The application is denied for the following reasons: h' 1. The proposed building lies in the flood ,plain as determined r` by the City of Tigard's.flood plain map. The Tigard Munici- pal Code, Section 18.57.040, prohibits permanent structures and any other structures which would significantly impede or ixiterer with the flow of flood wavers to be located in the flood plain. 2. The information regarding elevations and flood plin levels contained in Columbia Hardwood Flood Plain Analysis by Robert Meyer, is based on illegal fill placed in the flood plain counter to the Tigard Flood Plain Ordinance. The Tigard Municipal Code, Section 18,57„040 prohibits filling in the flood plain or any change in topography or terrain which would have a substantial tendency to change the flow of waters during a flooding period or which would increase flood hazard or alter the direction or velocity of the flood water flow. 3. The submitted plans make no provision for landscaping of the proposed development. Main Street - Tigard, Oregon April 13, 1979 t 0 ' Docket: SDR 19-79 - Columbia Hardwood Yr Applicant: Columbia Hardwood and Moulding Company r Request: For site plan and architectural review of a proposed 35,125 sq. ft. • lumber storage building. Location: S.E. Portion of Tax Lot 600, Tax Map 261-1 at 12700 S.W. Hail Blvd. Site Designation: The site is zoned M-3 and designated open space and Light industrial on the NPO 5 plan. Site Description: The site is mostly flood plain which has been filled, Proposed Use Lumber storage Previous Action: SDR 38-77 - On October 24, 1977 the Planning Department approved the site plan and architectural review of a 15,400 sq. ft. storage building at 12700 S.W. Hall Blvd. subject to the following condition: 1. Existing landscaping be upgraded and maintained. Required Parking: 35,125 sq. ft. 1000 = 35 spaces required Site Plan and Architectural Review: The applicant is proposing to construct a 35,125 sq. ft. lumber storage building on the S.E. portion of the land located at 12700 S.W. Hall Boulevard. The remainder of the site is already developed as the Columbia Hardwood and Moulding Company. More than half of the proposed site lies in the floodplain as determined by City of Tigard flood plain maps. The applicant has submitted a a. report by Robert Meyer Consultaits disputing the flood plain level. The Meyer report shows the flood plain level to be located much closer to the S.E. lot line. A site inspection revealed that the flood plain had been filled, thus changing tha ea'.evation and topography of the land. The filling nearly destroys any retention capability on the N.B• side of the adjacent railroad embanl,ment, encroaches upon the natural , drainageway and threatens to adversely affect the rights of adjacent property owners and the community as a whole. For purposes of this chapter, the following words and phrases shall be construed to have the specific meanings assigned to them by definition as follows : . (I) "Fill" means any act by which earths sand, gravel, , rock or any other, similar material is deposited, placed, ,� - pulled or transported and includes the conditions resulting therefrom. (2) "Flood" means a temporary rise in stream flow or stage that results i . water overtopping stream banks and inundating land adjacent the normal flow of water through the stream channel. (3) "Flood hazard" means an immediate danger to prop-- erty or health as the result of inundation of the flood.- ' �� plain. i (4) "Floodplain" means the relatively flat area or lowlands adjoining the channel of a river, stream, water- course or other body of water which has been'or may be covered by floodwaters Within the area of applicability defined in the floodplain district. " Those elevations I y; depicted on the i-oodplain series maps are based on mean �k sea level datum and their locations are an indication of the surface elevations at that location. 1 (7) "Obstruction" means any dam, wall, embankment, levee, dike, pile, abutment, projection, excavation, ,h channel modification, bridge, conduit, culvert, building, " gravel, refuse, fill, structure or matter in, along, or across or projecting into any channel, watercourse, or . floodplain area which may impede, retard or change the direction of the flow of water, either in itself or by catching or collecting debris carried by such water, or that is placed where the flow of water might carry the same downstream to the damage of health or property. (8) "Regulatory flood" means the flood used to define the outer boundary lines of the FP district; the maximum flood predicted to occur within each one hundred years . (9) "Structure" means human built or constructed structure or edifice or building of any kind, or any art!- . ficilly built up or composition of physical part.; adjoined .together. (Ord., 78-10 §5, 1978; Ord. 74-50A §1 (part). , 1974) . 18. 5 7.030 Peimitted uses . The following uses by their nature do not threaten substantial obstruction of , water flow in the floodplain and do not impair the water storage capacity of the floodplain and shall be permitted within the floodplain district subject to the limitations w1"'` in this section stated: y+',y (1) Off-street parking and maneuvering areas, access ways and service drives located on the ground surface. Ex- cavation, grading and paving may occur to construct said facilities; however, no fill shall be allowed for construc- tion of said facilities other than gravel for a paving base • and only an amount gravel commensurate with city con- struction standards for said facilities shall be allowed; (2) Accessory residential uses such as lawns, gardens or planting areas not causing substantial obstructions to floodwaters and including fences designed to minimize the obstruction of floodwaters and flood-carried debris; (3) Roadways, bridges or utility structures designed to not significantly impede the flow of floodwaters; (4) Agricultural uses conducted without locating a structure in the FP district including a boundary fence designed to minimize the obstruction of floodwaters and flood carried debris; (5) Recreational uses such as bicycle and pedestrian paths, archery range, athletic field or parks .
