Dear Mr. Krause:
Mr. Anderson provided a copy of the easement granted by Fred Meyer to Gulf
Oil Company. We have reviewed this document and find that it has nothing to
do with the situation i.e. , our request that you provide a right turn only
out of the southern portion of your parking lot.
It is possible for you to landscape the area, from the corner of the Les
Schaub Tire Center to the sidewalk on 99W. just to the north you could
provide a right turn only lane to 99W. My intent is to eliminate entry to
the parking lot at this location.
We are considering a re-alignment of 72nd Avenue which would create a four
k, way intersection at this southern location. (Please look at the enclosed
°'
map.) Tax Lot 2600 is vacant at this time, but will develop soon. If
d t, we were able to do this, it would mean that the traffic light presently
serving your main entrance would be shifted south. I am mentioning this
now so that you realize that this proposed right turn lane to 99W is temporary.
A major development is in the near future and we need to consider its
ramifications now and plan addordaaigly.
Please re-submit a plan showing a right turn lane onto 99W from the southern
portion of your parking lot. Add 'a landscaped area to coincide with yriur;
proposal.

2. That landscaped area immediately south of main ingress/egress point
be continuous, north to prohibit all traffic entry. This will form a !'

be enlarged, while still retaining the right 'turn lane as pro-

4. That the applicant agree to allow the installation of a bus
shelter on the eastern most corner of their property fronting

B. Opposition was by one party, Ms. Schubert, who owns some residential
property to the North across Spruce Street. Her objections were

1. Fred Meyer using "R" zoned property for commercial parking.
2. Nursery stuck being stored and displayed in "R" zoned lots.

3. Delivery trucks using "R" zoned lots.

4. Corner of 71st and Spruce is dangerous and Fred Meyer should
put up a stop sign at their drive.
5, Fred Meyer Employees are parking at their mail boxes and
blocking them. Fred Meyer Employes are asked by Fred Meyer

C. M . Howard made the. Staff Recommendations (see attached copy) .
D. Public portion of meeting closed. The Commission discussed the
project and it went to a vote.

AApplicant n wishes to improve and expand the home center in the Fred Meyer
Complex on 99W. Staff has determined that this complex is "Non-Conforming"
with regards to landscaping, signs, parkix. screening and entrance require-
ments off 99W.
Normally this would have to come before the Planning Commission, however, I
do not feel that the "Non-Conformance" is significant enough to warrant such
a review which would cause unnecessary delay and expense to the applicant:
Present signing regulations will require that the large sign be removed by
.� ' January 11, 1981 per Sign Ordinance 16.24.010 Tigard Municipal Code. We
/ have required additional landscaping around the home center addition and
along 99W. We have suggested improvement of the access off 99W with additional
traffic restrictions. The installation of a bus shelter at the corner of 99W
and 71st Avenue has been made a condition of this approval.
From a logical and realistic standpoint we have improved the site considerably
from w'..at is existing now. I do not think that total conformance to City
codes is possible. In reviewing this application staff considered
conformance and realized that "making the best out of what exists" was the
only realistic approach to take. Had this application been for construction
of a totally new building, then we could have required total conformance, r*
but where it was oily for a small addition to an existing structure we were
able to improve a ,;,owtion of the entire site.
If you wish to review the entire matter, we will report to the applicant
and bring them before you. However, as I have stated, r think that a, site
design review at the staff level is sufficient under these circumstances. l

Proposed Expansion of the Fred Meyer Home Improvement Center
The following is a brief description of the proposed project and its
anticipated affect on the community:
The proposal is to expand the Home Improvement Center at the Fred Meyer
Retail Store Complex, located at 11565 S.W. Pacific Highway.
The proposed change would consist of four (4) areas of work; interior
' remodeling, construction of a new Outdoor Garden Retail Sales Area, and
providing additional landscaping at various impact points throughout the "' S
'. Complex.

The interior work would consist of Moving non-structural walls, upgrading I .
finishes and adjusting department functions.
The Outdoor Garden Retail Space would consist of adding a depressed,
well screened and landscaped Retail Area of approximately 10,000 sc .ft. , 5 .
partially covered, on the upper front end of the building (Southeast
corner. ) In conjunction with this and directly behind would be a
depressed, screened, truck service dock. n;
The existing Outdoor Storage Area on the lower end (West end) would be r;
increased by only about 800 sg.f t. and would be entirely enclosed,
relating to the existing structure in appearance.

We feel this l change will meet the public need, not only by being more
convenient, but also as a, continual effort to 'up-grade the facility
and to make it more compatible with the. community.

Because of the nature of the proposal, there is no major impact on
public services. This change will be served by existing facilities.
In summary, this change in relation, .to the overall Complex is minor.
It will have no adverse effect on the surrounding area; in fact, by
upgrading the existing building and services and providing additional
landscaping at the Pacific Highway frontage, we feel it will be an
asset to the community; we hope you will, too, and request Planning
Commission approval.

I am submitting for a Minor Modification to the Conditional Use for the Canterbury
Crest Specialty In-Patient Care Facility, just off of Pacific Highway on Canterbury
Lane, The following is a response to the criteria of Section 15.130.050(13):

6. An increase in the floor area proposed for non-residential use by
more than 10% or previously specified: The existing approve, building
square footage is 18,000 square feet. We propose a 266 square foot }'
addition, which is under 10% by 1,534 square feet.
7. A reduction of more than 10% of the area reserved for common open
space and/or usable open space: There is no reduction to open space
due to the expansion. We are in-filling a Lower Level to match the foot •
print of the First Floor above.
8. A reduction of specified setback requirements by more than 20%: No
reduction of setbacks is proposed. The expansion would not encroach
into minimum required setbacks.
9. In elimination of project amenities by more than 10% were previously
specified provided such as: The proposed expansion does not reduce
recreational facilities, screening or landscaping. We will eliminate a
concrete surface on the Lower Level, which has an overhang on the First

10. A 10% increase in the approved density" This addition does not
change existing project density.
This project complies with any underline standards, minimum set-back
requirements, building height requirements, parking and landscape standards.
