NOYT STREET PORTLAND, OREGON 97209 (503) 222-4402 FROM: Ed Sullivan, City Attorney RE: Tigard School District -- Possible Litigation I was asked to check into the possibility of some difficulties perceived by the Tigard School District in dedicating certain land connection with the construction of a new • n c,on w n - to the City of Tigard '. auditorium at the Tigard High School site. As I understand it, the difficulty related to, the dedication of land on either or both • - - S. W. 92nd Avenue and S. W. Durham Road and the signing of a non- remonstrance agreement for the construction of either or both of those roads. On Friday, October 9 , 1981,°'I, spoke with Fred Anderson, who I thought to be the attorney for the District. Mr. Anderson indi- cated that most of the legal work for the District had been transfered to the Mille Anderson firm and that he was not advising • the District on this matter. He was uncharacteristically vague in his recollection of the dedication and waiver of remonstrance problems, but did suggest that I call Pete Taylor, an employee of l who handles new construction and other related the school district w ens - Lion an t matters. 4 ' I spoke Mr. Ta y for in th e afternoon of the 9th about this matter. He indicated that the had requested an evaluation from legal counsel of the District' s rights and responsibilities vis-a- vis the city in this matter. Mr. Taylor indicated that, regarding the senior high school site near Durham Road, he hEd the question as to whether or not the present school board could bind future , boards with regard to the dedication and the waiver of remonstrance. I, indicated to him that, while he certainly could received his own counsel, I, would probably advise the city the prohibition against 1 bindin g future legislative agencies applied only to regulatory ulato ry functions, rather than proprietary functions. Mr. Tay lor also indicated, that the District would attempt to see What could be done about waiving the requirements on the sewer charges, dedica- tion, and the nonremonstrance agreement on both the senior high site and Fowler Junior High site on which there is proposed d ler e ` op to be further improvements, necessitating a further conditional use permit.
