2. CALL TO AUDIENCE FOR THOSE DESIRING TO SPEAK, ON NON-AGENDA ITEMS.,
(a) J.B. Bishop, Main Street Development Limited, referred to a letter from
the City Attorney to his lawyer and himself. Legal' Counsel stated that
as Council was unaware of the contents of the letter, it was inappropriate
to discuss at this time Mr. Bishop apologized and asked Council to con-
' . firm that they will consider whether or not to hear the appeal at next
week's meeting. Mayor stated that that was possible.
3. APPROVAL OF MINUTES: April May'•ril 28 and Ma 5 9 1 8t1.

7. 72ND AVENUE INTERCHANGE - FINAL ENVIRONMENTAL ASSESSMENT
(a) City Administrator explained that a letter had been received from the •
Oregon Department of Transportation speaking to the noise impacts. It ,
stated that the State would not be willing to pay for noise mitigation
for the school, but that if the City were willing, the State would
• cooperate in obtaining the Federal Funds':

School District be allowed to comment and pay for the mitigation, but
that the City was not willing to
(c) Ron Kleinschmidt, Oregon Department of Transportation, requested that a
letter informing them of final City and School District decisions on the
noise mitigation be sent as soon as possible,

(d) On another matter, City Recorder, reported that a request had been made to
explore the possibility of arranging the 99W work in the evenings (after
the rush hour) . Mr. Kleinschmidt suggested that this should be negotiated .
through the Engineer and Contractor.
8. RESOLUTION NO. 80-39 A RESOLUTION OF THE TIGARD CITY COUNCIL REQUESTING AN
_ ANNEXATION PETITION BE FORWARDED TO THE BOUNDARY REVIEW
COMMISSION (SHORT TITLE: HALL BLVD. BAPTIST)
(a), Planning Director exRlai;ned that this was a four acre annexation applying
for` a conditional use. permit in an R-5 . zone. (for church use) . He'went
on to say that construction was nOtprojected fog' two years. He recommended
approval.
(b) Motion by Councilman Brian, seconded by Councilwoman Stimler, to approve.
