I reviewed the 1973 land use file for the above named property owned by Gerald f W. Crow. In 1973 .a conditional use approval was granted by the City (CU 2-73) to allow warehousing in a M--4, Industrial Park, zone. Since that time, the . ' building has been occupied by industrial uses, most, recently Tektronix. Mr. Crow has advised me that Tektronix used the facility for warehousing and storage as well as assembly work in almost equal portions. Your proposed use appears to be more similar to the original intent of the conditional use. Therefore, I i have determined that your use would be categorized as a conditional use allowed • under the existing approval granted in 1973. No new land use application is .. ; required at this time, however, consistent with the Tigard Community Development Code, any expansion or alteration will require an application and either site r • � �," development review or a new conditional use,. •. During our telephone conversation today, ' I mentioned that the City desires to . have you execute a non-remonstrance agreement for street improvements' related to ` '- the site. A consent covenant was completes in September 1973 which runa for fifteen years waiving opposition to participation in a street local improvement ~ district. It may be beneficial to you now to voluntarily sign a new agreenmwent, . with no deadline, rather than wait until further development of the sits:+ is planned. Bruce Clark sent you a letter dated September 5, 1973 iu. which he stated that you would have to return before the Planning Commission for any future . development. In reviewing your present proposal under the existing Code, you are required to appear before the Planning Commission as a Planned Development Um) due to. development proposed within the 100 year floodplain. I am returning your Site Design Review Fee. Enclosed you will find an application for a Planned Unit Development and Sensitive Lands Permit. Please complete .these applications and return to me by February 9, 1981 for•A 0 a Planning Commission meeting on March 3, 1981, will draft a Staff Report for your review prior to this meeting. My Staff Report will recommend denial of your proposal. The Planning Commission has been very restrictive concerning use of the floodplain , The A . Park Board and the City Council have designated the floodplain from Main Street to Hall 'Boulevard as a park. To allow a large parking lot right in the middle of this proposed park does not seem realistic. Your proposed warehouse would require about.twenty (20) parking Spa' s. YoUr existing building requires the same. At the present time, you have approximately one-hundred (100) parking spaces. Perhaps you would compromise the proposedone-hundred (100) spaces in the floodplain. Your original Conditional Use was for warehousing. You have increased your need for parking because you are now manufacturing electronic components and have • employees. A review of the record doeS not suggest that this use was mentioned originally.
