Site Information and Proposal / ' The property is presently undeveloped and it Slopes gently down away from Hunziker Street. The route of the force , main is not shown, but it appears to require an easement from the adjacent parcel' to the west. d. Storm drainage is provided by connecting the proposed catch basin to an existing private storm drain which in turn �s connected to a public storm sewer. The public storm sewer does not have adequate capacity and therefore, stormwater ' detention is required. ANALYSIS AND CONCLUSION I The proposed development conforms with Community Development Code requirements for building height, setback, yard area requirements, • visual clearance, off street parking and loading, and access and ,egress. However, there are several aspects of this proposal which warrant further discussion. . I 1. Parking •r The Code requires parking to be provided at a ratio of one parking space per 1,000 square feet of building area for this type of activity. Therefore, thi3 development requires 17 parking spaces and, as noted earlier, 36 spaces are proposed. The 'applicant :has shown the one necessary handicapped parking space in an appropriate location, as well as bicycle parking. The plans for the specific type of bicycle rack should be submitted to the Planning Division for approval prior to installation. 2. Access The proposed driveway entrance is suitably located and the majority of the driveway within the site is over 24 feet in width. However, at the south side of the building, the driveway is only shown to be 20 feet 7 inches where the Community Development Code' requires a driveway width of 24 feet. The site plan should be amended to provide this slight expansion of driveway width. 3. Landscaping The Code requires that 25 percent of a parcel in the I-P zone be retained for landscaping. If additional amenities are provided, including 3 inch caliper Street trees and a minimum 10 foot w•.. landscaped buffer along the front of the project, the landscaped area can be reduced to 20 percent. Prior to the issuance of building permits, the applicant must submit a landscaping plan which includes street trees along the Hunziker Street frontage; . . trees and screening in and around the parking and loading n g area and a description of the types of ground cover and other planting • materials to be used. WHEREAS the parties have heretofore entered into a certain land sale contract dated December 30 , 1986 , a copy of which has been recorded in the records of Washington County under recording numbers 86061801 and 87008514; and WHEREAS said contract provides that the deferred contract balance, shall be paid in full on or before December 31 , 1988 ; and WHEREAS there has been a delay regarding the development of a the property relating to storm sewer matters; and WHEREAS the parties desire to modify the contract to extend, the date of payment; • NOW, THEREFORE, IT IS HEREBY AGREED for good and valuable consideration that paragraph 3 (b) of the land sale contract dated December 30 , 19 86 be and hereby is modified to read as follows: (b) The deferred contract balance and any accrued interest thereon shall be paid in full on or before December 31, 1989. Purchaser May prepay any or all of the remaining contract balance at any time without prepayment penalty.
