COMMENT UPON WHICH DECISION IS BASED The Decision was based in part on a comment by the city engineer that Puget should be required to dedicate a five foot right-of-way and provide standard half-street improvements. INCORRECT NATURE J;URE OF THAT HA COMMENT Such a comment is inconsistent with the provisions • of CDC Section 18.3_64 . 030 (hereinafter "Ordinance" ) which clearly contemplate that street improvements should not be required when unnecessary. In the • q y.� present ' case ;the required dedication and half-street improvements are unduly burdensome, '', and are completely unnecessary on account of the absence of any similar improvements in the area and the high probability that such improvements would not benefit anyone. If Puget is required to place curbs, gutters and lights on ,Bonita Road and 74th Avenue, it will be one (• of the first property owners to d o so along the entire length th ' of either road. Bonita Road extends approximately from Lake , Oswego through Tigard. Along its entire length, there exist feet of sidewalk. The roadway only about 125 Y has curbs in • only a very .limited number of locations . 74th Avenue ,is not flanked by sidewalks or curbs at any point in its entire length. Additionally, street improvement in the form of widening Bonita Road or dedicating additional right-of-way makes no sense at this time. The bridge which carries Bonita Road across Fanno Creek near the west side of Puget' s property • is narrower than the, existing roadway. According to information available to Puget, there are no ,'plans' to widen this bridge. i Any widening seems e xtremel y unlikely in light of the fact is n Fanno Creek which that the bridge i� the only one crossing e , meets existing construction standards. This bridge will therefore likely be the, last of those bridges crossing the creek to • be widened. The city engineer' s comment, part of the information on which ' the Decision was based, is therefore erroneous. It is clear that immediate improvements and dedication of right-of-way P s , should not be required as a condition of site development approval. NEW INFORMATION RELEVANT TO DECISION During the application process, Puget indicated to enter a nonremonstrance that it would be willing� f. e�,te agreement. The decision not to accept that agreement in lieu of present improvements,was apparently based on the doubts of the city attorney that such an agreement would be enforceable. During the appeal period, new information regarding • a guaranty of fu ture improvements has become available. Supplemental landscaping work is proposed along the north and west side of the new addition. The street trees and other plantings shown on the north side of the building conform with the Code requirements. The landscaping and Screening chapter of the Code (18.100) requires development in an I-P zone to provide a 20 foot wide landscaped buffer area with screening when adjacent to an R-12 zone. The Fanno Creek floodplain will provide a natural buffer greater than 40 feet in width. A sight obscuring fence or hedge is required by the Code to fulfill the /J screening requirements. However, Section 18.100.080 A. 4. f. allows for alternative solutions to comply with the screening requirements. The amendment to the landscaping plan (to provide additional willow trees) suggested by the NPO and the applicant appears to be a suitable approach. t: Since a portion of the development will occupy the southern lot (TEL. 900), this parcel will also be included in right-of-way dedication and half street improvement requirement vote by the Engineering Division. Two options are available to the applicant if these conditions are not to apply to Tax tot 900.
