flood.
Condition #4 states that the School District work with staff, to
provide access between the Summer Lake development on the west
• property line and the p roposed p ark. Your concern regarding this
`condition was that you be able to maintain access control onto the
school property, especially during operating hours I have no
i difficulty with the provision of gates and so forth, but the intent ,
here is to permit children in the adjacent development to have
a, g, ,ess to the play fields and the park land beyond to be dedicated
' to the, City. There is no intention b_y thi,:: condition to require ' ti
the construction of a pathway across the school property.
Condition #5 states that a bond covering the cost• of improving s
Katherine Street be filed with the 'City prior to issuance of any
`; building permits . You have asked if it would be possible for
the City to waive its bond requirements because it is dealing
i with the School District and not a private business. I have
this with the City
discussed t ,y Attorne y, Joe Bailey, and he feeds. ..
that the City could permit the construction of Katherine Street
without the filing of a 'bond, but instead that there be a contractual
agreement drawn up between the City and The School District.
Sincerely,
i
