary to reduce the front yard setback as indicated on the accompanying drawing. This design approach is consistent with the existing building on the site. III. REVIEW OF VARIANCE CRITERIA • Section 18.134.050 of the City Development Code provides several criteria which must • be met by a proposed v ar i mce. Each is addressed as follows: Criteria 1 The proposed variance will not be materially detrimental to the purposes of this Code, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards; and to other properties in the sane zoning district or vicinity." ' Comment: The. total site developm ent proposal must be viewed as an integrated design for a • thorough evaluation with respect to Code purposes and Plan policies. Generally, it !° is an n the intent of the Comprehensive Plan and the Development Code to provide for T.P. Uses Sri environment conducive to business, as well as compatible with adjacent ' areas. The decision with respect to building configuration i ' s the result of a complex analysis . alysis of many factors. Reducing the front yard setback at this site will not adversely affect these properties, since there are currently substantial setbacks on the adjacent properties. Also, the design facilitated by the variance will continue the established building appearance on the balance of the site thereby enhancing the area as a whole. • Criteria "There are e s pecial circumstances� that exist: which are peculiar to th..: lot � � � ,, size or shape, topography or other circumstances over which'the applicant has no control , and which are not applicable to other properties in the same zoning district." r �„ Comment: . This parcel s narrow triangular shape is precisely the condition for which variance . • provisions are included in the Development Code. As described above, the lack, of site depth would preclude a reasonable development of the property without the proposed variance. This condition is beyond the applicant's control , and is not applicable ., to other properties. Criteria 3: "The use proposed will be the same as permitted under this Code and City y standards will be maintained to the greatest extent that `�is reasonably possible, while permitting some economic use of the lands" ' Comment. The proposed use of the site is allowed by the IP zone, and is consistent with the surrounding area. The amount of the proposed reduction of the front yard setback is ' M. based on building dimensional requirements from an economic and construction standpoint. This also reflects the Code standard for landscaping adjacent a street (10 ft. minimum) in site developments providing 20% landscaping overall . Although this standard is applicable to parking,areas, it is useful as a basic criteria for a, minimum landscaping. The proposal , therefore, reasonably meets City standard while allowing an economic use of the site. Criteria 4: "Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will, not be adversely affected any more than would occur if the development were located as specified in the Code " Comment: The front yard setback as proposed will not affect physical or natural systems, since under any development plan, it is typical for an Z.P. site development to include building, parking, and landscaping. DESCRIPTION OF THE PROPOSAL This is a proposal for Site Design Review and an administrative variance to facilitate construction of a multi-use office/warehouse building on Tax Lot 200, Map 2S1-12DD. The site lies between S.W. 72nd Ave. and the Southern Pacific Railroad, north of SW Upper Boones Ferry Rd. �. An existing building on the site was constructed in 1986. The northerly portion of the site was not developed at that time, largely due to the site's configuration, and'' '• its potential use as a "card lock" fueling station f'.r adjacent businesses. Since that use of the site will not occur, a small building With parking has been designed ,i for the site. The design of the building is consistent with the established portion of the site. 4 '' . The proposed front yard variance is in response to the site's narrow triangular shape „ and the need, to maintain standard module dimensions in the building. II. DISCUSSION OF THE PROPOSED FRONT YARD VARIANCE '. fl The I.P. zone requires a 35 ft. front yard setback. In most instances, a site allows the building to be set back far enough to provide parking and landscaping between the building and the street, often as much as 65 ft. However, in this case, the site is only 110 ft. deep at its deepest point, narrowing in a triangular shape to the north. If the 35 ft. yard were respected, the building envelope would be 75 ft. deep at its deepest point, and 45 ft. deep at its narrowest point. Since building walls need to be tperpendicul ar to each other in plan, and in order to maintain acceptable module dimensions, it will be necessary to reduce the front yard setback as indicated on the accompanying drawing. This design approach is consistent with the existing building on the site. III. REVIEW OF VARIANCE CRITERIA Section 18.134.050 of the City Development Code provides several criteria which must be met by a proposed variance. Each is addressed as follows: • 1.... Criteria 1 ''The proposed variance Will not be materially detrimental to the purposes of this Code, be in conflict with the policies of the Comprehensive Plan, ler to any other applicable policies and standards; and to other properties in the same zoning district or vicinity.' Comment: The total site development proposal must be viewed as an integrated design for, a d,, thorough evaluation with respect to Code purposes and Plan policies Generally, it is the intent of the Comprehensive Plan and the Development Code to provide for I.P. .; uses in an environment conducive to business, as well as compatible with adjacent areas. The decision with respect to building configuration is the result of a complex analysis of many factors. It is the overall intent of this project to establish a high quality environment, compatible with its surroundings, which is also the purpose of the Development Code. Reducing the front yard setback at this site will not adversely affect these properties, • since there are currently substantial setbacks on the adjacent properties. Also, the • design facilitated by the variance will continue the established building appearance on the balance of the site, thereby enhancing the area as a whole. • Criteria "There ar e s pecial circumstances that exist which are peculiar iar to the lot • size or shape, topography or other circumstances over which the applicant' has no control , and which are not applicable to other properties in ,the same zoning district." • Comment: '" ,.. This parcel's narrow triangular shape is precisely the condition For which variance • provisions are included in the Development Code. As described above, the lack of site depth would preclude 'a reasonable development of the property without the proposed . . variance. This condition is beyond the applicant's control , and is not appllicable to other properties. Critevia 3: "The use proposed will be the (same as, permitted under this Code and City T svandards will be maintained to the greatest extent that is reasonably possible, while permitting some economic use of the land;" Comment: The proposed use of the site is allowed by the IP zone, and is consistent with the surrounding area. The amount of the proposed reduction of the front yard setback 'i is based on building dimensional requirements from an economic and construction standpoint. This, also reflects the Code standard for landscaping adjacent a street (10 ft. minimum) in site developments providing 20% landscaping overall . Although this standard is, applicable to parking areas, it is useful as a basic criteria fora minimum) landscaping. The proposal , therefore, reasonably meets City standard while allowing an economic use of the site. Criteria 4: ''Existing physical and natural systems; such as but not limited to traffic, drainage, dramatic land forms or parks 'Will not be adversely affected any more than would occur if the development were located as specified in the Code;" Comment: a: 7 (' systems, since The front yard setback as proposed will 1 not affect physical o natural sy em under any development plan, it is typical for an I.P: site development to include building, parking, and landscaping.
