This letter follows our discussion of Friday, November 18, 1983, regarding the
. nonconforming use status of the light industri-4 uses in our Security Storage facility. ,

By this letter I am requesting, 'pursuant to Section 18.132.040(D)(2) of the newly •
adopted Tigard code, that certain portions of the Security Storage facility (the name .
will soon be changed to Burnham Light Industrial and Storage) be registered under .,

the light industrial use classification in conformance with Tigard Code Section
. ,, •,. 18.132.040(D)(3).
Attached please find a site plan drawn by Dale B. Haller entitled "Tigard Warehouse
Development". Since the plan does not contain a date on it, I have written in the
date of 11-22-83. The date I have wri tten on the plan is for identification purposes
, ..,., only in as much as the plan was originally drawn some time in the early seventies,
probably prior to 1973. The portion of the Burnham property development which is
the subject of this nonconforming use registration request is that building depicted
on the plan as E and F. The plan contains three buildings; the first A and B, the
second C and D, and the third E and F. It is the E and F building which is the
subject of this request.

. . More specifically, the request is pursuant to Section 18.132.040(D)(2)(c), for a use
.., classification of light industrial for the above identified building E and F. In support
of this request I am enclosing a list of companies and their businesses that were
using building E and F as of 3-16-83. This list, three pages of legal size paper, is
attached as Exhibit "5" and by this reference incorporated herein. You will note that
all the uses that existed as of 3-16-83 fall within the use classification of light
industrial under the existing Tigard City Code. You might also note that on the list
you will see a partial address for each company in that its door number is identified
as building E door 1, building F door 2, etc.. Those identification numbers are for

convenience only since pursuant o Section 18.132.040(D)(2)(b) any nonconforming use

may be extended throughout any existing parts of a building which was manifestly
• arranged or designed for such use as of March 16, 1983, but no such use shall be
extended to occupy any land outside such building except as is permitted by
18.132.0400)(2)(e)".

October 28, 1980, the Planning Commission approved Robert Randall''Company's
request for a Sensitive Lands Permit to alter the 100-year floodplain along
Fanno Creek by the addition of approximately seventy (70) cubic yards of fill
x on 4,000 square feet to the rear of two existing warehouses.
SITE PLAN AND DESIGN REVIEW:
Staff recommends approval of Site Design Review, SDR 32-80, with t he
following conditions:
1. A letter of approval from the Tualatin Rural Fire Protection District
Fire Marshall be submitted clearly indicating that the emergency vehicle
maneuvering areas to the rear (south) of these buildings are adequate.
Plan to,be changed to satisfy Fire Marshall.
2. All co itions of M 7-80 shall be met as appropriate.
