I received a phone call from Ralph. Furter. Last weep. attempted to explain how the Park Street project e volved and • how we attempted to satisfy the desires of the T.P.O. as well as other concerned Parties. Evidentally I did not satisfy Mr. Ftrrer's concerns, however I' will explain to you essentially what I told him. Regarding the fencing on School Street, there was a discussion h directly relating to the fencing of the School Street property line at the T.P.O. meeting, however it w6ts not the consensus of r requirement for our development. It -the grow that this be a requ me r. School P P was decided that since there are no doors at the School Street side of the Schucks building, the building itself would act as a fence ,„ovided the area behind building dng he fenced to p revent students from loitering behind t hestractnre. This fencing was developed as shown to the N.P.O. group and was addressed in Mr. Sleds se's N.P.O. summary letter to the staff (third to last sentence) which. Patrick Futter, attorney evidentally missed. • r At the time the deceleration. lane was discussed this site had• two access/egress drives to Pacific Highway. We attempted to work in a+ deceleration by eration lane as suggested b the W.P.O. group. y The solutions were not acceptable either to us, to aft or to g the State Highway Department whioh ' had ultimate jurisdiction. One reason cited was that it created too long a deceleration ;\. lane when combined with the existing one at School Street. It created, in fact, an additional trffic lane and would have resulted in .riimal deceleration. This would have created a greater hazzard at School Street.' The compromise was to illiminate one of our access drives to Pacific Highway, widen • « k i, • • the one remaining drive to forty feet which allowed us to add one additional egress lane, then to provide access from School Street utilizing the deceleration lane which already existed. To us this made sense. This solution took into accouz,.t the concern for deceleration voiced by the N.P.O.' satisfied the staffs concern Highway Department's rn and the �Si hw D a e artment s as well. We did not attempt to ignore the problem in any sense. This was reviewed and approved by staff. .Incidentally the N.P.O. group could have had access to the site plan at any time they desired, a copy from staff. We provided additional sets. The N.P.Q. in fact had a final review of the' project at a regularly scheduled meeting before the building permit was issued. At that time they did review the final copy . of the site plan. Although several issues were raised regarding access to Grant and Park Streets (relating to an appeal by L1.13. . ishop) no issues was raised concerning the planned access/egress from Pacific Highway. In my telephone conversation I related to Ralph Furrer that the power pole near School Street was scheduled to be removed as part of the construction project. Evidentally Ralph Furrer did not pass that information to Patrick Furrer. The City staff did not ignore the N.13.0, information as stated by Patrick Furrer. The staff did what they should have to provide a feasable solution to all concerned. Not only was they N.P.0. to be heard, consideration was given to the Highway Department, the Owner and our irdpesi opinion es atones ,•��.1llrouNS solution is developed on one groups v groups are heard and presumably the best of each go into making the final decision. Ash Ave a • Tigard, Oregon 97223 i ' RE: SDR 17-83 - APPEAL OF SITE DESIGN REVIEW • y Dear Members of the Tigard Planning Commission: On March 16th at approximately 11 p.m. two Appeals were filed with the police department objecting to portions of the city's approval of the site design review for the Park Street Square f project at Park and Pacific Highway. We raise the question about the validity of the two appeals due to the method of filing and (}' the untimeliness of the appeals. It is our understanding that business matters pertaining to • planning uses are to be filed with the city recorder. This presumably means by the closing of city offices of the day of the appeal. Because the two appeals were filed pp PP with the wrong agency _w t and at the 11Th hour we feel they are invalid. You would not be allowed to file' for public office after the closing hour, for in- stance, by filing with the city ,police department or the Tigard Water Bureau, nor do you pay your traffic tickets at the fire department just because the police department is closed. I question whether, as a member, he can have come from N.P.O.##3. Mr. Bishop knew of the existence of the Grant street service drive in October but chose to wait beyond the final hour of the final day of the 10-day appeal period in March,. nearly five months after he saw our proposal, to register his r: g concern. School. j' Street is a major access tolboth an elementary school and a pre-school, is not a standard street (single lane in places) , and is used by young children as a , pedestrian route to both facilities. Locating an entrance/exit as currently planned would, in our opinion, create an unsafe condition both for, children and vehicles. Secondly, those unsafe conditions would appear to be compounded by the fI close proximity of the entrance/exit to S.W. Pacific Highway. Finally, with an Ii L entrance/exit on S.W. The uses 'proposed 'are consistent with those allowed in the C-G zone and the building setbacks from Pacific Highway are appropriate. The landscaping plan submitted does not indicate a sufficient number of , street trees as provided in Section 18.100.035. A 6-foot high fence along with a 5 to 10-foot wide landscaped buffer on the back off the g project. City Code requires . a minimum width for the landscaped buffer , of 10 feet. The visual clearance areas for both driveways onto Pacific Highway are proposed to ' contain signs and vegetation. The Code prohibits obstructions over three feet in height except for utility poles and trees without branches below eight. feet. T he proposed plan is in conformance with P arking g and access standards except for bicycle parking. A minimum of 5 se c ure d bicycle rack spaces should be provided.
