Please be advised p that I am in the process of my project files , the planning staff' s files pertaining to NPO #3 meetings along with the ninutes and tapes derived from hearings in front of the planning commission and council as a part of the approval process of ZC 1-78. Additionally, I am reviewing my architectural plans, which have been stamped and approved by the building department for the "Stan Wiley" and "Pietro' s" buildings. In direct comment to your memo and query on the status of the conditions that were attached to ZC 1-78, I offer the following responses: Point #I- Examination of your records in the building department will show City approval and acceptance for the above referenced two buildings! The state highway department approved this matter along With their high- 7 way access permit process and an examination of this • process. will confirm this statement! ! Point #2- Yes , an agreement is required. I did obtain it, as part of the highway department' s policy of granting access perm' ..s. Thir ly , I am not required or directed , by ZC 1-78 to file this with the City, but, if it is ,so requested as an extraordinary procedure , I will do soi Point #4- Concrete sidewalks , installed per cod e, have been installed along the frontage of both above referenced ` ` buildings , not just the Pietro' s building as observed by • staff. This project was approved and planned to be built in stages and obviously the remaining frontage on both sides of Pietro' s is currently vacant awaiting develop- meat. As contemplated from the start of my development plans in 19771 1° will install sidewalks along Highway 99 when I begin development on these lands, as is common . practice for other landowners in Tigard • • 6 • V" w , 1. r 1 ,I ' ' . w . Point #5- The above referenced review of approval process records , which I am currently in the midst of, plus my comments to Council last Monday will suffice as my answer. �• Yes , this condition has not been met! It was and is not a condition tied to a precise date„ The half street improve- ment including sidewalks, curb, and gutter, will be accompl- ished when I develop the adjacent tax lots or when I join k' with my neighboring property owners and form an LID to 1 b up-grade both this frontage and other frontages on Park St. , both East and West of Watkins! ! J 1 R Point #7- This will be addressed in detail, in response to ,. my review of the record established as noted and previously referred to in this memo. I would though draw your attention to the wording of this condition and then upon your review of my report of my research ask for your re-examination of ' ,, Liz's .judgement that I am not in compliance on this point! ! - Point #8- Yes , site plans were submitted for the entire project and as required by City policy. All appropriate ; and mandated site design reviews have been obtained for both buildings ! When development occurs on other phases , site design review approval will be applied for in the normal manner. Point #I0- The building department is responsible for this , not the developer! ! Previous Action: On September 25, 1978 the Tigard City Council approved the General Plan and program for ZC 1-78 for a Commercial Professional Planned Development. k Parking Requirements: 1111 1 space per 100 sq. ft. of floor area 3670 '- 100 = 36.7 or 37 spaces required Site Plan and Architectural Review: , The applicant is proposing to build a 3,670 sq. ft restaurant as part of a Commercial-Professional Planned Development. The general site plait has been approved but the landscape plan, lighting and signage for the entire development have yet to be submitted and approved. They will be subject to the requirements of the under lying zone, the Planned Development District and Site Design Review. • The applicants proposal is being reviewed only for site layout and building appearance. Approval of the landscape plan, signage and lighting will come at a later datelbut prior to the issuance of an occupancy permit. The applicant is requited to have 20% of the total lot area landscaped and maintained including a 10 ft. strip of landscaping along Pacific Hwy. The present site plan does not reflect either of these requirements. The building itself is proposed as a one story pitched roof structure with °e asphalt shingles for the roof and cedar siding for the exerior wails.
