This letter is a request for you to consider de&.cation of a portion of
your land on Durham Road. Washington County has requested that Tigard assume ',
the responsibility of this roach Council will consider this request very
soon and will probably grant the County's request.
Our plans call for the widening of Durham to collector street standards
with a planted median strip and turn-out lanes This will take place as
development takes place. At the present time the Summerfield Commercial ,,
Center is being constructed across the street from your property. To serve
this development, we have planned a turn-out lane to Summerfield Drive,,
The difficulty with this plan is that we need a portion of your land to
allow construction of a thru-traffic lane to move east-bound traffic on
Durl am Road.
An inspection of your property revealed a problew with the trees along
your property line. We require 45' from the center line for a dedicated
right-of-way. Our policy iS to return your property to the condition we
found it in or better. Moving the trees is possible.
If. I could I would like to suggest some alternatives to you. The City
is not a heartless land grabbing creature, we are a realistic entity experiencing
growth at a rapid. rate, In the future, you will no doubt develop your five.

We are in dire and immediate need of a letter from the city
stating that the 1979 ;approval by Aldie Howard for the retirement

h.r reference to ORD 73-5, Exhibit C; paragraph 3 (which approved the
Summerfield PD) stating that each phase of the development shall F' .
be reviewed and approved by the P a nincL Commi ss ion, I'm not r
r . sure why Aldie didn' t follow this procedt.re, but the record shows
that this phase, and others, were administratively approved by
Aldie. . Since these developments are now in place, i t. is my
,,. opinion that any procedural glitch is harmless error and the
city's decision by Aldie approving this 150 unit development ie
• final and enforceable
I have prepared a letter that I believe will satisfy the
lender, If this is acceptable, please execute it and fax a copy •
to me at 221-1510,
