Two of the ten conditions of approval pertained; to storm drainage. The conditions are cited N below followed by an explanation of the intent of the condition, 2. A private drainage easement shall be recorded by the applicant for the relocation of drainage facilities in Tax Lot 501, prior to occupancy of ` the new additions. The property involved consisted of two tax lots under separate ownership (T,L, l 500 and 501) , The development- was proposed to occur on the southern parcel i L. 500) and the relocation of an existing drainage ditch was i �_� ) l g proposed for the northern parcel (T.L, 501) . because all work was initiated by the owner a of T,L, 500, an easement to relocate the drainage facility on T.L. 501 was required. 4 - d It was noted in the staff report, that since the two parcels were not approved by the City, they did not constitute legally separate parcels, The parcels were then combined into one ownership, Subsequently, the easement wasl ne longer necessary because all construction was occurring on a single property. a. Development Review SDR 14-85 Apparently the second element of the condition, requiring a drainage easement, has not been complied with. Based upon the facts as we know them at this point, I see no evidence that the City waived or modified the drainage easement requirement. I do • not understand the approval of a different location to carry with it any waiver of the drainage easement requirement. In any case, the waiver of such a critical element of the approval, without at least a substantial equivalent being provided, could not have been achieved at staff level. Based upon what we know at this point, the conclusion I reach is that the condition has not yet been complied with and, therefore, the occupancy could be made subject to revocation. CONCLUSION It is my arisen n the context t ,. of an application by understanding an upstream property s owner for approval of a project.e The project would require uire drainage easement . q the dra�nag�tea� ° use of t which the City imposed on Roger's Madhinery Company. appears to me that this type of request was anticipated by the City when it imposed a t to�c�an�l se easement requirement.
