S U B J E C T: Fourier Development (S,D.R, 5-85) and area wide drainage
problems, See attached map,
As you may know this area has had serious drainage problems for several
years, The largest contributor to the problem appears to be Washington
Square, The system that starts at the culvert under Hwy. 217 at the Mini
Storage development and 'runs south and westerly to •Ash Creek is a ariyata
system, We have searched County planning records and have been unable to find
information as to why ,Washington Square was allowed to drain onto private
property with large volumes of water':
To minimize current private property disputes and enhancel development to occur
in an orderly, fashion, this i system needs to be public, This determination was
made several years ago and subsequently drainage L,x:;q, 's were talked about •
but never pursued. I think it' s time we follow this one through completion.
The Fouriers which own about 30% of the affected area have agreed to circulate
a petition and participate in the L ;C,D, I .have
p rovided them with a petition
and property owner l i st.
Relative to their development, we conditioned them to replace the ditch with a
conduit and grant a public easement within their pr a r
pes ty .LThey are now
asking if a non-remonstrance agreement would be acceptable' given the fact that
the improvement should at least be designed from one end to the other before
sections are constructed, They feel this design task should not be theirs, l: '

SITE DEVELOPMENT REVIEW SDR 5°85
APPLICATION: Request by Hilda Larsen, Jan Fournier, and George Fournier to
construct a 15,000 square foot industrial building and related facilities on
property zoned I-P (Industrial park and located at 10655 SW Greenburg Road
(Washington County Tax Map 1S1 35BB, Tax Lot 800).
DECISION: Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED the above described application subject to certain
conditions. The findings and conclusions on which the Director based his
4 decision are as noted below.
A. FINDING OF FACT
1. Background
Conditional Use (CU 20-81) and Site Design Review (SDR 1-82)
approvals were granted to permit the establishment of a tire

warehouse and distribution center. The site plan submitted during
the review indicated that, an additional area would be reserved for •
development at a later date.
2. Vicinity
Information
The adjacent parcels to the north and west are zoned. I-L " and
several parcel zoned C-G (Commercial General) lie to the south. :
3. Site Information and Proposal Description
• As mentioned above, the property is presently developed with a
22,000 square building g the southern property line and

proposes to install a 70 by 205 foot building on the northern
line, expand the existing parking

general area a 20 foot wide storm sewer easement should be
provided along the drainage ditch that borders the property
on the north and west. This easement shall be centered over
• the existing ditch and that portion of the easement that
lies within the subject property should be conveyed to the ;
City for future construction and maintenance.
c. Since the drainage problems in the area may need to be dealt
with in a comprehensive manner in the future, a
non-remonstrance agreement should be required.
d. Connection of. the new building to public sewer will be
required.
The Building Inspection Office notes that the existing structure does
not meet building and fire codes. Any. additions • to this building will
require bringing the entire structure into conformance. The new
building will require a fire, wall if its setback is less than 20 feet.
The Washington County Fire District No. 1 has no objection to the
proposal. Any future remodeling should be reviewed by the City and Fire
District.

B. ANALYSIS AND CONCLUSION
The proposed development is consistent with City Code requirements for
uses permitted, setback, height, landscaped area, parking, and vision
clearance. The two modification to the site plan that will be. required
relate to access drives, landscaping, and the drainage easement. ,.
1. Access
The City standard for driveways with 90° parking in 24 feet, the
site plan indicates a driveway width of 23 feet. It should be
noted that 25% of the spaces may be designated for compacts with
•
parking space dlmensigns of 8.5� and 15 feet. This may help in
providing t. he additional width n.

driveways.
2. Landscaping

ro The site plan. indicates a landscaped area of 15%, which is
consistent with the requirements of the I-L zone. However, the
proposed type and location of the vegetation must be modified as
follows

a. Street trees are required along the street frontage with '
• spacing dependent upon the mature size of the tree. If
flowering plums are used as indicated on the plan, a maximum
distance of: 20 feet between trees is necessary.
b. Screening is also to be provided between the street and .
parking lot. Additional landscaping material including . .
shrubbery will be necessary.
c. Trees are required within and around the parking area at a
ratio of one tree per seven spaces. The trees within the
parking area shall be located on landscaped islands that are
a minimum of 3 feet in width.
3. Drainage
In order to convey a portion of the storm sewer easement noted

above under the agency comments, the building location may require
some adjustment.
C. DECISION
The Planning Director approves SD n 5 5
subject to the following
conditions:
1. UNLESS OTHERWISE NOTED, ALL CONDITIONS SHALL BE MET PRIOR TO
ISSUANCE OF BUILDING PERMITS.
2. All necessary permits shall be obtained ' from the State Highway
Division
3. Public sewer facilities shall be available to the, proposed
building.
4. A public storm sewer easement with a width acceptable to the City
Engineer shall be provided along the northern and western property,
lines. (EASEMENT FORM ENCLOSED). '

have no stipulations to the application. The only request that we would

Department, City of Tigard, and Washington County Fire District No. 1
