The stairs and handrails would not just be expensive, but also not as visually attractive as the landscaping which would replace them. When comparing the stairs to the landscaping opti on,, the stairs would, be potentially more unsafe, more expensive, and not as attractive. The one consulation being that these stairs would see only limited use and thus the safety question is not as critical . The property is zoned I-P (Industrial Park) and is located southwest of the SW Upper Boones Ferry Road and SW 72nd Avenue intersection, Tigard (Wash. Co. Tax Map 2S1 l2DC, Tax Lots 700, 800, 900 and 1000). The findings and conclusions on which the Director, based his decision are as noted below. ,' A. FINDING OF FACT 1. Background Y During the Comprehensive Plan and Zoning amendment process, the subject property was rezoned from I-L , (Light Industrial) to I-P (Industrial Park).' 2. Vicinity, Information All surrounding properties are zoned I-L (Light Industrial),, Industrial uses exist to the south and east. A service station with two driveways onto 72nd Avenue is on' the southeast corner of Upper Boones Ferry Road (Carmen Drive) and 72nd Avenue. Undeveloped land is .{� � � � velb 's immediately north and west of the site. , 3. Site Information and Proposal Description p ' A 25i250 square foot office/retail center consistent with the uses allowed in the I-P zone is proposed. The 72nd Avenue street improvements have been completed, however, a 5-foot wide sidewalk is required along the street frontage. , b. There are three driveways on the opposite side of 72nd 1 • Avenue. The southern driveway for this project should be located directly across from the driveway g that serves Oregon Business Park I and the northern access should be as far to the south as possible and directly across from one of the existing driveways for the service station "A 1• c. Water runoff will not effect City facilities since the land slopes away from the road. The applicant will need to make arrangements with down slope property owners to accommodate the runoff from this site. • d. If a boundary survey has or will be done for this `property, a copy should be submitted to the Division. The Building Inspection Office states chat the method of disposing of storm water should be reviewed. The Tualatin Rural Fire Protection District indicates that the driveway turning radius for the 90" turn located at the northwest corner of the property is too small.P P Y 1 This area,should be modifi,.a so the inside and outside turning radii are 32 and 50 feet, . respectively. The driveways should be relocated as recommended by the Engineering Division to correspond with existing driveways on the other side, of 72nd Avenue. 3. CARMAN CENTER SITE DEVELOPMENT REVIEW Acting as representative for George H. Killian, we would like to present for your approval the development of a 27,350 square foot building at the intersection of.S.W. Carman Drive and S.W. 72nd Avenue in the city of Tigard. The intent of this development is to provide complimentary commercial stores that would support `. the growing light manufacturing and industrial uses in the immediate area. The projected uses of this center are in direct conformance with those uses outlined , in the I-P zone. Businesses in this building will be service oriented and thus have no detrimental . effects on the neighboring properties. Its clean commercial uses will emit no odors, smoke vibrations, or other types of off-site impacts. The proposed site development we feel offers the best utilization of the property. Because the building is set back away from the road, we were able to provide a low grass berm and substantial landscaping. This combination elps to soften the building and reduce its mass as perceived from the street. The two curb cuts proposed will minimize traffic conflicts and provide smooth and clear access to and egress from this project. They are necessary to insure smooth on-site circulation and thus a requirement for the economic viability of the development. Indicated building materials were chosen for their warmth and durability, to insure a quality project for years to come. Signage will be mounted to the P E "Dryvit" surface as shown on the enclosed building perspective. These signs will be 2'-0", high by their required length, and will be back lit cabinets. The variance request, is to increase our allowable areas for convenience stores and eating and drinking establishments from the present limit of 10%. It is our belief that the 27,350 square foot building shown is the maximum area that can be developed on this property. Due to current competition, it is necessary to provide a parking ratio higher than the minimum required by code and thus limiting the maximum square footage of a building. With the constraints of a limited site area and required parking the maximum area . presently allowable for a convenience store or an eating and drinking establishment is 2,735 square feet. a A convenience store today requires approximately 3500 square feet to provide the necessary space and goods to attract customers. The same argument holds true for eating and drinking establishments who would like to locate in this project because of its location, but would be prohibited by the limited space. To permit a viable business in today's market, our research indicates that we request a variance to increase the allowable percentage to 15% for convenience stores and 20% for eating and drinking establishments. The variance will not ue detrimental to the purposes of the Comprehensive Plan and is necessary only because the property allowed for a building of limited size. The property is ideally located to meet'the demands for such services by the surrounding area and would be, a positive contribution to this community.
