Dear Mr. Foy,

This will serve to memorialize my conversation with '''Karen" a staff member
of your firm on October 7,1980, my letter to you of April 29,1980 and at
' least 3 conversations which have occured between April and October of 1980
relative to the "deceased" landscaping located in the Gaarde Park Subdivi-
sion.
As I have previously outlined to you, several of the trees landscaped
along SW Garden Park Place and two trees located on my parcel (Lot ##5)
have expired since their initial planting during the summer of 1979
•
We apparently all agree thet the replacement of the landscaping is the res-
ponsibility of Stoneridge Development Co. The problem appears to be that
it's never the right season to replace the trees. Now that we have gone
through all four seasons, the question arises when is the right
season ??
I believe the time has arrived for Stoneridge Development Co. to meet it's
responsibilities. It appears reasonable to expect the trees to be replaced tl
no later than November 15 1980. If
you are unable to meet that deadline I
would anticipate and fully expect to receive full monetary compensation for
my loss to the extent of having cs commercial landscaper remove the existing" •
trees and provide replacements

NW and NE corners of Idjacent subdivision lots. Also, we do not know what '
type Of screening the future subdivision lot owners will desire. Therefore, '
we intend to place the center-line of the fence approximately six--inches north
of our mutual property line. Consequently, we request that you sign and return

Your latest correspondence to me describing your intentions of fulfilling
the Site Design Review requirement is acceptable with the following correction: ' '

On the north property line of lots 34 and portion of 33 which abutts the , '
southern property line of the Scheckla's property, the five foot high
arborvitaes will be planted at 30" on center along this lot width at .

As you are probably aware, your south property line adjoins our subdivision.
The City of Tigard has instructed us to build a 6-feet hi gh ce d ar fence ce along the
north property line of our subdivision. However, several property owners along
this line have expressed an i ,ceros t i9 our utilizing closely-spaced trees instead
" of a fence to meet the goals of privacy and noise-control .
We are willing, provided that the City agrees, to substitute landscaping improvements
for fencing. However, we are extremely reluctant to alternate sections of fencing;
and trees along the subdivision property line because it would detract from the trim
and balanced appearance which we have worked to achieve. Consequently, we are
asking for "ballots' from adjacent property-owners, which we will deliver to the City .
of Tigard Planning Department.
If wood fencing is to be installed, we will -- where necessary -- give up 6- or 12-
inches of our property to minimize the trimming of adjacent landscaping along the
property line. If a 'tree-fence" is to be installed, we will compliment adjacent
property-owners' landscaping improvements and will plant trees just inside our property
line.
We have enclosed a questionaire and a self-addressed envelope for your convenience.
Please call if you have any questions (777-5633) . Also enclosed is a copy of the
"Standard Design" for fencing, which has been approved by the City of Tigard Board
of Design Review: Your prompt reply would be greatly appreciated.

• We reel that a'fence` would I be detrarnental. to our 15 foot cedar hedge. .
'i • This hedge was planted 14 years ago with the idea of providing privacy .

property behind us was developed. Each tree has been appraised •
at $150.00. It is difficult ,to go between the trees and we feel that

received this letter yesterday July 11th I had not
received any correspondence regarding design review for
this project.
I know that Nancy was going to prepare a letter however
she stated that she would have to review it with Dick
Bowlin before it would be approved. I Would assume this
letter was " lost" in Bowlin ' s file of the prc;ject and
never sent.
The storm water retention plan referred, to was hand

delivered to the city of Tigard (John Laws ) , on May 24th
( see transmittal ) , prior to the design review submittal .
This was poi nted out to Nancy when the plans for the
