Johnson St., at mid-point, and running northeasterly to Fanno Creek) is inadequate. Further, said facility is hot even a public drain line. Secondly, it is also apparent that any addition of hard surface (roof, asphaltic concrete, etc.) on the St. Anthony tract will contribute, to the aformentioned problem. ' He stated they were prepared to meet some municipal improvements, however was overwhelmed with the sco a that was requested by Planning Director. • Lengthy discussion' followed between Commissioners, Staff and Applicant regarding the LID processs, the use of an non remonstrance agreement, necessity of improvement or half-street improvements at the present time. • Planning Director commented his calculation were approximately 75 to 100 r thousands dollars and questioned how Mr. Nicholson arrived at his figures. 9 Commissioner Moen reviewed the streets needing improvement; noting, the main difference between the Church and City's proposal was the time of improvement to S.W. The budget available from sources ce� for the building and municipal improvements is very close to $400,000. Construction bids for Phase 1 ranged from over $450,000 to below $390,000 for the project as submitted for review. It is estimated, using the figures supplied by the Tigard City Planning Director, that cost of the half street improvements by LID, as demanded by the Director, to include S.W. Johnson, S.W. Grant and S.W. McKenzie, including curbs, sidewalks, storm sewers and widened to standard streets, would be approximately' $235,000. On February 3, 1982, St. Anthony's Parish filed an appeal to conditions of the Site Design Review approval. Specifically, the applicant agrees to the con- dition to form an L.T.D. to improve McKenzie Street but feels public improvement . requirements to SW Grant and SW Johnson are excessive. Under the process set forth under Section 18.84 of the Tigard Municipal Code, • all appeals of a decision made by the Planning Director are heard by the Plan- ning Commission. The policy of requiring street improvements at the time of development is a City Council initiated policy. 's on McKenzie, Grant, and Johnson Streets wil be a foregone conclusion if the applicant petitions since the applicant itself controls the ,, geographical majority of the affected adjacent property owners such that opposition under the ordinance would be ineffective to bar the formation of the L.I.D. The normal use of the projected Kelly Center will occur during a time when the church building is not in use. As a public meeting center, groups will schedule events at times other than at present peak traffic load times and not in conflict with present peak on-property parking. Parking and street use is thus not a serious consideration. The applicant, however, recognizes the desirability of some municipal improvements and, within its financial 'capabilities, is willing to perform all reasonable conditions. Obviousl y, elimination of ingress ngress and egress to the school ' , from 99W bares no relationship to the project submitted and is a detriment, to any future use of the, land adjacent to the hicthway. The architect responded in writing on September 24, 1981; The Planning Director approved the Site Design Review with conditions relating to: 1. elimination of 99W ingress/egress as approved by Public Works • Directory 2. petition to form L.I.D. on McKenzie, Grant and Johnson, or if i , L.I.D. is unsuccessful, to make half-street improvements on McKenzie and Grant, and sign non--remonstrance agreement on L.T.D. for Johnson and 99W 3. parking; 4. no Occupancy Permits will be issued until conditions are satisfied; 5. changer, to specifications to be approved in writing; 6. grading plan; 7. underground utilities; . 8 non-remonstrance agreements to be recorded with County; 9. parking to be paved; 10 no minor land partitions; 11. dedicate rights-of-way. On October 14, 1981, Mr. George Frye, Committee Chairman, requested a "working session with the City Council on October 19,' 1981:" Council agendas did not r permit the matter to be scheduled until the November 23, 1981 Council meetitng.
