I reviewed the 1973 land use file for the above named property owned by Gerald
f W. Crow. In 1973 .a conditional use approval was granted by the City (CU 2-73)
to allow warehousing in a M--4, Industrial Park, zone. Since that time, the .
' building has been occupied by industrial uses, most, recently Tektronix. Mr.
Crow has advised me that Tektronix used the facility for warehousing and storage
as well as assembly work in almost equal portions. Your proposed use appears to
be more similar to the original intent of the conditional use. Therefore, I
i have determined that your use would be categorized as a conditional use allowed

under the existing approval granted in 1973. No new land use application is
.. ; required at this time, however, consistent with the Tigard Community Development
Code, any expansion or alteration will require an application and either site r

During our telephone conversation today, ' I mentioned that the City desires to .
have you execute a non-remonstrance agreement for street improvements' related to
` '- the site. A consent covenant was completes in September 1973 which runa for
fifteen years waiving opposition to participation in a street local improvement
~ district. It may be beneficial to you now to voluntarily sign a new agreenmwent,
. with no deadline, rather than wait until further development of the sits:+ is
planned. The opportunity to sign a non-remonstrance may not be available after
i." the existing agreement expires should you wish to build an additional Structure ' •

on the site. At that time, half street improvement could be required prior to
. , occupancy.
I have enclosed a copy e f the City's non-remonstrance agreement form as well as .
q the 1973 agreement now binding on the property. A copy of the conditional use
appro'al is enclosed which references right of way dedicated for Burnham Street
. and Ash Avenue. Mr. (1-a has stated that the City agreed to pay for land

Dear Mr. Crow:
Apparently we need to re-focus our approach. I reviewed your past files.
Bruce Clark sent you a letter dated September 5, 1973 iu. which he stated that
you would have to return before the Planning Commission for any future
. development. In reviewing your present proposal under the existing Code,
you are required to appear before the Planning Commission as a Planned
Development Um) due to. development proposed within the 100 year floodplain.
I am returning your Site Design Review Fee. Enclosed you will find an
application for a Planned Unit Development and Sensitive Lands Permit.
Please complete .these applications and return to me by February 9, 1981 for•A 0 a Planning Commission meeting on March 3, 1981,
will draft a Staff Report for your review prior to this meeting. My
Staff Report will recommend denial of your proposal. The Planning
Commission has been very restrictive concerning use of the floodplain , The
A . Park Board and the City Council have designated the floodplain from Main
Street to Hall 'Boulevard as a park. To allow a large parking lot right in
the middle of this proposed park does not seem realistic.
Your proposed warehouse would require about.twenty (20) parking Spa' s.
YoUr existing building requires the same. At the present time, you have
approximately one-hundred (100) parking spaces. Perhaps you would compromise
the proposedone-hundred (100) spaces in the floodplain. Your original
Conditional Use was for warehousing. You have increased your need for
parking because you are now manufacturing electronic components and have
• employees. A review of the record doeS not suggest that this use was mentioned
originally. To Construct another "warehouse to be uSed for manufacturing

will allow is for you to bring your case before the Planning Commission.

You have presented roe with a very difficult situation As you :kmow, the . E
Park Board has plans for the floodplain along Vann° Creek between Main
and Mall. A portion, of the proposal park includes your proposal parking j
: lot. Without adequate parking you would be unable to construct a new , r�'
building.

The Planning Commission has appro•ved..activity.wi•thin the 100 year floodplain
in certain,,,ver( limited, instances. I doubt••that in this case that
they will allow you to.use any portion'of the' floodplain. If by chance
the Planning Commission should-,-the city Council would reverse their
decision, and you knew' the Park Board will scream.
• My suggestion is that we all wait and see what happens with City Council
in November, the« Urban Renewal Agency formation, the Park Board allocation
of funds, and the Ash Street' issue.' All of these things will come together
by January 1, 1981. I still think. we can trade parking on the Public �.
Works area for floodplain/park in the near future.
At this time my Staff Report would deny your«request for Phase II and
